What say you now, Mr Bryson?

Scottish Football Association.
Articles of Association.
Powers of the Board of the SFA.
56, (8).

“It [the Board]shall have power to enquire into all and any financial arrangements between recognised football bodies, clubs and players and to cancel any agreement between clubs and players contrary to the Articles and to publish in the public press or otherwise the findings of the Board in this regard and the substance of any and all evidence tendered in such enquiries.”

“It shall have the power

“to enquire into all and any financial arrangements

“between recognised football bodies, clubs and players

“and to cancel any agreement between clubs and players contrary to the Articles”.

While the prolonged HMRC inquiry into Rangers played out in public, the Scottish Football Association had the power to enquire into what was going on and rule accordingly.  They chose not to.

Mr Bryson is the executive charged with this responsibility.  He did nothing.  Then his evidence to the Commission determined the outcome and effectively cleared his earlier inaction. In SFA parlance, this is “heavily conflicted”.

What say you now, Mr Bryson?

It was always rather curious that the SPL convened the Commission, not the SFA, which is the registration body.  Had it been the SFA, the first route of appeal would be to the Court of Arbitration for Sport (CAS).  CAS ruled against Mr Bryson’s interpretation of proper registration when the Swiss FA registered Sion players, in line with the documentation submitted, but improperly.

If the SPL takes the matter to CAS it will win.

Celtic, and Celtic fans, cannot do anything alone.  We need to stand with other SPL clubs, or to be more specific, we need to stand with the fans of other SPL clubs in the first instance.  An SPL Fan Group is needed.  More on this later.

    SPL Statement – Independent Commission

The SPL Board appointed the Independent Commission to consider all aspects of the above matter and at no point provided any direction to the Commission on any aspect of the case.

The SPL Board notes that the Commission has upheld a number of complaints against Rangers OldCo and that Rangers OldCo has been found to have breached SPL and Scottish FA Rules over an 11-year period in relation to the non-disclosure of financial arrangements involving many of its Players.

The SPL Board are assured by the integrity of the process followed and thank The Rt Hon Lord Nimmo Smith and his colleagues, Nicholas Stewart QC and Charles Flint QC, for their time and effort.

The Board wishes to give the detail of the decision further consideration at its next meeting

  4. Since Thommo broke the story about Ogilvie and Co being Ranger’s shareholders he has probably given CO the prerfect alibi.

Ogilvie will simply say that since he was a shareholder in Rangers he had a conflict of interest so left this work to others!

I just signed papers if they put them under my nose (when I was at Rangers) and didn’t deal with any Rangers stuff when at the SFA as I was a shareholder.

When Joseph Heller wrote Catch 22 he based it on the SFA rules.

  5. Paul67

Bryson did not just clear himself of his earlier inaction, he saved the SFA the cost of meeting his failure to act.

The argument had LNS arrived at the conclusion that Rangers had sought competitive advantage would have led to compensation claims of the SFA for not investigating as soon as they were aware HMRC had presented an ebt bill (possibly early 2008?)

So the last thing the SFA wanted is the only verdict all the evidence pointed to, but instead used another technicality to avoid the consequences of their dereliction of duty.

Is it only me or do others find both rulings from the FTT that a loan is not a payment and LNS that no sporting advantage was gained by having £40 odd million to spend on players an insult to our intelligence?

Do folk in charge think we are a nation of morons or are they simply addressing the morons in our midst?

One judgement -The FTT is already under official appeal, the other is still out to the jury of football opinion and they are the ultimate judges. LNS has found the technicality on which to make a judgement that protects Scottish football from compensation claims – job done in a legal sense.

The collaterall damage may cost more than the compensation saved.

The SFA are beyond saving now and so is Scottish football as long as it is run under their jurisdiction.

  6. What I can’t understand is during Sion’s dispute with Uefa, uefa refused to accept any ruling made by the Swiss courts as they said civil courts had no jurisdiction and any disputes had to be settled by CAS.

Now it seems to me the SFA think they were covering their arses by appointing a so-called ‘independent’commission, and doing a Pontius Pilate by allowing said commission to set the punishment as well.

Time for Uefa to look at this, they probably are already, but let’s not forget, the unseen handshake is not just a Scottish thing.

I have tickets for tomorrow’s game and the game in Dingwall next weekend. I’m heavily conflicted about whether I’m going to use them or not.

I understand fully the argument that we should stick with Celtic and that it’s not our fault. However I also understand the argument that by continuing to spend time and money watching a corrupt game we are legitimising and validating the corruption and cheating. It’s this argument that holds more sway for me at this time.

If I thought there was going to be some sort of action tomorrow to register our disgust (e.g. mass walk out during the game, by both sets of supporters, to be replicated at other fixtures later in the day) then I’d be inclined to go, but I’m not aware of anything taking place and I fear that if we all just turn up as normal, we have no hope of addressing the corruption and cheating that has utterly warped our game.

If the LNS result sticks without challenge I’m considering not attending another Scottish football match, but trying to get tickets for Celtic’s European games only from now on.

Whilst we may have suspected that there was considerable bias in the application of the rules, the LNS decision lays this out explicitly in black and white. I sense acceptance among fans of all clubs that Rangers/New Rangers were/are governed by a completely different set of rules to the rest of us.

    This isn’t sport any more.

  14. Well done Paul, using their own rules to hang them….they tried to twist them so often, re-write to suit it was surely a certainty they would slip

Now is our time, the true power of the Scottish game – the fans must once again stand united to bring about the changes required. We the fans forced the issue to get Sevco put into Division 3 against the wishes of other SPL clubs / SFA and Sevco themselves.

The Internet bampots MUST get together to form a clear strategy to get the message over we will NOT be cheated AGAIN.

Mostly keep to lurking at the moment, the volatility of opinions on the blog on any given issue varies wildly from very good and sensible posts to some utter gash; I tend to stay away directly after defeats and after rulings like yesterdays from LNS.

Did any of us expect anything other than the verdict that was published yesterday, I didn’t, it was only a gut feeling but I would have been astonished if titles were stripped from them yesterday. If the SPL/SFA could have manufactured a way out they would have, it seams they have and they did.

The evidence given by Mr Bryson makes no sense, it basically states the way I read it is; register your players any way you want legal or illegal because as soon as I accept the registrations they become legal anyway. How clubs who have been banned from cups more heavily fined feel about that I can only imagine.

Football in Scotland is finished as sure as night follows day, the deady bears have gotten away with it, the only punishment they have received is demotion to division 3 because the club was liquidated and they had to start again as a newco, the SFA and SPL have not got a clue.

We have the hordes of hades stating that they are the real victims in all of this, and they have been so hard done too, it is astounding of forehead some of the statements emanating from asbestox.

I will renew my season cards, I don’t want to punish Celtic because of the situation with the deady bears, but I totally understand anyone who is re-evaluating their financial contribution to Scottish Football which after the LNS verdict is totally morally and financially corrupt, the evidence is clear for everyone to see (except if you are an Edinburgh Jury) and its sad but I don’t know how the game can move forward from here.

On a brighter note, absolutely looking forward to tonight’s 1254125 with the Lisbon Lions at Celtic Park, should be a good night!

When I played school football there were Protestant and Catholic schools in the league.

A teacher from one school or other refereed the game. The subs ran the line. Honesty was the watchword. We even lent each other players in the case where a full complement did not turn up.

A player of ours, lent to the opposition, and furious at being sub, took this honesty to new levels and scored a hat-trick for them. Just to get back at the teacher in charge.

  24. Can someone clarify/confirm that the outcome from the LNS enquiry was merely a “recommendation” to the SPL? (as I believe it is). As I understand it, this means that these “recommendations” are discussed by the SPL board, where amongst others Celtic are represented. I think this may have some way to go yet.

  27. macanbheatha, if you’re on them for a great length of time, request a gastroscopy as something else may be up. But doctors here in Germany prescribe Omep freely, seems it’s necessary to counteract the effects of modern processed food. Not an ideal solution, of course.

  28. This might seem a bit odd.

But the more I think about it the decision yesterday wasnt really about Rangers.

    Rangers are dead.

All the guilty verdicts and mountains of punishments would have done what exactly.

Whats the point in hanging a corpse.

However a guilty verdict would have one very serious outcome.

People would ask how could such a state of affairs have arisen.

And people might actually investigate how such a state of affairs had arisen.

Would you investigate the dead or might you take a wee iook at the living.

I think a big bright spotlight would have focused directly onto the SFA.

The bizarre logic needed and the selective interpretation of evidence to arrive at that verdict yesterday could quiet easily give rise to the notion that the Establishment was closing ranks.

Charles Green and fat Sally’s demands for an apology are a joke, what part of GUILTY don’t they get? They were found guilty, end of, it’s only the punishment that doesn’t fit the crime. What is the point of a fine when its unrecoverable? They may as well have made it £2.50 or 250,000,000

  31. Still deducted a point more than cheating rangers…

‘Salisbury have been docked a point and fined £100 by the Conference for fielding an ineligible player.

The papers for Elliot Frear’s loan from Exeter were not received and processed prior to the player being fielded against AFC Hornchurch on 12 January.

It means the Whites drop to second in the Blue Square Bet South – level on points with Welling, who have a better goal difference.
