SFA counsel checkmate on Tonev

When engaging in a civil case under Scots Law, where one witness’ testimony contradicts another, a sheriff will rule not just on what witnesses actually say, but on their demeanour, assertiveness, body language and other perceivable traits (I’m no lawyer but I’ve first-hand experience of this).

Alek Tonev’s SFA Appeal panel, faced with contradictory evidence, explained their decision on this basis, “Tonev gave his evidence in a guarded and hesitant manner”, whereas Shay Logan “gave his evidence in a careful and measured manner”.

Alek, Celtic, you and me are free to disagree with this verdict, or cite the fact that the player may have appeared hesitant because he was so uncomfortable speaking English, he attended with an interpreter (who was unused).  In these circumstances hesitancy appears normal, I can’t imagine speaking at a hearing conducted in French with anything but hesitancy, so to find against the player on this basis is blatantly incongruous, but that is a side point.

Celtic threatened to take the SFA to the Council of Arbitration for Sport (CAS).  My hunch is that before this Appeal was rejected, the SFA’s counsel confirmed that the panel were able to judge on matters of demeanour and manner.

CAS do not re-hear cases.  In this instance, they will only determine if the grounds on which the decision was made, and subsequent punishment, were within the rules of the governing body which conducted the appeal.  It is inconceivable that the SFA, who employed counsel, would return a verdict which they knew could be referred to CAS, if it broke one of their own rules.

Like you, I don’t have enough information to judge one way or the other on this one, so I’ll offer no view.  Don’t be stressed that our reputation will be damaged by the charge.  These incidents are so rare at Celtic they are headline news and recalled for decades (literally).  This is a good thing.

  2. Graham Spiers on STV tonight speaking about Mr Ashley. Worth 2.1 billion, and he might be a saviour for Sevco. Maybe I am a retard, as my family keep telling me. But, is it not the case that Ashley cannot be involved with two clubs, and that he and Sevco are subject to some disciplinary action because of this ? Maybe someone out there could enlighten me.

    The only solution I can come up with ….no season ticket well no ticket for away in Europe….. I am quite sure someone could come up with a system whereby your European away ticket is attributed to your season ticket pass and you travel with this and it is read by a hand held electronic device at the stadium you are visiting allowing you entry. It’s not foolproof but it would certainly make some think twice about purchasing a ticket for away in Europe and then passing it on

    TET, you know me. I hate to see Celtic being singled out for punishment when other perpetrators are ignored. I do however have a particular pet hate of flares and the morons in our support who use them.

     

     

    It looks like we are being singled out and made an example of here and I’d expect to see a surge of action against all other clubs who’s supporters use pyro at any eufa match from this point forward. This seems to set a new precedent. I look forward to seeing how Turkish teams are dealt with in the coming rounds.

    Celtic should refuse any tickets for away Euro games – Celtic Travel should be wound-up.

  25. I’m surprised at the appeal verdict. I would have thought that a Scottish court, in the absence of corroborating evidence, would have passed a verdict of not proven, as the SFA should have done.

    The ‘two club’ rule 19 is predicated by ‘without the express written permission of the Board’.

     

    The current charge may well be the SFA wishing to ensure the rule is properly observed but it is possible they wish merely to impose their right to be consulted and grant permission.

     

    Not suggesting this is the likely outcome but official sanction of Ashley’s effective takeover of Sevco is certainly an option on the basis of rule 19. Afterall its not as though there’s no history of goodwill towards Sevco. Speirs might not be as far off the mark as some are suggesting…

  31. The problem with all SFA actions/decisions is that they invariably create a rod for their own back.

     

    Having created conditional membership and a myriad of other rules, specifically to cater for the Sevco fiasco, any club is perfectly entitled to expect the same treatment should they find themselves in a similar situation.

     

     

    Thus too, with the Tonev decision. All it needs is an accusation of racism and you are automatically guilty – especially if you look uncomfortable under cross examination (or wearing a green & white top). But then again, perhaps if Tonev had turned up at the hearing wearing a royal blue, star laden top, he might just have received the “not proven” verdict which should have been the outcome.

     

     

    The SFA itself should be charged with bringing the game into disrepute.

     

    They have made Scottish football the laughing stock of the entire footballing world.

     

     

    All the SFA had to do was apply their own rules without fear or favour.

     

    Alas, they are filled with fear and so obviously show favour towards the establishment club or should I say clubs.

     

     

    No wonder they can’t get sponsors.

    Shay Logan’s tweet “Off you pop geezer” added an unsavory note and I’m sure we’ll be hearing more from this brash, hmm, confident witness.

     

     

    I’m a little confused why the SFA pursue racism with such zeal yet retain a laissez-faire approach to sectarianism. I’d suggest it’s time Celtic made some complaints but then again, with our ill-disciplined away support we may just expose our Achilles heal.
