SFA lawyers examine illegal registration responses

BBC today revealed that the SFA’s legal team are examining responses from the Associations 93 clubs to a letter dated 9 March, which reminded clubs of their responsibility to record financial records with the SFA and asking them to declare they have complied over the last 10 years.

The inquiry was established after reports that Rangers had illegally registered players for over a decade, excluding payments which were not taxed.  We can presume that as the legal team are investigating, there was at least one response which returned a noncompliance.

The SFA issued a deadline for responses of 6 April and under Article 86.1 any club not responding in a timely manner would be in breach, so it’s unclear why it has taken over two months to get to this stage, so why the legal team are only “examining responses”.

We look forward to hearing an early comment on this crucial matter from the executive.  It is enormously unfortunate that the SFA were unable to inform their AGM of the findings on Wednesday. BBC report that the Association legal team have yet to report to the Compliance Officer, which is the next step.

    My reading is that if Rangers had asked for the matter to go to the CAS the SFA may well have agreed forsome reason – but they would have had the right to say no.

     

     

    If there was to be a request for referral to CAS from Rangers following a second Appeal Tribunal, surely this time the SFA would definitely say no?

    Rangers men , through and through……well apart from Kennedy, who mercifully has disappeared after his cringeworthy press conference .

     

     

    What I don’t get is this. The offer they have to beat is £200k down and a loan of £8.3 million paying 8% per annum

     

     

    Does anyone think for even a nano second that if Green was trying to buy Celtic for such a pittance , he would be allowed to do so by the support. So what’s going on with the Blue Knights.

     

     

    Are Douglas Park and co , so cash strapped they can’t match that offer. Or do we have a different dynamic at play . Kennedy, the embarrassing one, claimed he had Whytes signature on a napkin or something similar . That guaranteed the shares . So Kennedy told us.

     

     

    Now Kennedy is a joke figure for the way he has courted publicity over this. He is also pally with the now totally discredited Souness. However Paul Murray is a credible figure. He may not be wealthy , however he is capable and knows how to put together a deal

     

     

    Why have they consistently failed to get over the line. I think it’s time he told us, or at least told the Rangers support. Preferably without the distraction of having Kennedy beside home dressed like the “big man” out of chewing the fat

    Well thought out post, as usual.

     

    What I don’t see is why HMRC would countenance letting CG walk away with the assets for a risible (ahem) quantum in advance of the liquidation proceedings. At that price, would it not be seen as simply hiving off the good stuff purely to put it beyond the reach of the creditors? Paulie Walnuts argues on RTC that there is far more value in selling off the assets separately than in the manner which D&P have carved up with Green. His argument convinces me, for one!

    Regarding Paul’s article:

     

    I’m also itching to know if Hearts returned a “nothing to declare” response to the SFA’s letter. I do not believe for one second that Campbell Ogilivie’s presence on the Hearts board of directors guarantees that scrupulous attention was paid to every administrative detail to ensure that all contracts complied with relevant rules, regulations, laws and statutes. That doesn’t seem to be the Great Administrator’s favourite gig.

    Tomorrow’s People’s chairman, David Stewart, spent much of his career at accountancy firm Deloittes where he was a former board member.  Deloittes recently teamed up with Ingeus to become one of the largest welfare to work companies in the UK and prime contractors for the Government’s flagship ‘Work Programme’ scheme.

     

     

    The charity’s Chief Executive, Baroness Debbie Scott, is a Tory life peer.  She was once Chief Executive of Iain Duncan Smith’s think tank, the Centre for Social Justice, a right wing bunch of loons who are believed to be among the chief  architects of the Government’s shambolic welfare reforms.

     

     

    It is therefore unlikely that the DWP will take any action against the charity, who have several lucrative sub-contracts for the Work Programme and other Government backed workfare schemes.

     

     

    Tomorrow’s People have been involved in workfare since before Blair’s New Deal in the late 90s and have long championed the idea of unpaid work.  They were involved in John Major’s doomed ‘Project Work’, a workfare scheme which was trialled in the dying days of the Major Government.

     

     

    The charity, which also has a string of former bankers and CEO’s on it’s board, has helped to give charitable cred to increasingly exploitative workfare schemes.  With the deep pockets of Diageo behind it, it has been one of the drivers of a culture which has ended with even homelessness and disability charities becoming involved in forced labour and administering benefit sanctions.

     

     

    It is therefore no surprise to find this bunch of wolves in sheep’s clothing behind the latest workfare scandal to rock the Government.  They really are all in it together and will push just as hard as they think they can get away with to destroy what’s left of the Welfare State.”

    The CelticResearch guy does great work, but I’d rather hear it from the SFA…

     

     

    …which brings us back to SFA QC Aidan O’Neill, who said it could have been referred to CAS. If he is speaking on behalf of the SFA, one must assume that the SFA would be willing to allow Rangers this option, even after the toing and froing involving the CoS. They could call it ‘special circumstances’ or find another one of those quirky terms they keep coming up with. It’s clear from what you and Gordon_J have posted that most legal minds think they can’t, but the route doesn’t look 100% closed.

    Fantastic post. It is interesting to note that while the Tories are throwing literally £billions at private “providers”, the DWP will not provide support for individuals who require specific qualifications, cards, certificates etc. Or who wish to train to be plant operators, drivers, or who need to pass a Health and Safety Test to get into certain workplaces. These providers eventually run out of money, only to be replaced by yet another snout in the public trough. Maybe the Government could provide a leaflet, helpful to those seeking work? ‘The roughsleepers guide to working in London’. That should do the trick!

    Apart from the Euro’s there’s an interesting Brasil v Argentina (ko 20:05 UK time) clash today.

     

     

    Basically it’s the Argentina full side against Brasil’s Olympic “hopefuls” side.

     

     

    Despite their recent 4-1 tobering of the USA, this is not (and has not been for sometime) a great Brasil team, which was shown by their 2-0 crash to Mexico in Dallas last week.

     

     

    Argentina fresh from a 4-0 win against Ecuador last Saturday are still trying to find the right player to fill the Xavi role to supplement Messi. Looks like it’s Mascherano’s turn today.

     

     

    Brasil have an interesting frontline with Neymar, Leandro Damiao and Porto’s Hulk (who, for me, sums up what’s not quite right about this squad) but are unsettled at the back. Danilo was shaky the last match at LB and Spur’s Bruno may come in at CB.

     

     

    Brasil manager, Mano Menezes’s (who’s known to be a dressing room “motivator”) jaikit is on a very shaky peg already so another Brasil defeat today could be the final nail for him.

     

     

    So, all in all an interesting match up, but I’ll take Argentina to shade it.
