SFA Judicial Panel opens on Res 12 issue

The SFA Judicial Panel Disciplinary Tribunal sit for the first time today to examine Rangers Uefa licence application in 2011, the subject of which was picked up by the ‘Res 12’ group of Celtic shareholders.  This application was made under Craig Whyte’s memorable tenure which saw the club withhold tax payments before the eventual appointment of liquidators.

Evidence of what took place was eventually heard in open court, at Whyte’s trial in Glasgow last year.  Rangers did not declare to the SFA they failed to make tax payments and should not have been granted a Uefa licence.  As a consequence, Celtic, who finished second in the league that year, were denied a chance to participate  in the Champions League qualifiers.

So far, so clear, but then the matter becomes subject to issues not heard in court, specifically the Five Way Agreement between the SFA, the (now defunct) Scottish Football League, the Scottish Premier League (now the Scottish Professional Football League), oldco Rangers (now also defunct) and Sevco Scotland (now newco Rangers).

This Agreement gave Sevco Scotland associate membership of the SFA and a place in the Scottish Football League in return for accepting some, though not all, of Rangers football penalties.  Newco When the SFA announced this Tribunal, Newco did not contest the guilt of Oldco, instead suggesting they had agreement of immunity on this matter.  The SFA clearly believe differently.

The Judicial Panel will first decide on its competency to hear the matter, based on whatever partial immunity Charles Green secured for Newco in 2012.  If the terms of the immunity is not sufficient to exempt the worst excesses of Craig Whyte, the panel’s punishment of Oldco will apply to Newco.

The extent of this one is significant, effectively cheating to gain entry to the Champions League.  I expect nothing less than a multi-year ban from European competition.

You will notice people switch seats of the Newco/Oldco debate with this subject.

Craig Whyte appointed administrators who would release the name ‘Rangers’ and associated intellectual property to Newco, unlike administrators at Airdrieonians in 2002, who refused the then Clydebank to rename themselves Airdrieonians.  The name was subsequently changed to Airdrieonians in 2013.

Whyte’s plan was to buy the brand name from Rangers administrators and put the Scottish football authorities on the spot.  In buying the assets from the administrators, Green had control of the name by the time of the Five Way Agreement, and he accepted some liabilities as a price for entry on the nod into Scottish football.

This resulted in a debate that will never end.  Newco claim continuity with Oldco when selling tickets, but not so much at times like this.  No ‘Say No to liquidation’ banners were noted in the asset register.

Green claimed Sevco Scotland “bought the history” from administrators Duff and Phelps (you will not be surprised to learn ‘the history’ was not on the asset list purchased).  Now lawyers for Green’s one-time rival for Oldco’s assets will try to fortify his work.

We’ll see if Dave King’s recent sabre-rattling has been effective.

    From middle to front. Leckie and Mooy were ok but the rest were pretty poor imo. Surprised to see so little of Cahill given his record at previous tourneys.

     

    Rogic produced a lot of good passing which would’ve produced more if his teammates were up to it imo. Looked a bit frustrated with his teammates at times against Peru.

     

     

    Would love to see Rogic stay long term , silky player who was born to grace the hoops

    I know this has been a long running issue and one I’ve tried to keep up with. Reading your post, although I’m aware we’re dealing with rats in a sack, has made me a little more optimistic.

     

    Think you guys have them banged to rights and there’s not much wriggle room.

     

    Huge thanks and admiration to the Res 12 bhoys who were like a dog with a bone and never ever gave up.

     

    This is probably the most important issue in Scottish football and without the Res 12’ers, normal service would have been allowed to resume.

    It’s the one outcome that suits the masonic cabal. It is the only leveller. Any other outcome,good or bad still leaves us in pole position with euro funding the gap.

     

     

    We may be able to survive the odd miss out on CL football but a country ban would need us to alter course considerably and move closer to the pack.

     

     

    Perhaps it’s the one outcome that might make the club do something serious for a change…

    I wish I had your faith, but I am a realist and scotland is scotland, a nation where cheating and corruption go hand in hand , as long as you are of the hun persuation, time after time they have been bang to rights, and time after time they have given the rest of the game the vicky, they are a law unto themselfs and they will always, by that I mean ALWAYS get the benefit of any doubts, so in effect get away with whatever they choose to do, they had a chairman who should be in the jail, I could go on and on and on and on but what’s the point, they are huns and scotland will do whatever it takes to admonish them, to say otherwise is getting the ordinary mans hopes up, it’s never gonna happen, and you as well as anyone knows it.

     

    DumBhoy suggested that an outright ban could be possible, I doubt it cos they know that for once our club would show their claws .

     

    If they get anything worse than a token punishment I will chop my legs off.

    I agree – they would have no compunction at all about taking down the whole of Scottish football with them; God knows, they’ve threatened to do exactly that on many occasions since 2012.

     

    But revenue streams – and the loss of them – are probably the only thing that will stop the Aberdeens, Hibs and Kilmarnocks, and everybody else who got a nice wee £400,000 windfall from us qualifying for the CL, from looking the other way and saying nowt.

     

    Not to mention us, and I would expect us to take the nuclear option if that happened, including withdrawal from the League.

    I agree with your spin on the hearing. I don’t expect any punishment for Sevco. I expect Rangers and Craig Whyte to be hammered and Craig banned from football for life.

     

     

    The 5 way agreement will not have envisaged such a scenario and Green will not have accepted any liability

     

     

    In the unlikely case that Sevco are punished for something then King won’t accept it and fight through all appeals and the courts as necessary and get Sevco to pay the Legal fees.

     

     

    Prediction no action against Sevco, no title stripping or punishment possible to Rangers. Bad Boys did it an ran away

    I tend to agree with Rock Tree Bhoy …

     

     

    As far as I can see, the Zombies have done the same thing as last time …. spent money they dont have, but hope to cover through future European revenue … they have a history of doing this (actually, they only have a very short history, but you know what I mean).

     

     

    They need European money to continue to operate…..

     

     

    So no European ban would be considered …because it would (or at least, should, if the rules were applied) push them to the edge, if not over the edge…

     

     

    As DD has said, Celtic want them to continue to operate ….,

     

     

    so, Celtic wont take any steps that would ensure a ban for them…. because it would jeopardize their existence… and Celtic want them around (slightly wounded, perhaps, but around) , because the OF is good for ticket sales …

     

     

    and Celtic fans have shown that, no matter what happens, they will continue to fill Celtic Park (at least, as long as we are winning …. what will happen when the zombies start winning … and at some point, they will…..remains to be seen)

    They don’t sign duds and Stuart Armstrong will do well in the EPL.

  19. Anyone expecting Sevco / Rangers to be punished by anything more than a wee slap on the wrist is going to be disappointed.

     

    Seems SA move to Southampton has been confirmed. Lets hope we put the funds generated to good use. Oh and i’m not talking about buying a spare set of blubs for our fancy new lights.

    Somewhere along the Resolution 12 appears to have been conflated with the 5 Way Agreement. By that I mean that any penalties levied by the Independent Panel cannot override anything already covered by said agreement, and presumably the final version of such, and that any penalties actually levied will not in any way reflect or be connected with the actions of RFC over the previous two decades, including those that ended in the Supreme Court. A fine then for deliberate oversight.
