Record correct, SFA prepare to disband Appellate Panel

1122

This morning’s article in the Daily Record is not a work of fiction.  They reported that SFA chief executive Stewart Regan’s “bid to deliver a broad consensus over the way forward also involved discussions over the appellate tribunal’s transfer embargo on Rangers.”

In short, the SFA discussed changing their rules to disband the Independent Appellate Panel process before instructing Lord Carloway to sit in response to the Court of Session’s rejection of his previous judgement.

With two further Independent Judicial Tribunals still to sit in judgement on the actions of Rangers, for the illegal registration of players and non-payment of social taxes during the EBT era, the SFA will also subvert these rules before ‘Rangers’ are expelled from the Association.

After the meeting Regan left for his summer vacation without instructing Lord Carloway to convene the Appellate Panel.

That’s not all.

The scam to establish an SLP 2 in order to allow the SFA and SPL to co-opt ‘Rangers’ into that league is what the governing bodies have planned for your game.

If rules are changed AFTER a club is found guilty and in receipt of a penalty in order to nullify that penalty the game in this country is broke, ethically and financially.  Having established independent judicial panels to deal with serious rule breaches the SFA cannot do Rangers bidding without removing all judicial oversight.

We’re back to the days of George Peat walking in and out of hearings for the Celtic manager.

Most disturbingly of all, YOU are the cash cow for this outrageous enterprise.  With Rangers gone from the SPL Celtic fans bring all the commercial and television income into the game, and are set to buy more away ground tickets than all other clubs put together.

You are expected to continue to cough up for tickets to Tynecastle, Rugby Park etc, and subscribe to ESPN and Sky Sports – money which will divvied up among SPL 1 and SPL 2 teams, as well as they rest of the Scottish Football League clubs, to compensate for them missing out on a ‘Rangers’ game.

You will also pay more money for those tickets than any other group of fans in the league.  Why don’t you just write a cheque to Kilmarnock, Falkirk or Cowdenbeath today?

This nonsense will not bring another £1 into the game, all it will do is redistribute money from your pocket to clubs who care nothing for you.  Partick Thistle yesterday released a statement on their site, “We believe Scottish football needs to be restructured, financial distribution needs to be fairer for all clubs”.

“Financial distribution needs to be fairer”!  Patrick Thistle get to keep all their ticket sales, commercial and other income.  By “fairer” they mean they want some of your money.  If you agree with them, write them a cheque, but if you disagree, you better figure out what to do next.

Thoughts that some great victory has been achieved are premature.   Prepare for the next instalment.

Our domestic competition is, at best, uninspiring.  This disgusting land-grab for your cash will destroy our ability to compete in Europe, and it’s not just the senior team who will suffer.  The Celtic youth system costs millions to operate each year, don’t fantasise that it will survive intact.

Celtic currently employ 27 Scotland youth internationals.  They are almost single-handedly carrying the future of our national team.  This attempt to bleed your club dry will devastate all areas, with subsequent consequences for the Scotland team.

It’s not often I’ve told you the Daily Record have nailed a story but this one is on the money (your money).  I’m at a loss as to what to do next.

We cannot accept this.

  4. Green is a business man who is involved in football. He is not an ambitious football man who’s in this for the glory. If you look at what he did at Sheffield Utd. He sold their top 2 players when they had the chance of promotion.

I reckon he knows that he can’t cope with the current structure and that he is planning to get down to a budget of paying players £2k average per week in front of 25,000 hardcore fans every 2nd week.

A £4m wage bill and £13m income works but if the 25,000 supporters turns out to be 10,000 it doesn’t. I wonder if he has looked at attendences prior to Souness arriving.

That being said I think that if the “Cardigans” came in with an £8m bid he would now sell the day before tomorrow. He must realise now that they are totally toxic and beyond salvation.

  6. Lots of comments on a newco sting on Scottish football. There is another sting going on though which is by Charles Green/ Duffer &Co and Craig Whyte on the team that used to be Rangers. The first sting may see a newco unfairly placed in an SPL2 with little punishment whilst the second could see no club playing anywhere for some time. It’s a race and I know which one my money is on!

  7. Billy Dodds should be more concerned with HMRC knocking on his door looking for their money rather than his toddler tantrum about taking his SPL medal away.

Why mention Lubo and Viduka and the 21 point winning margin? you cheated Billy, the dice were loaded and you cannot get your head around the end of your supremacist club. Tainted titles indeed!

The intentional misrepresenting of the TUPE regs is outrageous

Huns know what the regs say , they cannot have legal advice as they claim …. No lawyer could have given such advice

Also , it would take any interested journo about 5 mins to understand that the Hun position is wrong …why are they not doing it?

    ———-

Agreed PF. The clue is in the name, “Protection of Employment”. Charles Green is a recidivist liar whose dishonesty could be exposed by a primary school child. The MSM? They come into the same category and have not deigned to question Charles on the drivel he spouts.

As for “interested journos”, the vast majority has an interest in getting the Huns back to their “rightful place”. They continue to spin the lie that the club and the old company are different entities in the same way as the Orcs do. The technique is to say something often enough so that it gradually becomes accepted.

Why are they misrepresenting the import of TUPE? It can’t be in order to fool the players into thinking they have to transfer. Players will have ready access to legal advice from other than Declan. The only reason I can think is that they are pulling out all the stops to portray Rangers (whatever that is) as the victims in all of this. If players leave, as they will, the finger can be pointed at them as leaving a sinking ship and breaching their contracts to boot. It’s a pretty lame explanation but it’s all I can come up with. The stupid Hun I quoted mentions ambiguity in the legislation but that’s more tripe – it’s as clear as day.

  9. Things not going to plan for the SFA/SPL?

A long time ago when they hastily changed the rules to ‘a vote’ due to the impending death of Ragers, they sat brazenly with their feet up thinking they’d covered their butt, they saw Ragers financial apocalypse coming, before supportive MSM would dare write about it.

They saw administration before MSM would mention it, and no doubt they thought were covered with the Gerrymandered vote when the inevitable liquidation arrived, but things were not going to plan even the outcome of an open vote of SPL clubs was clearly misjudged.

Now they want to reinvent themselves inside a fortnight, all to save Ragers from the only chance they have which is Division Three, leaving it up to the

So if you were in another football club and you fancied signing up Master McCade on a free well fair dos.

Now then if there was a possibility of Sevco coming after you for a(n unknown/specified) fee sometime in the future would you sign Rhys or Joe Bloggs? Not so clear cut.

Which brings me on to a couple of points…

Firstly like most I have seen Company acquisitions/take overs, in ALL cases the key personnel are interviewed and their positions are clarified before the deal is done.

As Alex Thompson suggests in his Turkish piece the standard of “Businessmen” you have in Corporates and those associated with R@ngers are somewhat different.

Yet one guy we know Mr Green had discussions with is Manager McCoist, pressure was put on Mr Green by some heavy hitters in Scotland to ensure Ally was not upset.

My contention would be that Mr McCoist would have spoken to his Lawyer, enlisted the help of some pals and negotiated a deal for himself.

It is therefore totally disgraceful that young Footballers who embark on the same process and have been ignored by Messers Green and McCoist, who were too busy looking after numero uno, put pressure on these guys like Dock side bullies.

Just as they would destroy Scottish Football before they see their club get it’s just desserts, they would damage footballers’ careers and more rather than allow them to ply their trade elsewhere without them wetting their beak.

Good morning fellow Celts from windy West London..rain not far away!

Force them to play by their own rules..it does for them, eventually.

A good few years ago I was working in a global business with a significant operations in West of Scotland. There were huge cost challenges and each year they were going through redundancy programmes…the headcount was reducing annually by 6 or 7 – the people impacted had long service and they were unlikely to find similar roles elsewhere and faced possibly the rest of their lives on the scrapheap.

As the new guy, the management team assured me that there was a robust selection process in place, visible and equitable. That ‘custom and practice’ demanded that we continue to follow that model, no need for me to get involved at all. My antenna always begins to get twitchy when I hear….custom & practice…no need to get involved. Maybe I had lived in Clydeside too long.

In genial tones I agreed, it sounded like a good process and in the interests of fairness and compliance could I see outcomes of the last two rounds . Much scowling, but compliance was assured as they knew a refusal would sound odd. Later that day there was a senior meeting that no-one invited me to. Strange. The following morning I received the files as requested.

The process looked fair, criteria was relevant to the group and I had little or nothing to be concerned about…except, I noticed that they were drawing strange lines around the ‘at risk’ groups I.E. bringing some roles in and leaving others out. The Job Descriptions looked similar and responsibilities were the same, yet some names were included whilst others were excluded. I couldn’t establish a valid reason and resolved to find out why.

A few months earlier in one of my first meetings with the team, one of the guys asked if he could speak to me. He was concerned that he was being continually (yearly) dragged into selection criteria when he shouldn’t and there were other guys who were being “protected” and was there anything I could do. I put it down to a guy moaning when he had escaped redundancy in the last few years and others were not so fortunate. My view at the time was ‘times are tough, get over it’.

Here I was almost 6 months later looking at his name on the old files I had been given. It was evident that his fears were founded he was correct and it was becoming clear to me why. He had escaped twice simply because he was very good at his job. There were others who should have been in the pot that would not have survived. I had been in the business long enough to know why threy were being protected!

At the following scheduled meeting I thanked the managers for sharing the selection criteria and made no mention of the grouping for previous years. I did however, ask when the current groups were being drawn up? Silence for a few moments, then the leader explained he had chaired that meeting earlier in the week. I was surprised and said so ….why was I not included? I got the ‘did you not see the invite?’ routine. Well No! or I would have been there.

Remaining calm, I simply asked to see a copy if the selection groups, with the supporting statements from each manager. They were clearly not happy but complied.

Later that day I had a surprise visitor, the business leader popped by for a wee chat. His general tone was amicable enough while he made me aware that the ‘guys’ were wondering why I wanted to see data …that had never been asked for before. My reply was direct. I was surprised that my predecessor had failed to validate the process. For good measure I also made it clear that I would expect an invite to the ’round-up and leveling’ sessions before any redundancy decisions were made. He agreed and left sharpish.

I had been appointed into my role by a European leader. The local managers had an opportunity to meet me before decision was made but it was a ‘done deal’ and they knew it. My next step was to give my Euro boss a call, I was very candid with her and explained what I had discovered and the reasons why it had been happening. I spelled out the risks for the business if it ever came out. She was astonished and when I explained that their next move would be a vote of no confidence in me, she almost went mad. I explained that I was from the same target demographic group and would need ‘head cover’.

The round up sessions had external visitors. My Euro boss and her boss from the States. They had asked the local leader for a personal invite.

Outcome was the gerrymandering of selections groups was resolved and a few of the team left as part of the redundancy programme. The leaders did ask for me to be replaced as predicted. Three years later I was still there and promoted to department Head in UK. Everything would come through me every re-org, policy, procedure, every disciplinary and grievance….and most important of all …I was in the room when performance and career progression was being discussed for every UK manager…every promotion needed my stamp of approval!

Make them follow the process…check they are following it and call them to account when they are not.

What those in charge seem unaware of is that by taking the steps they are attemping to take they are saying that “Rangers” are so important to our game they are above the law that governs the game. This perception will be applied to every refereeing decision in their favour because referees are part of the same authority that are doing there best not to order off the equivalent of a deliberate leg breaking tackle by a Joey Barton type player.

What is the point of an SPL2 if those in charge set it up so that SPL1 is deprived of one if its main income streams for as short a time as possible.

It dooms SPL2 before a ball is kicked and if after 3 years UEFA money becomes essential for Newco, then SPL1 experiences the same contaigion it did from 2009.

This is why the detoxification Alex T speaks of is so important because without it the game will always be poisoned and those in charge are now administering the poison rather than removing it.
