Strict liability: if football fans misbehave in a stadium, their club is held liable.

This is the Uefa way and is how most European national associations conduct their business.  Not in Scotland.  In Scotland there is a belief that some problems are so entrenched, it would be unfair to penalise clubs, who do whatever they can to discourage fans from, for example, setting off flares.  Here, a club which does everything it can to stop an errant act is not held liable.

It wouldn’t be an exaggeration to say some clubs fear strict liability.  Celtic cannot stop people setting off flares, they take steps to discourage it, so, the argument goes, why fine or otherwise punish Celtic?

It’s a cop out.  I’d hate to see points deducted, leagues decided, because a club was proxy for a strict liability offender, but everything else is on the table.  Clubs are poor at policing their own, there are in-built inhibitors which make doing so difficult.  Strict liability takes the issue out of their hands.  Stands will be shut, ticket allocations withdrawn, but almost certainly only once.

Flare carriers are the most difficult to police as they are the act of a small number of individuals, who are able to protect themselves [although not their club]by hiding in a crowd, but strict liability would end offensive chanting by thousands overnight.

For that, it’s worth it.

Only caught last night’s Motherwell game in highlights.  Newco looked like the Rangers I remember from the early 80s.  Despite being a mid-table mediocre outfit, Rangers were, and played like, a big team back then.  They attacked with all they had, but John Greig was often out-thought by the manager of a small club, who could organise a defence and break with purpose.

Football tactic students will be captivated by the second leg.  Do Newco go on the attack, and risk the same outcome, or do they learn to live within their limitations, hoping to tempt Motherwell beyond theirs?  The team which gets it wrong could lose by three goals.  It’s a good job Newco didn’t screw around with the ticket allocation, they’ll need that away end packed and energetic.

    being an Inverness lhad born and bred and spending my early childhood in the Howden End watching Inverness Caley in the Highland League (untill my Da started taking me to Paradise) I have often had a fondness for ICT and always want them to do well.

     

     

    It was with mixed emotions i watched the game yesterday with my son (also born in Ness but a Paradise ST holder like myself). At the final whistle we switched off, couldn’t watch them celebrate knowing we were cheated out of a treble, In different circumstances we may had gone to the game with old friends but could not face it.

     

     

    Any thoughts of being happy for them evaporated after their tweet ‘thats how to win with 10 men’………..no longer will we ever look for their score and hope they do well

     

     

    anyways……….onto today, i pray Murderwell do the biz BUT there will be dark forces at work this afternoon, non-existant free kicks will be awarded where ever possible, yellow cards issued early doors, everything possible will be done for the 3 year old team to ensure they complete the journey. I fully expect a catalogue of honest mistakes this afternoon, can Well come out on top.?

    If Clubs in Scotland were held liable for their fans’ behaviour, oldco would have been liquidated decades ago ….that’s the only reason Clubs are not held liable in Scotland….no doubt about it …..

  15. Having been in Lourdes all week and just returning last night, I have had a lot of catching up to do. I prayed at the Grotto for all CQNers, believers or non-believers. I remembered Sean in a special way last weekend. So MT, I am delighted to hear the result of Sean’s court case and of his exam results. You have all been through much, but I am sure you are stronger for it. You are aware more than ever of the strength of the CQN Family around you also.

    Ststivs, cannot remember if it was a good day on that morning in 1973 in Holy Family, PG, but I do know that if you contact Cursillo you will be amazed at what such a group can achieve. I did a Cursillo weekend in Derry many years ago and participated in two others later on. It is a truly great experience which you might benefit from.

    TET (I think) often observes, how good Thomson is at changing a match subtly, almost unnoticed.

     

     

    Motherwell must play the game as high up as they can. The new club are statuesque in their defending when opponents pass and move.

     

     

    Allowing them possession in Well’s half, will just invite high balls on top of heir keeper.

  27. I just can’t see sevco losing today. It just depends on how many they score. An early ‘well red card or penalty would certainly help save Scottish football, over to you Craig Thomson.
