Thistle’s aim for top 6, the liquidator’s duty

It’s another big day in the title race as Aberdeen visit Firhill. Partick Thistle’s form has been up and down recently, losing to Hearts and Dundee United, beating St Johnstone home and away, winning and losing against Motherwell, all in their last six games. They have not won or lost by more than two goals win or defeat since November.

Aberdeen’s games since the turn of the year have also been tight, a 3-1 defeat at Inverness last month is the only occasion there has been more than a single goal in any of their games. It’s likely to be tight tonight.

A win would put Thistle into the top six, is it too much to ask…….

Natural justice would suggest that Rangers liquidators, BDO, should be allowed to appeal to the Supreme Court on the club’s creditors’ behalf (they were granted permission to appeal this morning). Rangers won the initial decision on a number of their players EBTs, and then the first appeal, so it’s clear there are finer points of law at play.

With Rangers now in liquidation, creditors may wonder why BDO are spending their (diminishing) pot of money on what is sure to be extravagant legal fees, especially as HMRC is the most influential creditor.  Liquidators have a responsibility to the creditors to dismiss any claims on creditors’ funds which cannot be substantiated.  If the liquidator wins at the Supreme Court, all creditors apart from HMRC will receive a higher payout.

I don’t imagine Supreme Court hearings and written judgements are arranged in a hurry, so put this one on the back burner for a while, but there remains a lot at play here.  I’ve tried to steer clear of the issue for a while now, as it’s little more than a distraction, but that’ll change should HMRC win in London.

Every time Sevco makes a statement about not having any debt, they are admitting that they’re a new club, because the only way Rangers could get away with not paying over 90 million quid to their creditors, not counting the yet to be finally decided BTC, was by not being Rangers.

     

     

    What will it take for creditors to finally say enough is enough, if you’re Rangers we want our money, and ye can start by selling yer Big Hoose and Auchenhowiedidwegetawaywithat.

     

     

    They’re using a prohibited name under the 1986 Insolvency Act, and yet not an objection from the people they left so out of pocket.

    Right, so it would appear that if Resolution 12 isn’t resolved by 31 March then it’s really been a waste of everyone’s time and effort.

     

    Also it would appear Celtic didn’t do all they could have to ensure this issue didn’t die a death.

     

     

    So what we are saying is Celtic feared the res 12 guys would somehow be able to progress this issue independently of Celtic PLC so they encouraged them to bring it on board so they could keep an eye on and hinder/slow up the progress till it was time barred?

    All our wins since 2000. The actual average is 92.5 but given the nature of 3 points for a win it’s more of a spread. On our points per game we’re headed for 86 which is the lower end of the previous winning totals (3rd lowest after 07- 84 and 13 – 79) .

     

     

    As an optimist I tend to think we’ll be a bit closer to 90pts which puts is right in that middle group of winning totals.

     

     

    If, unlikely as it is, we get 10 wins from here 93 pts will be the 5th highest winning total since season 00/01 in the process losing only 3 games which has only been bettered 3 times and equalled twice.

     

     

    For the record our worst winning season in that period was 12/13 – 24 wins, 7 draws, 7 losses leading to 79 pts. Although we beat Barcelona so people seemed not to notice.

    The Bootleg Bears keep making these self condemning statements, which are an open goal for creditors and other aggrieved parties.

     

     

    However, for unknown reasons, no one claims the tap in.

     

     

    Could it be that any and all situations involving creditors are the sole responsibility of BDO and it may be down to them as to how they proceed.

     

     

    Personally, I believe that there was an agreed position that nothing was to hinder the Bootleg club, as all parties, including HMRC stated that they had no intention of preventing a club call “Them” from competing.

     

     

    It’s the Bryson conundrum that has facilitated the cheating and validated the irregular player registrations.

     

     

    And that has nothing to do with whether tax was due or not.

    I guess there are many interpretations of that data. As you correctly point out we are doing no better or worse than our average campaign accurate data points average.

     

     

    Means other teams are improving. Significantly they are improving faster than Celtic – hence the gap is closing and they are doing so in a climate of little or no spend relative to Celtic?

    Not for one minute do I doubt your (collective) abilities in advancing Res. 12 nor that there is much more work being by you than can be put on here.

     

     

    From BRTH’s comments, it appears that responsibility for investigation of the issue lies with UEFA and that it is already too late for them to act.

     

    I admit I have read these posts only once, so I will read them again.

    As I said earlier the time bar was introduced last year, Res12 has been running since 2013, it could be that those responsible were too busy balancing the books and working for other football companies such as the SFA, SPFL, ECA and trying to blow smoke up our rectal passages about pipe dream moves out of Scotland.

     

    Then again they could have all this in hand and have made representation to UEFA and agreed that an investigation will take place after all the legal stuff has died down but just forgot to tell us.

     

     

    Either way it makes no difference to us, we are continuing to make sure the Resolution is taken as far as we can take it, as promised.

    Please read BRTH’s post again, 31st March is when the license was issued, any enquiry before that date is within the time.

     

    However the monitoring period is till the end of the season which is why we cannot be sure which is the cut off date and why we are using the earliest possible.

    There’s no doubt RD’s having a bad season and he’s going to need to win 9 out of 10 remaining league games to say he’s doing relatively as well as any other manager.

     

     

    I could go on a big rant about how simply being at Celtic put’s a grand at least onto a 1st team squad players wage and other things. Our wage bill per the accounts is 5x plus higher than Aberdeen’s according to their figures. We also employ 500 people to their 112. I suspect our football wage bill isn’t 5x greater than their and I’d also suggest that outside of our biggest earners that if you subtract the ‘Celtic premium’ we’re not paying that much more than them – and therefore it’s not too surprising that they’re getting closer to us.

  19. Normally in a week were 2 teams play the same opposition, many are quick to point out similarities or differences in results.

     

    Like we drew with Dundee but Sevco put 4 past them so Sevco are a better team or we put 4 past Morton and Sevco needed a late equaliser against them so we’re a better team. You know the type of nonsense that means absolutely nothing. Although we all know we’re the better team!

     

     

    I think this week is different though.

     

    Aberdeen went to Firhill and battled back from a goal down to win 1-2. Fair play to them, they didn’t crumble and now I’m sure the SMSM will be backing them to run us all the way for the title.

     

    Well we go to Firhill on Saturday and I believe we need to make a real statement, show everyone we mean business and no-one is taking our title.

     

     

    A full 90 minutes of pressure on Thistle, 3 or 4 nil win and dampen all this nonsense that we’re under pressure.

    After all,FIFA looked back further than five years to nail Blatter and Platini.

     

     

    Or ‘cover it up for five years and yer laughing’ is the new modus operandi for European football-and that will not do. That is no way for a governing body to operate.

    I agree but there is nothing in the CFCB rules that qualifies that it’s simply a five year time bar on prosecutions, BRTH being of a legal mind is taking that to the date and his date is 31st March, who are we to disagree :) I’m just happy we will not be caught with our short trousers round or ankles :)

    On the corruption, it was a criminal investigation not a UEFA investigation that moved Blatter, UEFA had to throw some sort of cosmetic action together, remember it only really started to move when the big sponsors started pulling out.

    Some important stuff from BRTH and Canamalar this morning. Time overdue for Celtic to expedite the original Resolution.

     

     

    Unrelatedly, there was discussion yesterday about the timescales for the Supreme Court decision on the Big Tax Case.

     

     

    The Deutche Bank case which was issued this morning in favour of HMRC took 10 months between leave to appeal to the SC being granted, and the judgement being issued.

     

     

    That’s pretty quick, all things considered.

     

     

    Based on that, we can expect the final ruling on the matter to come down sometime in the New Year, which, given the likelihood that the criminal cases wil have been concluded by that point, makes 2017 quite a year for bringing matters to a head.

     

     

    What it also means is that any overlap with Res 12 will be moot unless there is prompt action now to ensure that the issue is not time-bared by UEFA.

     

     

    If I was a cynic, I’d suggest that the SFA have been stonewalling deliberately to filibuster the matter.
