Season will be decided on the field, not in the courts

I received a text early evening on 18th August last year: “Gongalves starts”.  Former Hearts player, Jose Gongalves, was one of a handful of players FC Sion signed illegally in the summer 2011 transfer window and he had been named to start against Celtic in the Europa League qualifier, first leg.

As a contest, the tie was over.  There followed two matches with considerable effort and drama from both teams but the eventual outcome was, literally, never in doubt, the courts would have their way.  Sion would be expelled from the competition and Celtic would progress to the group stage.

Today Celtic’s only remaining competitor from the chasing pack for the SPL title is up in court to face the HM Revenue and Customs.  The courts will have their way again but although you may feel the outcome of Rangers tax case is inevitable (I do), the impact on this season’s league championship is less assured.  Should they lose, Rangers have the option to appeal, postponing any negative impact on the company until next season at the earliest.

If Rangers have, or can generate, enough cash to keep the lights on this season the league will be nip and tuck until the end of the season. The tax case will attract most attention but if you are looking for indications of how the season is likely to go, keep an eye open for cash related incidents.

Well done to Rangers’ broadcast partner, STV, for their story this morning on SPL discipline.  They report the Ibrox club have the worst disciplinary record in the league, having accumulated a total of 41 bookings, contrasting starkly with the cool class at Celtic Park who are best behaved in the league with only 20 bookings.

With Beram Kayal out for the season Ki Sung-Yeung is the Celtic player closest to a suspension, a further three yellow cards would put the Korean over the threshold.  Rangers have Lafferty one booking, Edu and Bocanegra two, with Goian, Broadfoot, Bartley and Whittaker all three away from a suspension.  Lee McCulloch has only been booked twice this season but shows enormous potential.

    This is what I mean folks. 30 years they’ve been able to buy whoever they wanted, all of it in someone else’s tab. 30 YEARS. Sandaza is the level if they are living in their means. There is no end in sight to them having to shop in that market. This is the future, the forseeable future, long term.

     

     

    I understand why they’re having trouble with this. Could you adjust a 30 year mindset in five minutes? Or five months?

     

     

    There is a big dose of reality coming their way. It’s going to be awesome to watch.

    I’m not sure that’s correct.

     

     

    The letters didn’t spell out that the players would get their wages paid through an EBT.

     

     

    They just said that the club would pick up the tab if the EBT scheme proved innefective.

     

     

    That’s not quite the same thing.

    The players were given two contracts in effect.

     

     

    Contract 1 where they would pay tax on.

     

     

    Contract 2 where they would be paid by a trust, and the money received from the trust would not be liable for tax.

     

     

    The side letters were given to the players and their agent stating this, they were necessary as no player or agent would take the word of the club otherwise.

     

     

    These letters are confirmation that the hun have broken the rules set out by the football authoroties that player should only be paid by the club and no outside agency, hence they were not eligable for a euro licence.

     

     

    The fun is just begining.

    EBT’s should have been non-contractual.

     

     

    The side letters to players explaining the terms of the use of EBT’s and remuneration are contractual.

     

     

    EBT’s were used illegally in this instance.

     

     

    Huns would put money into EBT pot. Under normal circumstances loans would be made to those who are in the EBT to be paid back in 100 years although intention is that loan is more a gift/bonus with no real intention of them ever being paid back. In Huns case, because footballers and agents would never accept this based on oral communication they probs had to provide the contractual side letters. Apparently side letters would never have seen the light of day if it was not for the Harry Rednap investigations with City of London police when Rangers were raided and pc taken away.

No players, no staff, only an administrator to their name. Hope the locals can, either, inject enough money, or buy the club in time.     Keevins said something sensible there. IF thems lose (highly probable) it will have an impact on other Clubs. I have to say he is correct.

     

     

    Before I explain though, let me say this first. I want them gone, out, wiped from every record book…

     

     

    Keevins said every Club will have to cut their cloth if thems lose and he is right. However, there will still be a league. Now whether we want to be part of that league, it is another debate.

     

     

    He said thems cousins apart all other Clubs will survive.

     

     

    What I will say though is that thems going will impact on us if we do not move to another league. Why, in my opinion we will not pack Celtic Park when we are strolling the league against such as murderwell and will not spend money on players on this basis. As Paul put up a few days ago, if thems go we will not see the likes of the 28th December for a long time to come.

  20. Just reading on New Years Day 1965 at Ibrox, Jimmy Johnstone was repeatedly fouled by Rangers Tottie Beck and when he retaliated, Sending the Rangers player to the turf he was sent off. Beck miraculously recovered as soon as Jimmy had disappeared up the tunnel.

    Not just because it almost certainly guarantees defeat in the Big Tax Case for RFC…

     

     

    But I would think RFC would be obliged to disclose ALL player contracts to the SFA at the time of them being signed.

     

     

    If they didn’t, RFC have made an absolute mockery of football administration in Scotland, with potential licensing issues arising. If they did, and the SFA did nothing, then the SFA is up 5*** creek…

     

     

    Either RFC or the SFA could be wide open to massive lawsuits from Celtic and other clubs.
