Souness: loan was for work, makes interesting dates claim

Graeme Souness today told a Daily Record reporter that he received his EBT LOAN from Rangers because:

“I was doing work for Rangers.

“I was in between jobs. I was going to scout for Glasgow Rangers at that time”.

Payment in return for “doing work” is what this whole business is all about. Payment for “doing work” is taxable. It cannot be remunerated via a non-repayable loan.

Mr Souness was manager of Blackburn Rovers from 14 March 2000 until 6 September 2004.

As Blackburn manager, he signed Tugay from Rangers on 17 May 2001. He requested £30,000 from the Rangers EBT scheme five weeks later.

“In between jobs” Really? These dates make that an interesting claim.

    Going back, it did used to be the case that the employee was het, but not for a long time. I think the Third Lanark players were het for the NI that the club failed to remit as it was going bust, and cases such as that caused a change in the law.

    Under the current proposals, the beneficiaries can only decide to pay up, or repay the loan and defer the tax until they dip the fund again. Doesn’t matter otherwise what they do with it or spend it on, if the loan remains outstanding, the Governements intention is to take their cut of it from 2019. We’ll see how that pays out.

    That said, I’ve no experience of the various schemes and scams that have been set up over the years. Sounds like your muckers were ‘self-employed’ though, hence a commercial approach to the transaction being taken by HMRC.

  10. Seem to recall him being used to front one of the groups that tried to buy the ole ramshackle stadium and the other assets of the club that he once played for before they were put into liquidation after getting their CVA rejected?

     

    Was just wondering if he was perhaps jockeying for position once more with some of the legal aspects of the successful acquisition getting straightened out and potentially…..its all going to be up for grabs again and theres maybe some pulling of the press strings goin on to actually raise things like that with him now after all this time.

     

    Any possibility there’s a bit of mud getting slung Souness’s way in an effort to discredit him early doors?

    Yep – been involved in IT in financial services for 30 years so I know all about it including IR35 etc.. These guys were all employees (not self-employed) who were paid partially by EBT – really not unusual. Just sent a message to a couple to find out latest. Both received APNs. once has agreed to pay £22k over 12 months. The other is unable to pay. HMRC advice to him was 1. Sell house/car/whatever 2. Take out loan 3. Ask family & friends 4. Max out credit cards. They want their money.

     

     

    BTW – not my “muckers” or “chums” – colleagues at best! :-)))

    Celtic along with other clubs with a representative in the SPL Board were provided with information that was not provided to SPL lawyers Harper MacLeod.

     

     

    Whilst it does make sense until we have a final ruling on the true nature of ebts all the parties mentioned know that irregular ebts were used from 1999 to 2002/03.

     

     

    This is a fact and the same evidence that was kept from the SPL in terms of the fraudulent nature of how RFC operated the DOS ebts was kept from the SFA in 2011 in the shape of the 20th May letter.

     

     

    When it comes to Res12 and LNS I’m yer granny and I know how to sook eggs.

     

     

    Res12 is existing priority because Celtic alone have a locus on getting answers.

     

     

    Get that process running and LNS is next regardless of COS decision although a ruling in favour of HMRC saves having to spell out the niceties of DOS ebts and BTC ebts.

  16. Just watched the ‘questioning’ of GS. Tell you what his acting has improved, albeit just a sliver, since his appearance on Boys From The Blackstuff. Whoever asked him the question was very nervous, but GS coaxed him along with gentle questions of his own.

     

     

    Evidently, something has changed behind the scenes. GS was oh so subtly pointing a finger, or threatening to.

  19. Could the Souness intervention not just be an act of retaliation? If Souness has been made aware that he will be personally liable for any sums due to HMRC for his Rangers EBT, even if the club claimed at the time that they’d pay it if HMRC found against them, then he doesn’t need to keep up the charade and can sully Murray’s reputation.

    That interview was stage managed and Souness’ “nothing to see here demeanour”, was well practised, But why?

     

     

    If we take it that it looks increasingly likely that the Supreme Court will uphold the CoS decision, then it is all over in that matter, bar the shouting and squealing.

     

     

    The EBT stuff has no practical or pressing influence on Sevco.

     

    The questions of titles can be dealt with at leisure, once culpability has been established.

     

    So, why throw it into the ring now.

     

     

    Perhaps it is because there is something of more significance to the Establishment than the felonious affairs of a dead club.

     

     

    Something like the incorrect retention of a UEFA licence, which is a major can of worms for the SFA at local level and UEFA at International level.

     

     

    As far as EBT’s are concerned, I believe that the authorities are quite happy to cut Oldco adrift.
