SPL propose rules for Newco FC

We told you back in October last year that Rangers were likely to be liquidated and a Newco FC would be formed, which the SPL would vote back into the league.  Today the SPL issued terms of how the deed will be done as they issued 8 resolutions to be voted on later this month.

The key resolution is 2A, which establishes a procedure to phoenix a Newco into the place of an ex-club.  Crucially, this resolution only requires the support of 8 SPL clubs, all 12 of whom will be eligible to vote at the meeting.  5 clubs would be needed to block this proposal and right now there is only one willing to do so.

Resolutions are as follows:

Resolution 1 proposes an increase in the sporting sanction (points deduction) on any Club which suffers or is subject to an Insolvency Event from 10 points to the greater of 15 points and 1/3 of the Club’s SPL points in the preceding season.

This resolution increases the penalties imposed following an insolvency event, it requires the support of 8 clubs to be carried and should be supported.

Resolution 2A proposes further sporting sanctions in the event that any Club undergoes an Insolvency Transfer Event (i.e. transfers its share in the SPL to a new company where this occurs because of the insolvency of the transferor) of 10 points in each of two consecutive seasons from the Insolvency Transfer Event.

This resolution provides for an ‘Insolvency Transfer Event’, defining what happens when a club ceases to exist and a Newco FC is formed.  No provisions currently exist for such a scenario and I see no reasons to introduce any.  The resolution requires the support of 8 clubs to be carried and must be opposed.

Resolution 2B proposes revisions to the fee payment arrangements i.e. SPL fees to any Club which has undergone an Insolvency Transfer Event will be reduced by 75% in each of three consecutive seasons from the Insolvency Transfer Event.

This resolution provides for a financial penalty in the event the Insolvency Transfer Event resolution is voted through and requires the support of 11 clubs.  This is an outrageous and arbitrary increase in support required to impose financial sanctions.  All an Insolvency Transfer club needs is the support of one other club to halt financial penalties.

If resolution 2A is passed, resolution 2B should be subject to the same voting criteria and must be supported.  The SPL must ensure a financial penalty is imposed for financial misdeeds.

Resolution 3 proposes extending sporting sanctions where an Insolvency Event is suffered by a Group Undertaking of a Member Club of the SPL (Group Undertaking is defined in Section 1161(5) of the Companies Act 2006).

This resolution confirms insolvency events at group owner level are applicable to the club, requires the support of 8 clubs and should be supported.

Resolution 4 proposes updates and extensions to the definition of Insolvency Event in the SPL Rules.

I assume this is an administrative requirement and needs the support of 8 clubs.

Resolution 5 proposes updates and extensions to the definition of Insolvency Event in the SPL Articles and clarifies the process in the event that a Member which is the subject of an Insolvency Event is required to transfer its share in the Company.

This is a technical resolution defining how clubs lose or transfer their share in the League.  It requires the support of 11 clubs but it is not clear if has any consequence, more than clarifying administrative procedures.

Resolution 6 proposes a specific requirement in the SPL Rules that Clubs must pay their Players in terms of their Contracts of Service on due dates and places a duty on any Club to report any failure to pay its Players in a timely manner to the SPL.  Failure to pay Players and / or to notify such failure to the SPL would be a breach of SPL Rules.

This resolution should enhance fair play, requires the support of 8 clubs and should be supported.

Resolution 7 proposes a requirement in the SPL Rules that Clubs report to the SPL any failure to make payments to HMRC in respect of PAYE and NIC (a Default Event).  Any Club suffering such a Default Event will be subject to a Player Registration Embargo.  Any failure to report a Default Event shall be a breach of the SPL Rules.

This resolution prohibits clubs in tax arrears from signing players, requires the support of 8 clubs and should be supported.

If only they would pay their taxes we would not need to bother with any of this.

    i personally think its time for a bhoycott of away games

     

     

    if the other ten clubs are so desperate for the hun pound, that they would sacrifice any sporting integrity in favour of the huns pound, then they should be forced to do with the tim pound instead

     

     

    If they want to make it easier for the bankrupt clubs to carry on , then they might as well all personally feel the pain of bankruptcy themselves

     

     

    is the gang of ten, really only ten, or is the huns pleading for a way back and offering jam tomorrow

  4. I’m confused with who owns the share in the SPL. Seems to me that each club in the SPL has a share. And when a team is relegated they are forced to hand over that share to the team being promoted.

     

     

    Now, if a club with a share in the SPL goes bust, does that share not revert back to the SPL who then determine who it should be assigned to?

     

     

    And if so, what criteria is used? Should it not go to the team who finished 2nd in the SFL Div 1?

     

     

    And along the same lines, do the registrations of all the players not revert to the SFA? So the NewCo would have no players to start with and would be bidding against existing clubs for those players?

     

     

    p.s. I’ve said often on here. If NewCo gets in to the SPL, Celtic should get out. 3rd div of the SFL would be fine for me. Playing in the same league as NewCo would not be.

  5. The away fans could ensure that there are several ‘newcos’ wanting to phoenix into the following season’s SPL.

     

     

    The banks will not be happy with these proposals and they should bring pressure to bear.

     

     

    As a last resort, Celtic should refuse to recognise or play Newco Rangers. That will screw the TV deal for starters.

    Stinks. Celtic’s next move here is vital and needs to happen before the renewals go out or in my case it will be, “Season ticket up for grabs in section 103”, cos I’ve got a golf handicap to work on.

    We have a club who have jeopardised the solvency of several other members by their selfish actions

     

     

    We have a club who have jeopardised the signing of a TV deal, a crucial piece of income and marketing exposure

     

     

    We have a club with a current owner sticking 2 fingers up to the processes of the governing body.

    Yet we have the league bending over backwards to keep said club under their wing.

    Whats now to stop every club with significant debt in comparison to their income getting together to do a ‘Rangers’ at the same time and the majority of the league starting on -10 points, therefore negating the effects of any points loss, allowing them to budget for the reduced TV money for a couple of years and build themselves up quickly again after 3 seasons when the full TV money kicks in again with no debt burden?

     

     

    Celtic are in a difficult position now but I will not be deserting the club- the support have to come together now as we did in 1994 to decide on our response to this and action to be taken without hurting the club we love.

    Leeds is the precedent for that. IN the SFA and SPL’s eyes they are the same club as Rangers 1872

    Re Newcastle riots. Rather frustratingly I wrote a long piece around lunchtime about much earlier trouble but it got lost in the ether. I think the blog went down for a few minutes.

     

    Anyway they caused a lot of bother in Wolverhampton in the late 50s when they played Wolves in the European Cup.

     

    I wrote at some length about attending the Ibrox leg as a wee boy. I lived in the Gorbals and occasionally went to Ibrox to experience big European nights ( I attended the semi final with Eintracht Frankfurt who went on to lose to Real Madrid 7-3 at Hampden ).It drove home to me that me and my type were distinctly unwelcome ( both at Ibrox and in Scotland ). This supremacy also extended to supporting Scotland. I attended many games were Celtic players were roundly booed….. Wee Jimmy, Jim Craig, Davie Hay etc all got the treatment. In my generation many if not most Celtic supporters had no time for Scotland largely through their direct experiences of going to the games and in the workplace.

     

    At the dark heart of Rangers FC is a superiority which has bred bully boy tactics down through the years and I see no sign of any change.

     

    They have rioted everywhere. They will liquidate but they will be back just as the news this afternoon demonstrates. They have friends in the right places. Be prepared for the next spell of trouble when they discover that they will not be quite as strong as they have become used to.

     

    Time for HMRC and Celtic FC to step forward.

I think that will do me attending matches too , Followed the hoops nearly all my life ,seen some unbelievable things visited on us in that time , cant say i didnt see this coming though ,they had to be saved at all cost , that cost was the honesty and integrity of scottish football .     I have sent an e-mail below to Neil Doncaster. It is the only steps I can take to protest but it does raise the point that if the TV deal is as important as they say to the SPL then that is a prime ground to fight upon.

    Your announcement of plans to gerrymander a solution for the imminent demise of Rangers via item 2a of your Financial Fair Play proposals stand out clearly for what this is – a Cheat’s Charter and one to which I will not subscribe.

     

     

    I will not subscribe to any attempts to minimise any further fair competition in Scottish Football and will if these proposals are sanctioned take the only steps open to me to disassociate myself from a “rigged deck “ competition viz. I will cancel the subscriptions that I hold with Sky and ESPN for the product and will not re-subscribe until such time as those associated with this shameful exercise remove themselves or are removed from office.

     

     

    I will be writing to the relevant people at both bodies to ensure that they are aware of the strength of feeling on this issue and will endeavour to garner support via New Media outlets to ensure that acceptance of these proposals will have financial implications for all who support such an appalling proposal and its design to ride roughshod over the dictates of sporting integrity for financial gain, exactly those motivations which led to the demise of the Rangers Football Club.
