The evidence is in, you have been cheated

There is so much material to wade through as a result of the excellent BBC documentary, Rangers – The men who sold the jerseys.  Much of it is of only passing interest to us, although we will examine it in more detail in the days to come, one part, however, concerns Celtic and Celtic fans more any anyone else in Scotland.

BBC have evidence that the following players had side letters contracting payment to Employee Benefit Trusts:

Alex Rae, Arthur Numan, Barry Ferguson, Carlos Cuellar, Christian Nerlinger, Craig More, Dado Prso, Dan Eggen, Egil Ostenstad, Fernando Ricksen, Gavin Rae, Gregory Vignal, Jean-Alain Boumsong, Jerome Bonnissel, Julien Rodriguez, Kris Boyd, Lorenzo Amoruso, Kevin Muscat, Libor Sionko, Marvin Andrews, Michael Ball, Mikel Arteta, Michael Mols, Nacho Novo, Paolo Vanoli, Pedro Mendes, Neil McCann, Olivier Bernard, Peter Lovenkrands, Ronald De Boer, Sasa Papac, Ronald Waterreus, Sotirios Kyrgiakos, Stefan Klos, Steven Davis, Steven Thompson, Thomas Buffel and Zurab Khizanishvilli

The BBC list a large number of other Rangers players and non-playing staff who benefited from EBTs but they have no documentary evidence of side letters.

Scottish FA registration procedures are clear:

Rule 2.2.1

Unless lodged in accordance with Procedures Rule 2.13 a Non-Recreational [professional]Contract Player Registration Form will not be valid unless it is accompanied by the contract entered into between the club concerned and the player stating all the terms and conditions in conformity with the Procedures Rule 4.

“Will not be valid” being the key point.

The SFA’s Articles of Association also say:

Furthermore, all payments, whether made by the club or otherwise, which are to be made to a player solely relating to his playing activities must be fully recorded within the relevant written agreement with the player prior to submission to this Association and/or the recognised football body of which his club is in membership.

Article 98 states:

A club making payment of any kind to a player, either amateur or professional, must obtain from the player a written receipt for the same showing details of the payment, and any club under the jurisdiction of the Association must produce such receipts to the Association when called upon to do so. For a player registered by means of a Full Professional Form, a club must produce on request receipts for the wages paid to him in terms of his agreement lodged with the Association.

Documentary evidence exists that Rangers played 38 players with invalid registrations between 2000 and 2010 (the last year financial information is available for Rangers) .  Results from all games involving these players, which is all games Rangers have played since 2000, are void.

I am sure the BBC will forward all evidence to the SFA and SPL for investigation.

You were cheated out of five league championships.  Fortunately, evidence exists and the history books will be rewritten.

The SFA and SPL must immediately take action.  A statement must be made this morning reflecting the gravity of the situation and reassuring fans that our game’s administrators are able to deal with this matter.

12-in-a-row!  Who would have thought it!

Just a quick comment on Juninho. Juninho had an EBT for a short period while he was at Celtic. He had no side letters or contracts from Celtic and tax was paid on money paid into the EBT. ‘Nothing to see here’.

My take on it? BBC only put in what they could absolutely prove in a court of law. There will have been reams of stuff left out.

So some people aren’t named as EBT recipients? Hmmmm…. look at the wider pattern of evidence and draw your own conclusions on that.

This is cheating on an industrial scale. British sport has never seen anything like it.

It’s gonna require a very skilled engraver to turn ‘Cheats 11’ in to Celtic FC but I think it can be done. I’d be happy with a big score through their name just by way of reminder.

Expulsion with immediate effect is what I want.

  12. Morning,

The SFA/SPL better not sit in silence this morning.

I wonder if Duff&Duffer will file it along with Craigy bhoys, we are still waiting on his.

    RANGERS administrators Duff & Phelps

last night threatened to sue the BBC

over claims a senior partner in the

firm was aware of Craig Whyte’s

scheme to buy Rangers using cash

    from the controversial Ticketus deal.

  13. Of the 63 Rangers employees that last

    night’s documentary claimed were

paid through EBTs, the tables stated

    that Barry Ferguson received £2.5m,

    former manager Alex McLeish £1.7m,

    with others in the seven-figure

    bracket including Christian Nerlinger,

on £1.8m, Michael Ball, on £1.4m,

Ronald de Boer on £1.2m and Nacho

Novo on £1.1m. Dozens of Scottish

    players also benefitted, including

pundits Billy Dodds and Neil McCann,

with the lowest sum recorded the

£7,500 paid into an EBT on behalf of

    Steven Smith.

    The most intriguing beneficiary is

    former Rangers manager Graeme

Souness. He was paid £30,000 in 2001,

ten years after he left the club, and

while he was manager of Blackburn

    Rovers. The programme alleged that

HMRC believed this was an illegal

    payment related to Rangers

    midfielder Tugay Kerimoglu’s move

    to Blackburn five weeks later.

Many of these players had side-letters

    detailing the appearance money and

bonuses that were paid using EBTs,

    the programme set out. Murray

    himself has previously admitted that

these payments were not disclosed to

    the football authorities because they

    were “discretionary”. However, both

the SFA and SPL rules state that all

    payments to players relating to

    football activities must be lodged.

If the BBC’s findings are correct, it

raises the possibility that all Rangers’

key players in the title successes of

    1999, 2000, 2003 and 2005, will have

    been improperly registered. With

Steven Davis, Kris Boyd and Novo

also on the BBC’s EBT list, the

legitimacy of the title successes in

    2009, 2010 and 2011 would also come

    into question.

    The programme will raise fresh

    questions over the SPL’s 11-week

    investigation into possible non-

    disclosure of payments by Rangers

between 1998 and 2010, conducted by

legal firm Harper Macleod. The SPL

issued a statement hours before the

    programme aired, which appeared to

    suggest that the assistance they

require from Rangers to conduct their

inquiry – which will lead to an

    independent commission determining

sanctions if it is determined the Ibrox

club has a case to answer – had not

    been forthcoming.

    “The investigation into the EBT

payments made by Rangers FC is

being actively pursued on behalf of

the SPL,” said the SPL statement. “All

    relevant documents, materials and

    information have been sought from

Rangers FC and we look forward to

    receiving full cooperation from the

    club and its administrators in

providing everything that it and they

have access to and which is required

for the investigation to be completed.”

    Among the wide-ranging group of

    Ibrox officials who last night’s

    programme claims received EBTs,

    current SFA president Campbell

    Ogilvie appears an incongruous

    figure. Company secretary when the

    scheme was first implemented, he

    issue a statement denying any

knowledge of it, beyond the £95,000

sum he received through a trust. “I

was not aware of which players

received EBTs,” Mr Ogilvie said. “And,

having been advised that the scheme

    was being operated in accordance

with the regulations, I therefore did

not raise any aspect of this with the

    Scottish FA.”

Seems the TBOS had a few bampots working for them dishing out carte blanche to Murray to achieve his impossible Euro dream. Maybe they had EBT’s as well!

  19. Morning All, great stuff last night. But I have a question. If D&P are removed now, who would take over administration – could HMRC step in (and hopefully close them down)?

  20. Amazing that some broadsheets think that the threatened legal action of the administrators against the BBC is the top story to come out of last night. The Scotsman take a bow.

    Hello Prince Albert here!

One thing I’m confused about is the wee tax case. Does this not cover a period back in 1999. Where these payments captured by the small tax case captured by the SFA?

ON Souness there are 2 possibilities.

    1. It was a bung

    2. It was a withdrawal as a result of an EBT when he was employed by Rangers in the late eighties/ early nineties. Where EBTs operated at this time? If so were they declared in player contracts?

I’m sure Mr Souness will be happy to answer these questions.

i have a feeling there is more to come out.

I watched the programme last night with a retired acquaintance. He had already informed me that he was a class mate of Brian Quinn at St Gerard’s. But as he was leaving, he let slip, almost diffidently, that he had been in Lisbon on that other glorious day. It got me thinking; most of those who made that pilgrimage must be getting on. (At least 2 of my Dad’s pals who went with him have died.) Wouldn’t it be an idea for Celtic to invite those remaining to a celebration at Celtic Park, sometime soon? I’m probably saying this because my auld Dad is 89 and might not make the Golden Jubilee.

Anyway, now I’ll go back to read the joyful contributions that I’m sure make up the blog.

  24. Good morning CQNers,
