SFA and Sevco agree on embargo

719

This evening we received clarity on two items first reported here and on several other locations months ago.  Sevco have accepted the 12 month player registration embargo handed down by Lord Carloway’s Appellate Tribunal as a condition of their application for membership of the SFA, while Fifa have granted four former Rangers players permission to sign for new clubs.

The SFA, under president Campbell Ogilvie, took every step possible to alert Sevco that if they did not accept the transfer embargo a more severe penalty would be imposed on Rangers, whose licence they are trying to acquire.  Hopes of “elimination” from the Scottish Cup as an alternative punishment were based on false logic, and were also just silly.

Sevco disputed the embargo, hoping the SFA would offer to set it aside, as it tried to set-aside so many other rules to accommodate them in recent weeks, however, the best the new company could achieve was an accommodation to allow them to stock up on players over the next five weeks in order to off-set the effects of so many players ‘walking away’.

There is a chance this decision will save Sevco a second season in the SFL Third Division but there remains many hurdles for the new club to achieve before they start and complete a football season.

No mention yet of what the SFA and SPL plan to do with the plethora of other disciplinary matters due against Rangers, or how they proposed to prevent their own independent judicial process from reaching an inconvenient verdict.

  1. The SFA are at it here, big style.

They know the huns scored an own goal when they went to court to challenge the transfer ban.

Lord Glennie’s decision is an open invitation to the Appellate Tribunal to impose a suspension of membership.

To let the huns off with a transfer ban, after they have challenged the decision in court, and then rendered the ban totally ineffective by delaying it until after the transfer window, is a craven dereliction of duty.

”[23] I should only add this. Mr O’Neill’s argument that the construction of the Articles and the Protocol at which I have arrived deprives the Tribunal of the power to impose a penalty which is both effective and proportionate, is not necessarily shared by the Appellate Tribunal. They concluded their reasons by saying this:

“Although the Appellate Tribunal agreed with the Disciplinary Tribunal that termination, suspension of membership would have been excessive, it made that assessment in the context of the availability of competent lesser sanctions such as the one actually imposed. Were that option not to have been available, suspension might have had to be considered appropriate for such serious misconduct, which has brought the game into disrepute.”

I need not mention the other matters to which they refer. I simply refer to that passage to suggest that Mr O’Neill’s argument that on the construction which I prefer the tribunal’s powers are either insufficient or excessive is not necessarily correct; and to point out that the fact that I find the imposition of the additional sanctions to be ultra vires does not necessarily mean that the petitioners will escape to a lighter and ineffective punishment. That is entirely a matter for the Appeal Tribunal and not for this court.”

    Indeed they are.

The SFA are fighting tooth and nail to preserve Der Hunnes in whatever shape or form they can.

    They wont give up.

How the SFA have got UEFA/FIFA on board with this would be an interesting revelation.

Since fair play and sporting integrity are once again being put to one side it would suggest the SFA are hoping a lack of will on the part of their members will see the day.

A dangerous precedent has been set here. Putting aside all the other creditors Der Hunnes is able to enter the transfer market, buy players if they so wish whilst their existing football debts remain unaccounted for.

It beggars belief that this will come to pass.

  9. How can an organisation with a tax cheat at it’s head (Campbell Ogilvie) be taken seriously.

He was a member of the Board of a club that cheated it’s way to various title and cups. He fully aware of the cheating even when he joined the SFA executive and became President.

Scottish Football can never be cleansed until this corrupt individual is removed from office and he is shamed for his behaviour.

  10. Morning all from gay Paree, enfin un peu de soleil (21C max)

The SFA have bent over backwards, inventing new rules as they go along, to allow SevCo to play this season.

The transfer emabrgo was imposed for wrongdoing last season.

What about the previous 15 to 20 seasons?

CG should be careful what he wishes for.

The SFA are very willing to facilitate things for the Hun, allowing them to pick and choose their penalties and sanctions. Effectively, allowing CG et al to say oldco equals newco (history intact).

HMRC’s liquidators may well take a totally different view.

Still a long way to go, but it’s all getting very “tiresome”… as ol’ Peaty chops used to say.

  11. Morning, huns are raging…

‘We have had days of discussions with

the SFA and it is important for

    everyone, but most importantly our

fans, to understand that the SFA said it

would only transfer the membership to

play football if we accepted some form

of additional sanctions for the sins of

    previous regimes,’ said Murray.

‘The choice is stark — take sanctions or

risk not playing football at all. We do

not wish to gamble with the club’s

future so, under duress, we have taken

the difficult decision to accept some

sanctions in order to move forward.

‘A delayed transfer ban would be a

bitter pill to swallow and will only be

agreed to if the alternative is no

    football.

‘We would have a window in which to

sign players, enabling the manager to

strengthen the squad which is critical for

the club to start the process of

    rebuilding.’

Murray also stated the deal with the

SFA would not rule out the prospect of

further punishment from the SPL, who

    are forming an independent

    commission to investigate alleged

double contracts from the oldco’s use

    of Employee Benefit Trusts.

‘We also regret that any agreement with

the SFA appears not to have the

support of the SPL and, as such, it still

wishes to impose further sanctions on

the club for the actions of previous

regimes despite already voting us out of

    its league,’ he added.

‘This is truly astounding to everyone at

the club who is now in charge of

    rebuilding Rangers from Division 3,

particularly as the SPL are still trying to

    benefit from our media rights.’

No I’m not out of order. And btw any first point of order would be to correct you in your assumption that Protestantism is a religion.

Rangers are a Protestant club, it’s steeped in their values and history. Nothing wrong with that at all.

I’m not making a sectarian remark when I ask where are the decent Protestants willing to uphold the values of their club?

Surely honesty, decency, and sporting integrity arent lost on all Protestant Rangers supporters?

    Where are they?

There’s a concerted media campaign being spearheaded presently by Protestant men such as Derek Johnstone and Jim Traynor, both of whom are readily willing to forgo Protestant values of honesty and integrity to preserve a long standing Protestant ideology of supremacism at Ibrox. They wont countenance anything different regardless of sporting integrity and neither will the majority of their suppport.

All his relations were dead, but at that address they directed him to another address and there he was welcomed with awe.

Take yer heed out the stump Kitty.

Protestantism is more a definition of the group of churches that broke off from the Catholic Church during the sixteenth century rather than a religion.
