The premier business paper where Uefa is headquartered in Nyon, Tribune de Geneve, today ran an advert, paid for by public subscription, questioning the governance of Scottish football.

The advert asked readers to reference The Offshore Game report: Doing SFA for Fair Play and explained some of the issues governance, accountability and oversight in Scottish football.  It reads:

“A report by The Offshore Game (TOG), an arm of The Tax Justice Network (TJN), has highlighted examples of poor SFA governance in respect of:

• A Commission established in 2012 by the Scottish Premier League to investigate the use of employee benefit trusts to reduce the tax paid to HMRC by an SFA member club where the SFA provided key testimony which is now being questioned.

• The processing of a UEFA Licence in 2011 by The SFA when Court Officers called to collect overdue tax from a member club between Champions League and Europa League qualifying games. Proving there were no overdue and unpaid taxes was a condition of granting then retaining a licence to compete in both UEFA competitions. The tax concerned was never paid!

• The SFA have neither commented on the TJN report nor attempted to address the issues it raises. The TJN has called for an independent review of the SFA to make it more accountable.

• A group of shareholders of Celtic PLC acting in terms of Resolution 12 of the Celtic PLC AGM of 2013, have been pressing the SFA for over two years for a satisfactory explanation of their administration of the UEFA licensing process in 2011. In the absence of any meaningful reply they have now taken up the case with the UEFA Club Financial Control Body.

The TOG report highlights the financial cost over a decade to the British Taxpayer in Millions of pounds. The cost to Scottish football in terms of the loss of trust placed in the SFA to govern the Scottish game with integrity is incalculable.

Football fans everywhere are invited to read this important report into the game in Scotland.”

Our game suffers from a perceived lack of oversight, accountability and governance; fundamental requirements in modern sport which have been painfully lacking across world football for decades.  Uefa now have an opportunity to measure where Scottish football, and their own processes, are on these metrics.

    Great post. Not sure if it was a re-post, but a fantastic summary nonetheless.

     

     

    I have always personally felt that the whole “membership” issue was key to dispelling the survival myth. The Rangers (IL) membership was not transferred. Sevco applied and was granted an Associate Membership (from memory), to allow them to play Brechin City (which was a farce in itself, and why other clubs like Spartans etc have not taken legal advice on this I don’t know – fear factor/intimidation again?).

     

     

    Now I couldn’t give a rats ar5e whether it was the holding company or the club that hold the membership (I assume it’s the club), but that is irrelevant when it was not transferred anyway. a NEW membership was granted to a NEW club.

     

     

    WE know this, THEY know this, the SMSM know this, the SFA know this, the SPFL know this, yet still the lies persist for fear of social unrest.

     

     

    Only in Scotland.

  4. Quite honestly I see no outcome to the Res12 saga, successful, or, otherwise, unless the SFA admits that it was wrong – it won’t do it.

    Tanks got their name, from the fact that the development project during WW1 was very hush hush and the project was codenamed “Water Carrier”. Workers on the project shortened this to “Tank” and the name stuck.

    UEFA have the power to investigate and audit, the SFA do not have the power to refuse any UEFA action.

     

     

    Life sometimes throws up nice little surprises too.

     

     

    I’m thinking that the social unrest threat was more to do with the SFA’s ticket onto the gravey train through IFAB. And how unhappy they’d be if that was compromised.

     

    Everyone at the SFA has a ticket including our own, that is a powerful motive when it comes down to brass tacs, integrity or gravey ?

    If you remember correctly when old Rangers were legally in administration on the 29th of July Charles Green applied for the name change 2 days after this game on the 31st.

     

     

    Another entity faced Brechin before Green changed the name.

     

     

    I also have a screenshot of the new Rangers website stating it’s Sevco Scotland trading as Rangers.

     

     

    A conditional membership was created so that game could go ahead.

     

     

    Why would the same club need to apply to gain entry to a league they were already a member of ?

     

     

    They all know it’s a new club but will never admit it but if a creditor starts making noises then just watch them change their tune.

     

     

    When a club incorporates it becomes one and the same i.e synonymous meaning & when that club ceases so does the company.

     

     

    Scots Law kills the company is separate BS.

    Isn’t that contrary to lots of posts on cqn telling us it was imminent etc?

     

     

    Now that season book renewal time is over have the Celtic cusp port been placed back in its box (at the back of the bus)?

     

     

    I was reading the cqn article on how well the season book sales had gone and the “massive” waiting list. Felt I was just reading the Celtic view.

    Firstly he refers to Rangers as a Company and a Club and a Team, obviously to muddy the waters and convince the hard of thinking.

     

     

    I could spend hours on this getting the Facts to blow this away… but I haven’t got hours and Wiser folk than I have already done it to detail and clarify things much better.

     

     

    Firstly the Company that owned Rangers FC.

     

     

    Well that was the major shareholder Rangers FC Group Limited. This was controlled by Craig Whyte and was not sold off.

     

     

    Secondly the Club, this was Rangers FC PLC, incorporated as SC003487. It was never sold while in administration. If one was to believe the nonsensical approach of the BBC Rangers Football Club would be allowed to have assets but not debts. The idea that you can buy a Football Club but ignore that Club’s debtors and creditors is a nonsense.

     

     

    Why wouldn’t every Football Club just sell itself at the end of every Season, sell the Club, dump the debts and creditors and carry on to the next Season regardless, absolutely ludacrious.

     

     

    Not to mention the fact that Rangers Newco Football Club were playing, when the original Rangers FC was still in the SPL and was a member of the SFA.

     

     

    Thirdly the Team.

     

     

    The team are the Footballers that represent the Club, right. So how come the Players could go and play for other Clubs and why would the players that represented Newco have to TUPE over from Rangers to the Newco.

     

     

    Very poor from the BBC.

    Firstly well done on Res 12 advert.

     

    Secondly, having followed this over the past while on CQN, I was of the opinion that the PLC would be making a statement almost simultaneously. Have they backtracked on this or have I been fooled again.

     

    The tweet from Only an Excuse shows the ignorance on Res 12 where they think it all about the Huns, when in fact it’s about the SFA and governance, or to be more accurate lack of it.

    I am not versed in legal matters, however having read CQN I am aware of the hurdles and obstacles in placing a ” simple” statement in a Scottish newspaper.

     

    It seems to be a legal minefield.

     

     

    I would imagine that Celtic PLC will follow advice from their legal team. Hypothetically, how many of us disregard any legal advice we are given ?

     

     

    This is not condoning the PLC’ s actions or lack of action , however it is probably the reality. Imo any meaningful actions will subsequently be down to shareholders and supporters who are prepared to put their heads above the parapet.

     

    They deserve our thanks and continued support.

    The Scottish FA has appointed Sheriff Principal Edward F Bowen CBE QC to chair the independent commission into the events after the William Hill Scottish Cup final.

     

     

    The announcement was made to the members of the Scottish FA at its Annual General Meeting this morning. The Sheriff Principal will establish the commission immediately with the remit to provide a report into the security and risk management procedures deployed in regard to the pitch incursions at full-time.

     

     

    Resolution 6 obliges members to declare to the Scottish FA the identity of the club’s ultimate beneficial owner and to permit the governing body to publish the details disclosed under an amendment to Article 11.1.

     

     

    This was a response to work with Scottish Government, the SPFL and Supporters Direct Scotland on the Working Group on Supporter Involvement in Football and the resolution provides enhanced transparency around the ultimate beneficial owners of clubs.

    Taking legal advice is always down to how predisposed you are to agree with that advice and if it suits your agenda, there have been quite a few legal opinions offered on this and the Plc’s chosen position is only one of those, it suits their agenda and is the least onerous on them, when legal opinion tells you to do nothing. You either want that or you don’t, if you don’t you ask around.

     

    In their case it’s not about being right or wrong it’s about responsibility and how to shirk it.

     

    Remember, shareholders have been cheated here and the Plc will do nothing about it because they chose a legal opinion that advocates doing nothing.

    There were meny breaches of the rules and security procedures from before the game even kicked off yet you are interested in investigating only one of the breaches.

    There was a delay in getting the finalised submission to CFC as it was posted by solicitors and not emailed at the end of last week.

     

     

    Monday was a Bank Holiday and therefore no post.

     

     

    The submission arrived yesterday not Friday as anticipated. Thus the delay.
