Topping’s who knew what when?

In his Q&A session with the Daily Record yesterday, outgoing SPFL chairman, Ralph Topping touched on the subject of who knew what when, regarding Rangers slide into liquidation saying:

“There wasn’t one single person ever who envisaged this case happening. You tell me who pointed out that this was going to happen – did you?

“The biggest assumption about the set-up in the SPL would be that you would have Rangers and Celtic playing in it in perpetuity – nobody thought that those two bastions of football would ever be involved in anything like this and nobody flagged it up.”

Well, in October 2011 I knew.  This CQN article from 27 October 2011 notes in very specific detail Rangers were going to liquidate, a phoenix would be created which wanted direct access to the SPL (the top flight at that time).  I got the timing wrong, predicting the phoenix would take place during the season, but to be fair, it later became clear this was Craig Whyte’s plan at the time.

Ralph Topping’s SPL knew too.  Rangers alerted them to the situation that very month.  The SPL spend November, December and January preparing the ground for Rangers administration and liquidation, a period during which a new TV deal was signed.

  1. John James seems to be confirming what we knew all along, that LNS was a sham. The football authorities had apparently already decided to strip Rangers of the trophies during the EBT years. It was an open and shut case. Rules were broken, end of.

    Tried to watch the game on Celtic TV. In the first half in particular, the stream was constantly buffering. The alternative stream offered worked well except that it was always blur. Is this normal for live broadcast matches?

    That’s a great piece and shows the ridiculous nature of the owner and operator distinction.

     

     

    When you look at LNS interpretation of the “Club” when it was decided for whom to Sanction for the breach in disclosure it is interesting…

     

     

    “Taking into account these considerations, we have decided to impose a fine of £250,000 on Oldco. It is the board of directors of Oldco as a company, as distinct from the football management or players of Rangers FC as a club, which appears to us to bear the responsibility for the breaches of the relevant rules. All the breaches which we have found were therefore clearly committed by Oldco. We see no room or need for separate findings of breaches by Rangers FC, which was not a separate legal entity and was then part (although clearly in football and financial terms the key part) of the undertaking of Oldco. Rangers FC is of course now owned and by Newco.

     

     

    Okay, so let’s look at this…

     

     

    as distinct from the football management or players of Rangers FC as a club,

     

     

    Now, what LNS is describing here is a Football Team, right, he’s saying that it’s the Clubs Board of Directors that bear the responsibility.

     

     

    So what does this mean, well if we take non-disclosure as a Breach it is a Footballing Breach, correct.

     

     

    I.e. If my boss decided to give me an additional side contract with say a bonus, as long as it’s legitimately agreed and statutory compliant, they nor I don’t have any legal responsibility to disclose it to anyone; professional body, work mate, partner whomever. It’s mine and their business.

     

     

    Not if I work as a Football Player though, my Club has to lodge this with the League and Governing Body as specified in the Rules.

     

     

    So this only applies to Football Rules and Regulations NOT Company Law. This Breach was simply Contractual Between the Club, Rangers FC and the SPL Limited.

     

     

    So on an explicitly Footballing matter concerning the Club, why was Oldco sanctioned and not the Club? They’re saying because the breach wasn’t the Football Teams? What Nonsense.

     

     

    But it gets worse…

     

     

    We see no room or need for separate findings of breaches by Rangers FC, which was not a separate legal entity

     

     

    What happened to the Owner and Operator, and Club. Why ALL the Oldco, Newco (which was never under SPL rules anyway) distinction nonsense.

     

     

    You are now saying what we all know, what is the truth, the Owner and Operator, and the Club are one in the same and when applying the rules no separation is necessary.

     

     

    So we have in the one document…

     

     

    – Rangers FC – the one legal entity. One Entity

     

     

    – Rangers FC – The Owner and Operator, and The Club. Two Entities

     

     

    – Rangers FC – The Owner and Operator, the The Club and The Football Team. Three Entities.

     

     

    Whit!!!

     

     

    Let’s think about it, maybe it does make sense…

     

     

    Obviously these entities are not mutually exclusive and can be used in any or all, partly or together to construct a legal or non legal entity deciding on what’s expedient for Rangers FC.

     

     

    So maybe that explains this…

     

     

    Q: If there was another insolvency event at Ibrox would that be considered as a first or second offence?

     

     

    ROD McKENZIE: “Second. As it stands. There is a time period between insolvency events which I think is five years. So it might not now be 25 points. I think it is a five-year period between, and if you have a further insolvency event within the five year period then you get a further 25 point deduction. At Rangers in 2011 was the administration but they went into liquidation in 2012. We are just still within the five year period.”

  18. Kouassi – thought he looked much fitter than we have seen in the past, he was getting about the pitch. From the off he was pressing everything that moved, looking like the destroyer we thought he would be. What really impressed me was his range of passing and his ability to set the tempo. He was passing forward through the lines, taking 2 and 3 opposition player out of the game. Long passes, short passes, in the air, on the ground, outside of the foot, he had it all. Really looking forward to seeing him play again.

  26. Given that Manchester City has spent more on its defence this year that 45 countries have on military defense, it looks like FFP is dead in the water. The Neymar-PSG deal seems to be the last nail in the coffin, top-level football is getting about as realistic as professional wrestling – put on a show, sell the rights, pocket the cash.

     

     

    FFP seems to look at your earning/expenditure over the previous 3 years. I wonder how this will go for Monaco, who could lose €300m of talent in the close season but not be allowed to replace them. Still, it’s never bothered Monaco in the past…
