Raith call out SFA plans for Appellate Tribunal

1262

You wonder if Ally McCoist rues the day he called for the public outing of members of the SFA Judicial Panel which imposed a player registration ban on his club.  One judge, one journalist and one football club, Raith Rovers, were soon outed.  Crossing the Fifers was a mistake.

Raith Rovers are now pointing out the same facts we have discussed here for months:

“We are also concerned that there has not as yet been an opportunity for clubs to receive legal advice from the SFL and/or debate the potential consequences on the smooth running of our league in the event that the Courts are asked to annull/strike down any of the corporate transactions that have led to the current position of Sevco Scotland Ltd as owners of certain assets of the Rangers oldco.

“Indeed, the position as regards the potential sanctions to be applied by the Scottish FA via its Appellate Tribunal has also still to be bottomed out.”

In short, Sevco’s ownership of Ibrox may be nullified by the courts and the SFA will be forced to subvert judicial oversight if it wants to guarantee Sevco participate in football next season.

While these concerns were only expressed online, the SFA were able to ignore the issue, but with Raith Rovers asking the questions Mr Regan will have to look SFL clubs in the eye and tell them what he’s going to do with Lord Carloway.

Dwyer O’Hagan, or Lurgan 53 as he was known here, passed away on Wednesday after an illness stretching back to last year.  Dwyer enjoyed our triumphs and defeats on the blog for many years and will be sadly missed by us all.  Our condolences to his family and friends.

    Philbhoy,

The only people who will effect any change in Scottish football are the supporters – and that is the supporters of all clubs excluding Sevco.

Only the threat of reduced season tickets brought the SPL into line – they were faced with a financial alternative worse than life without Rangers.

However, notice how Doncaster is still in position despite calls by many on this site (including Paul 67) for his removal and/or confidence votes – cue tumbleweed.

Similarly both Ogilvie and Regan by their actions and words should have been in resignation positions by now – but still they sit tight and tough it out.

Only supporter power will effect change – and that might involve a few more financial threats…

Exactly mate and all is not lost, the next challenge has been laid down.

There needs to be a concentrated effort in highlighting this to the Chairman/Directors of the SFL Clubs. That they CAN control the outcome and that “…the vote that never was” as predicted by Alex in reality becomes the vote that is made to tell ‘The Board’ (SFL Board) that they will not be bullied and that the dead club will be treated the same as Clubs that have gone before them e.g. Livingston. No special treatment, they were kicked out of the SPL for their years of cheating, if resolution (i) is passed to allow them into the SFL then resolution (ii) MUST not be passed, if this is defeated they will HAVE to start in Division Three. It really is that simple. We must get it out there, SFL Clubs vote no to resolution (ii) and they are in Division three.

    Keep the Faith!

    Hail Hail!

  7. Do Celtic have a position on whether the sevco huns should be allowed into division 1?

Or have they now washed their hands of the matter?

Thank You for the very informed insight, I appreciate it.

Talking about young James, I feel he will have an even better season this year. James was sensational last season and he is the type of player we have to nurture through continuously. I am a big fan of Victor and Beram and I know Beram will drive Celtic on superbly well this season but for me, James will be the real star of Celtic this coming season and, if I am right, we should all be very proud of Celtic’s youth system.

I remember when me and my Bhoy done the tour of the Nou Camp in 2004 just after the king signed for them, could’nt help but notice how friendly the staff were, right down to the security guards. The two of us were decked out in the full hoops kit.

Cannot forget the look on the girls face when I bought my son the Barca top and asked her put Larsson on it, apparantly the staff were discussing that they had run out of the letter ‘s’ and they were hoping the customers asked for Eto and Deco. Anyway the girl had to go somewhere to pick up more letters, must have been a good walk we had to wait for 15 miniutes, Her face was a picture.

Looks like whoever came up with the latest strategy never checked FIFA Statues (thanks to steer from alex o henley)

Will the SFL Board apply the first principle of sporting merit?

Do Sevco meet the licensing requirements unde 2? The SFA should advise.

How will the SFA explain away 3 to FIFA?

How do the SFA explain 5?

or are FIFA Statutes not so much rules but (in pirate terms) more guidelines?

Article 19 Principle of promotion and relegation

1 A club’s entitlement to take part in a domestic league championship

shall depend principally on sporting merit. A club shall qualify for

a domestic league championship by remaining in a certain division

or by being promoted or relegated to another at the end of a season.

2 In addition to qualification on sporting merit, a club’s participation

in a domestic league championship may be subject to other criteria

within the scope of the licensing procedure, whereby the emphasis

is on sporting, infrastructural, administrative, legal and financial

considerations. Licensing decisions must be able to be examined

by the Member’s body of appeal.

3 Altering the legal form or company structure of a club to facilitate

its qualification on sporting merit and/or its receipt of a licence for

a domestic league championship, to the detriment of the integrity

of a sports competition, is prohibited. This includes, for example,

changing the headquarters, changing the name or transferring

stakeholdings between different clubs. Prohibitive decisions must be

able to be examined by the Member’s body of appeal.

4 Each Member is responsible for deciding national issues, which may

not be delegated to the Leagues. Each Confederation is responsible

for deciding issues involving more than one Association concerning

its own territory. FIFA is responsible for deciding international

issues involving more than one Confederation

  14. Wrt to generating opposition to the latest SFL proposals I thinkoffers of financial rewards from fans of other clubs are likely to be more effective than financial threats – a pledge from fans of SPL clubs to attend at least two ganes per season at their local SFL club should more or less cancel out potential shortfalls

    VertWolf

  15. everyone needs to relax a little, i think these proposals add up to eaith a yes to 3rd division or yes to 1st division subject to structural changes.

proposal 1 = vote to be assocaite member and therefore the right to apply for sfl league status, if successful every club starts in 3rd division.

proposal 2 = vote to allow them into 1st division and we’ll make sure we get changes agreed.

both of these require, i suspect would require a 66% vote because both involve rule change, is that not the case

hence, these proposal could actually be a good thing, did anyone actually think the would word the question in such a way that it would alianate the huns fans should they be playing in the slf?

A wee scenario on Rankers and why going into Div 1 could be a good thing …

Lots of talk at the moment, that the Green consortium has limited funding. It is also rumoured that season ticket sales are non existent.

If Rankers go into Div 3 , I suspect that either through a second bout of administration caused by a lack of income or , some other force, net result is that THOSE WAITING IN THE WINGS ( Brown, Walter etc), come in , the fans rally behind, start and within 3 years they are back …possibly burdened by the football club not owning the stadium.

Option two is they go into Div1, Green and co try to make a go of it, stumble through for 12 /18 months and then go into administration again, caused by a ‘get them out campaign’ led by Brown etc. The current circus starts again, and a 3/4 year recovery becomes 6/7 years.

Ask any fans of Rankers and their preference is to go into Div 3, which is why I am in the Div 1 camp.

No. There is no provision in the rulebook stating that new clubs must start at the bottom. If they vote yes to measure 1), and no to measure 2), Rangers enter the SFL. It would then be at the discretion of the SFL board, consisting among others of Rangers shareholder David Longmuir and fellow shareholder and RFFF supporter Jim Ballantyne, as to which division they play in. Yeah.

  26. SFL board apparently: Gordon MacDougall (Livingston), Jim Ballantyne (Airdrie), Ewan Cameron (Alloa), Anne McKeown (Arbroath) Gilbert Lawrie (Dumbarton), Malky Mackay (Queens Park), Ken Ferguson (Brechin), Jim Leishman (Dunfermline)

I suppose the best we could hope for is the 3rd div, and going by clashcitybhoy’s post, div 1 might not be the disaster we all think, the competition is stiff enough there, especially for a decemated team.

But unless the referees are sorted, it matters not a jot where they end up.
