SFA unsure of own rules

Celtic Quick News readers have assumed SFA rules apply to all clubs, including Rangers.  It is therefore, a surprise to read the BBC report today that the associations lawyers are “unsure” if Articles of Association rule 10.2, which prohibits someone (in this case, Paul Murray) becoming a director of a club if they have previously been a club director “within the five-year period preceding such club having undergone an insolvency event”, which includes administration and liquidation, should it arise.

The SFA are “unsure”.  Heaven help us.

The rules are clear, those who have been directors of Rangers during the past five years are not eligible to be a director of a Scottish club without appeal to the SFA board for discretionary dispensation.  It is preposterous for the association to be unsure on this matter.

If they are asked to consider Paul Murray as a Fit and Proper person, his record as director of Rangers should be examined.  As we explained on Saturday, Murray was director in the spring of 2010 when Rangers were issued with a £24m tax demand plus £12m interest.

Instead of curtailing budget the following season by selling players to mitigate the threat to the club’s survival, the board Murray served on authorised a £4m spend on Nikica Jelavic in August 2010.  If they had taken the responsible long-term view, they could have cut budget, realised significant levels of cash, prepared for the outcome of the tax tribunal and seen off any asset-stripping takeover.

The SFA really need to get a grip of their own rules. They appear intent on pretending Scottish football is not in crisis.

    Well for me the bet of the day is a shrt priced double on Hurricane Fly and Quevega.both should win

     

    First race I was told Steps to Freedom impressed connections with a nice piece of work on the Curragh gallops recently and there is confidence behind its chances.I was also told a few weeks ago that Dermot Welds horse Gallileos Choice was the one to be on in this race.Its a tough race and Walsh and Nichols horse Prospect Wells is a decent price (16/1) and I would give it a chance.

     

    I was told the Pipe stable have “The Package” ready to roll in the third race and they reckon it has a “good chance” (6/1)

     

    But Cheltenham can be tough,everyone trying,some horses aimed at this all year

     

    I have a big double on Hurricane and Quevega and will have a bet on the Package also

  9. I heard Hugh Keevins use the word ‘investigative’ regarding his colleagues in the press last night. We have seen today the results of one guy actually putting that into practice. If Hugh and his cronies even attempted to do their job properly then we would be much further down the line with what really goes on in our football hierarchy and towards putting things right. Mind you, by doing nothing they probably feel that they are doing their job and keeping everything in Scottish football just the way it should be.

    It does not matter if Campbell Ogilvie, John Mc Lelland, Dave King, Paul Murray et all … never knew or never noticed or never seen anything to do with two contracts.

     

     

    It was their job to know. By stating that they never knew THEY ARE ADMITTING GUILT. THEY ARE ADMITTING CULPABILITY BY NOT KNOWING.WHETHER THEY DID ACTUALLY KNOW OR NOT.

     

     

    This is why we have not heard from said Gentlemen and why no journalist dare ask them.

     

     

    I read Jörg Albertz going on about his Scottish bank account last week and how he still has it and if anyone wants a look etc ?

     

     

    What would be far more interesting to see would be his German bank account. As he never lived in Germany at the time he could reroute all offshore payments to his German bank account and pay no German tax.

    The South African tax authority is probing Rangers director Dave King over his involvement in a takeover bid for the crisis-hit club.

     

     

    Johannesburg-based businessman Mr King is being pursued by the South African Revenue Service (Sars) for 2.7bn rand (around £227m) dating back to 1991.

     

     

    Last week, the director who joined Rangers in 2000, claimed he was planning to sue former owner Sir David Murray for the £20m he invested in the club over allegedly not revealing the “true financial position” at Ibrox.

     

     

    Mr King, who is the subject of a court-granted “restraint order” over dealing with property in Scotland as a result of the tax case, stated last Wednesday he intends to reinvest all money he may receive from any action against Sir David into the club.

     

     

    He also stated that he is backing the Blue Knights consortium for a Rangers takeover and had approached the Scottish FA over possibly taking an “increased role” in the club.

     

     

    Sars confirmed it is continuing to pursue the Rangers director for the outstanding tax.

     

     

    A spokesman for the service said: “Sars will continue with its attempts to recover outstanding tax debts and Sars will continue to follow due legal process for this purpose. At this stage and in view of the fact that same aspects of litigation may be considered to be sub judice, Sars will elect not to make further public statements at this time.

     

     

    “Sars has noted the public statement issued by the taxpayer in his individual capacity and the attention of Sars and its counsel has been drawn to various media articles regarding the taxpayer and his interest in the soccer club, Glasgow Rangers. Sars will again elect not to make further public statement on the matter at this time.”

     

     

    Wine estate

     

     

    Last year the revenue service obtained a High Court order in South Africa to seize Mr King’s £10m Quoin Rock wine estate near Stellenbosch in the Western Cape province. This was sold at auction in November for around £5m.

     

     

    Sars confirmed “other processes of litigation” in relation to Mr King are “currently before different courts of law and are at this stage not reportable”.

     

     

    Mr King has not yet served any notice of action on Sir David, who noted the statement from the Glasgow-born businessman with “much incredulity”.

     

     

    The tax authorities in South Africa are focused on Mr King’s Ben Nevis company, as well as other businesses he was involved in. He is currently chairman of Micromega Holdings in Johannesburg, which has interests or owns several companies, including stock brokers and a risk assessment firm.

     

     

    Sars says Mr King faces 322 “criminal charges, has acted fraudulently, evaded tax and lied about his income and profits generated since 1990.”

     

     

    The tax authority believes Mr King declared average annual income of around £6700 when he made more than £84m from 1990 to 2001. He claimed “even his wrist watch and golf clubs” belonged to the Ben Nevis company, according to Sars.

     

     

    In his statement last week, Mr King said he believed the liquidation of Rangers was “inevitable” and said he had approached the SFA regarding its fit and proper persons criteria “in advance of considering an increased role in the club going forward”.

     

     

    A spokesman for the Crown Office confirmed its position in relation to the director of the Ibrox club. He said: “We can confirm that David Cunningham King is the subject of a restraint order. It would not be appropriate to comment further on an ongoing restraint case.”
