Relief and despair at Hearts CVA success

There is a degree of relief (in some quarters) mixed with surprise that Hearts creditors have agreed to a CVA, allowing the club to exit administration.  Although administration seems to be a natural state for many in Scottish football, remarkably few have subsequently gone to the wall in the last 100 years.

Third Lanark perished in 1967, an exception during many decades of solvent behaviour.  Airdrieoneans (not to be confused with the current club by that name, which is the renamed and relocated Clydebank FC) were liquidated in 2002, with the chastising words of creditor Sir David Murray ringing in their ears.  Oh how well irony played its hand.

Murray’s own club, Rangers (not to be confused with the current club by that name), were next to be liquidation after creditor, HMRC, stuck by their published rules and rejected a proposed CVA.

Apart from this, a remarkable series of campaigns, such as ‘Well worth saving’ and ‘Save the Jags’ has seen supporters step forward and find the money to save their club from that ominous fate.

There appears to couple of rules if you want to escape liquidation.  Try to ensure 75% of your creditor value is owed to shareholder-creditors or the bank.  Many clubs survive on directors’ loan accounts, which are ultimately forgiven in administration.  Banks too have been reluctant to kill the local totem, with good commercial reason.

The major thing to avoid appears to be breaking tax law. HMRC are prevented by its own terms of business from forgiving tax debt which has been run up through illegal tax evasion.  This was the case at (original) Rangers, who conceded some of their tax dealings were not legal during 2012’s Lower Tier Tribunal.  The balance of cases are disputed and currently subject to an Upper Tier Tribunal.

Hearts success makes for an interesting SPFL Championship race this season.  With three games to go Dundee hold a two point advantage over Hamilton.  The winner will go up, second place will face a play-off, but neither club will fancy fighting Hearts for promotion next season.  I can imagine the despair elsewhere to the news that Hearts will be a Championship club next season.  Poor Ally will need to get his game together.

    I’ll make a prediction. Once the whole truth comes out, not just the financial doping by BoS, or tax evasion but the attempts at covering it all up by the SFA, the LNS Commission (what a lie that is btw) , the smsm and lies told by CW’s Rangers, then by CG’s RIFC/TRFC, the last thing anyone will want it is to be associated with that revealed memory or its history.

     

     

    In fact the truth is so unbelievable we will be accused of making it up, yet the evidence is all there right now, but no one wants to look for fear of what it reveals about Scottish society.

    First games are tonight……

     

     

    Lanus (14) v Santos Laguna ( 3 )

     

    Lanus, currently in 4th place, two points off leaders, Estudiantes in the Argentinian Clausura handed out an away 4-1 spanking to San Lorenzo at the weekend. Both teams showing the exertions of their previous, midweek performances. However, Lanus seemed to be better organized in terms of depth of squad and ended up winning the match quite comfortably. This result will certainly buoy their confidence for the game tonight.

     

     

    Lanus still without captain Paolo Goltz have a few injuries and are forced to look, prematurely, for big things from youthful midfield duo, Marcos Astina (18) and Jorge Valdez Chamorro (20) who have performed well for Lanus this season.

     

     

    Finally, it’s a wee statistical Libertadores oddity that teams (like Lanus) who’ve qualified in second spot with only eight points have never made it beyond this stage of the competition.

     

     

    Santos (4th in Liga-Mx, 9 points off leaders, Cruz Azul) also involved in a high scoring game at the weekend, when they relegated Atlante with a 4-3 home win and took a step closer confirming a league play-off spot. Darwin Quintero scoring a hat trick in this one.

     

     

    Quintero along with strike partners Oribe Peralta and Andres Renteria in particular fine form at the moment. Marc Crossas must’ve done something right in last week’s 3-0 defeat against Arsenal in Buenos Aires, as he’s also in the squad for this game tonight.

     

    Prediction – This will be tight, but I fancy Santos to JUST edge it.

     

    AWAY WIN (55%)

     

     

    Léon ( 11 ) v Bolivar ( 6 )

     

    These two teams played each other in the Group stage, with Bolivar snatching a surprise 1-0 victory on their last visit to Mexico.

     

     

    Léon lost 2-1 at the weekend in a match that virtually ends their championship hopes (they are in 15th position in the league). However, Argentinian manager, Gustavo Matosas didn’t seem to perturbed about that (they fielded virtually a Youth squad) and spent more time underlining the fact that now was the time for youth in the National tournament, while his full squad would remain focused on the Libertadores. Striker, Mauro Boselli promising that tonight they will not slip up and will seal this game, convincingly, tonight.

     

     

    Bolivar, currently fourth in the Bolivian Clausura, 5 points behind leaders, San Jose, recorded a solid 2-1 away win to Wilsterman’s at the weekend. Bolivar are a well drilled team who follow veteran Basque coach (the man who took Bolivar to their only World Cup finals in ’94), Xabier Azkargorta, game plan’s rigidly.

     

     

    Bolivar have a full strength team tonight, bolstered by the return of Damir Miranda in centre mid. However, the performance of Bolivar keeper, Rómel Quinonez (21) who is attracting a lot of transfer interest right now, maybe a key in this game.

     

    Prediction – Léon slipped once before, don’t think they’ll make the same mistake again.

     

    HOME WIN (65%)

     

     

    Cruzeiro ( 10 ) v Cerro Porteño ( 7 )

     

    Cruzeiro, unbeaten at home, with a total of 13 goals are the highest scoring team in the tournament. Cerro have Julio dos Santos with 5 goals (3 of them pens) the highest scoring player in the tournament.

     

     

    A full strength Cruzeiro side held onto a 0-0 draw against main rivals, Atletico-MG to win the Minas Gerais State championship on Sunday. However, Cruzeiro have key players Dagoberto and Goulart (with 4 goals, their top scorer) out tonight. That being said they have able replacements in Willian and Julio Baptista. Also, under particular scrutiny will be their Paraguayan left back, Miguel Samudio, just back from suspension.

     

     

    Cerro in 7th place in the Parguayan Apertura with 9 pts drew 3-3 with fellow mid tablers, Rubio Nu on Saturday. Cerro now have gone seven games without a win, but fielded a mixed side for this game.

     

     

    Cerro flew to Brasil with a full squad of 20players for this game and trained earlier today in the Minerão where a 50,000+ crowd is expected for to night’s match.

     

    Prediction – The loss of Goulart main worry for Cruzeiro here. Cerro likely to park the bus.

    We expect more from our club. We also owe it to those who have supported our club and unbeknown to them have been CHEATED out of titles, cups and more latterly Champions league revenue by a club that refused to pay its taxes and used illegal means to gain a COMPETETIVE advantage. Some of these supporters are no longer with us and even though we knew it was going on we did not have the proof. Now we have the proof and we are reluctant to use it.

     

    Does anyone seriously think that the SFA would have came after Celtic for billing the U17 game as Celtic V The Rangers. It would have done nothing more than highlight the hypocrisy of the SFA with regard to the NEW club.

     

    We also need to take on the SPFL with regard to their website describing the 3rd tier club as being in possession of 54 titles. If they want “their history” then they should have paid their debts. They didn’t and as a consequence they died. We owe it to all of those past supporters mentioned above who were not around to witness their demise to REMIND them at EVERY opportunity that The Rangers are a new club.

     

    I expect no less from my club who have played by the rules and suffered for it AND it does matter what we call them. If we continue to refer to them as “Rangers” we confer a legitimacy on all of their underhand tactics such as the 5 way agreement et al to pretend that nothing ever happened and that they are the same club.

    Good points. It could be none of the creditors who were robbed of their money by RFCPLC have notified the relevant body on this matter.

     

     

    But you have to remember the outcome of the big tax case has still to be decided. Should the decision favour HMRC then the use of the name, the symbols and the claim to be the same club could have catastrophic consequences for Sevco. At the very least Sevco will have to drop the pretence and be very public about it.

     

     

    The accounts that were made public by Sevco last week stated: ‘club incorporated 2012’.

    The sfa are still breaking the rules for them.

     

     

    As I have said before, and I will keep saying it……….

     

     

    Sort the referees first and foremost, and then everything else will fall into place.

     

     

    I want our game back, we all want our game back, though in scotland it seems that a level playing field is too much to ask for.

     

     

    Why are the club not pushing for a fair, honest and transparent refereeing system ?

     

     

    They have nothing to lose and everything to gain.

    If they refuse, questions have to be asked as to why, and what have they got to hide.

    I understand your point regarding referees. I watched the Sevco match on Saturday. Foster wasn’t even booked for a red card challenge on Armstromg. McCulloch wrestled Mark Wilson round the neck and dumped him on the deck at a Sevco free-kick. Not only did Madden not book Elbows, he awarded a retake of the Sevco free-kick. Dundee United were denied the definition of penalty kick. I could go on.

     

     

    But here is the problem. Celtic had no involvement in the match. Celtic have had no involvement in any Sevco games. On what basis can they make demands? Surely Dundee United should be kicking up a fuss? Albion Rovers didn’t complain either, and we’ve all seen that decision.

     

     

    No matter how annoying it is there are no grounds for Celtic getting involved.

    On what basis will a case for referee reform be made? If it only comes from Celtic them no matter how much the case is evidenced it will be viewed as serving only Celtic’s interests.

     

     

    However if it came from the SPFL which means all the clubs acting together on the grounds of good for the game improvement then that is an entirely different matter.

     

     

    The SFA would find that harder to argue against but then again Celtic might not be able to get the needed support from the rest of the league.

     

     

    The SFA would need to be open to the issue and how it was presented then becomes crucial hence the need to soften them up as well as garner support.

    More likely is the pragmatic approach as like me know its pointless considering the SFA referees will ram it back at you for complaining

    Unlikely anyone would be fined for stating they though the goalkeeper was fouled, or they thought they should have had a penalty.

     

     

    Terry Butcher wasn’t fined when he said he thought Hibs were denied a stonewall penalty against St Mirren, and when he thought they should have had a penalty against Celtic, or when he thought it was a terrible decision to give offside when they scored against Hearts.

     

     

    And he was right every time. But Hibs haven’t asked for an overhaul of the system.

     

     

    We all have our own thoughts but bias is very difficult to prove.
