SPL propose rules for Newco FC

We told you back in October last year that Rangers were likely to be liquidated and a Newco FC would be formed, which the SPL would vote back into the league.  Today the SPL issued terms of how the deed will be done as they issued 8 resolutions to be voted on later this month.

The key resolution is 2A, which establishes a procedure to phoenix a Newco into the place of an ex-club.  Crucially, this resolution only requires the support of 8 SPL clubs, all 12 of whom will be eligible to vote at the meeting.  5 clubs would be needed to block this proposal and right now there is only one willing to do so.

Resolutions are as follows:

Resolution 1 proposes an increase in the sporting sanction (points deduction) on any Club which suffers or is subject to an Insolvency Event from 10 points to the greater of 15 points and 1/3 of the Club’s SPL points in the preceding season.

This resolution increases the penalties imposed following an insolvency event, it requires the support of 8 clubs to be carried and should be supported.

Resolution 2A proposes further sporting sanctions in the event that any Club undergoes an Insolvency Transfer Event (i.e. transfers its share in the SPL to a new company where this occurs because of the insolvency of the transferor) of 10 points in each of two consecutive seasons from the Insolvency Transfer Event.

This resolution provides for an ‘Insolvency Transfer Event’, defining what happens when a club ceases to exist and a Newco FC is formed.  No provisions currently exist for such a scenario and I see no reasons to introduce any.  The resolution requires the support of 8 clubs to be carried and must be opposed.

Resolution 2B proposes revisions to the fee payment arrangements i.e. SPL fees to any Club which has undergone an Insolvency Transfer Event will be reduced by 75% in each of three consecutive seasons from the Insolvency Transfer Event.

This resolution provides for a financial penalty in the event the Insolvency Transfer Event resolution is voted through and requires the support of 11 clubs.  This is an outrageous and arbitrary increase in support required to impose financial sanctions.  All an Insolvency Transfer club needs is the support of one other club to halt financial penalties.

If resolution 2A is passed, resolution 2B should be subject to the same voting criteria and must be supported.  The SPL must ensure a financial penalty is imposed for financial misdeeds.

Resolution 3 proposes extending sporting sanctions where an Insolvency Event is suffered by a Group Undertaking of a Member Club of the SPL (Group Undertaking is defined in Section 1161(5) of the Companies Act 2006).

This resolution confirms insolvency events at group owner level are applicable to the club, requires the support of 8 clubs and should be supported.

Resolution 4 proposes updates and extensions to the definition of Insolvency Event in the SPL Rules.

I assume this is an administrative requirement and needs the support of 8 clubs.

Resolution 5 proposes updates and extensions to the definition of Insolvency Event in the SPL Articles and clarifies the process in the event that a Member which is the subject of an Insolvency Event is required to transfer its share in the Company.

This is a technical resolution defining how clubs lose or transfer their share in the League.  It requires the support of 11 clubs but it is not clear if has any consequence, more than clarifying administrative procedures.

Resolution 6 proposes a specific requirement in the SPL Rules that Clubs must pay their Players in terms of their Contracts of Service on due dates and places a duty on any Club to report any failure to pay its Players in a timely manner to the SPL.  Failure to pay Players and / or to notify such failure to the SPL would be a breach of SPL Rules.

This resolution should enhance fair play, requires the support of 8 clubs and should be supported.

Resolution 7 proposes a requirement in the SPL Rules that Clubs report to the SPL any failure to make payments to HMRC in respect of PAYE and NIC (a Default Event).  Any Club suffering such a Default Event will be subject to a Player Registration Embargo.  Any failure to report a Default Event shall be a breach of the SPL Rules.

This resolution prohibits clubs in tax arrears from signing players, requires the support of 8 clubs and should be supported.

If only they would pay their taxes we would not need to bother with any of this.

    IF we make the scottish cup final we must not go. Statements are only worth it if they are spectacular.

     

    I would also contribute to a huge projected message on the walls of Ibrox that stated something like no more cheating.

     

     

    Tiny Tim, I believe that the death of Rangers would be a gift to Celtic and Scottish football. Just think what we could do without being handcuffed to them. There would be no more media driven conspiracy against us. Teams may also see fit to play football rather than copy the Rangers model.

     

     

    On separate note I imagine Celtic have the business case for an SPL without Rangers and know what format could support it and would not blindly state that life cannot go on without toxic legacy.

  2. We need to establish exactly who thought up these proposed new regulations , on who’s behalf they have been presented and when they were agreed.

     

    I stopped going to away games several years ago and stopped going to iPox in particular long before that , so I’m not going to preach to our magnificent away support what to do . I believe they will do the best thing for Celtic when needed , just like the rest of us who love our great club.

     

    I will still contribute my season ticket money to the club and more if I can afford it , even if we are not playing in this corrupt league. I would rather watch Celtic play kick abouts on Glasgow Green than be a part of a rigged system.

     

    This must be our line in the sand , we need to establish our best course of action and tell people this is what we will do , if these proposals are implemented.

     

    If it means all shareholders of Celtic threatening to take court action to prevent , what amounts to a pardon for the guilty and life sentence to innocent , then that is what we should do .

     

    The support need guidance on this from the Club and others , whether in public or behind the scenes . I for one don’t want to look back in years to come and when asked what I did to defend our club in its hour of need , have to say I did nothing.

    The time has come for the worldwide Celtic Family to stand up and be counted.

    I disagree with your statement that moving to another league outside Scotland is fantasy.

     

    It would be very hard, it needs to be well planned, and it needs to be in stages….maybe I am a fantasist for thinking the Celtic board could deliver that.

    Over the last 2 years we have frozen on the day , on at least 3 occasions at Hampden .

     

    If we play as we did against Killie on Saturday, we will be visiting Hampden again this season. If we play as we did in the League Cup Final , we won’t.

    IMHO if Celtic play a newco ragners in the SPL next

     

    season then they legitimize them and undo at a stroke

     

    all the sacrifices made since MON left.

     

    Getting a newco back int the SPL is a monetary thing

     

    for the other clubs

     

    However this only works on the presumption that Celtic

     

    will acquiesce and return to the way its always been

     

    If we play hardball they’ll need another plan.

    You know the SFA could kill the prospect of a new football company, ANY company, from riding roughshod with an army of dimwits, all over sporting integrity in Scotland. After all, sporting integrity is the core value of the sporting arena. It’s the basis that all rules and regulations are written. The Scottish FA exists to promote, foster and develop the game at all levels in this country, not just those in the top flight. Entry of a new company at any

     

    Level other than the very bottom, is wrong in every sense.

     

     

    A simple statement stating: any new company applying for a football licence to play in Scotland, can only be granted one to start at the bottom of the professional game. ie devision 3

     

     

    Or words to that effect

     

     

    To be permitted into a league any higher than the 3rd does not fit in any way shape or form, the ethos of sporting integrity.

     

     

    What if Donald trump decides the wind farms are to much for him and decides a soccer ball team is now for him.

     

     

    He could lobby the SPL clubs, to grant his soccer team a place at the top table. After all, he will invest heavily in his team. Bring jobs building a stadium yada yada yada. Would taking a current spl clubs licence be be any different from what is being hatched for the facecombers? Money obviously talks. Would hacks the length and breadth of the country stand for that? Would the SFA ?

     

     

    The answer would be a resounding no.

    I feel absolutely sickened,its nauseating.

     

     

    My only suggestion is for Celtic to apply to the Irish league set up and see what kind of tv deal we could achieve,help build a stronger infrastucture and invite clubs from elsewhere,I just cannot see how Celtic can remain a part of Scottish football after this and were sick of being told were not welcome elsewhere,well,let’s go somewhere we are welcome,help build something with true integrity.

Celtic were very slow in acting when the ten called a meeting without us being invited.When the meeting was called Celtic must have known that they were alone in this League.There will be no Aberdeen siding with us,nor Hibernian,Nor Dundee Utd.These would be the three that may have said no to this meeting,but They went and cast their vote along with the other seven, so we are on our lonesome.

     

     

    As I said Celtic are on their own,We, the supporters are the only people that can help in this battle of wills,40-50 years ago there would have been mass rallys,where ideas would be thrown back and forth,now there are no meeting places,just forums where there is a lot of inane chat,suggestions that are thrown back and forth,but no action,plenty of suggestions but no action.

     

     

    I may be the wrong person to suggest there has been an Idea thrown in the mix tonight that would certainly get the wrongdoings that are happening in Scottish Football to a world stage, but it would be a big ask from our Supporters,That is if we are lucky enough to get into the final,is to withdraw our support,refuse to attend that game.The World of football supporters would certainly be asking why.

     

    It’s a big ask,but I think it would certainly bring attention to our plight here in Scotland.

  11. I am actually quite calm about all this S.H.I.T.E. (Scottish Huns Insolvency Transfer Event). I had already decided ages ago that if the Huns were let off with minimal punishment for a massive crime, I would have no interest in Scottish Football. What Celtic FC does or doesn`t do might affect my feeling for the Club but it would not affect my decision to be finished with Scottish Football.

     

    In short, I would rather Celti FC ceased to exist than to be complicit in the continuation of Rangers.

     

    Hopefully, however, we are all reacting a bit prematurely but I have no confidence in the Scottish Establishment.

    A week or so ago one of the wise contributors on here advised us not to rush to judgement but to take 24 hours before coming to conclusion on complex issues such as we have before us to-day. So I suggest we follow his advice and ,’keep the heid’ before making up our minds on these matters. We certainly should not be lambasting our Board before they have opened their mouths and neither should we ,who have done no wrong, be punishing ourselves.

  13. I haven’t been able to keep up with the volume of posts tonight, however the comment made by NeilR around 17.53 is very close to my thinking.

     

     

    We have to find out what is the thinking of other clubs’ supporters.

     

     

    During the Dougie Dougie time and the Honest Mistakes era,I mentioned the silence from the other SPL clubs. Clubs who were being cheated of points and cash by Honest Mistakes.

     

     

    I advocated that the CSA canvas other supports groups as to their thoughts.

     

     

    Now, more than ever, these fellow Associations have to be brought into the equation and their views made public.

     

     

    It would serve the Bantering Buffoon at the CSA better to channel his energies to this cause, if he has the ability to so do, or else, step aside for someone who would have some credibility.

     

     

    For the moment, wait and see what Celtic are going to do,which I have said from the beginning, will be the decisive play in this charade.

  14. Some interesting uotes this morning from Billy Ng in the Times when he says “Apart from what was already known. other creditors have emerged in the days following our bid submission”. “It has put a new dimension to what is needed to keep the club afloat…”

     

     

    Interesting who are they, and how much are they owed? But his just sounds to me like laying the ground work for liquidation should he take over.
