What’s it to you, Charlie?

The news yesterday that HMRC would appeal the decision by the First Tier Tribunal (FTT) to reject the part of their tax demand against former club Rangers which was still open to dispute was received by most with passing interest.  The FTT returned a split decision, with the minority view giving HMRC substantial grounds for an appeal, and as we have heard often in recent years, HMRC always pursue tax under various circumstances.  Reasons include when they believe wrongdoing has occurred.

As such, it seemed strange that The Rangers chief executive, Charles Green, issued a statement on the subject yesterday as the on-going tax dispute “will have no affect (sic.) on us”.  He also wrote “in the strongest possible terms to HMRC pointing out the futility of such an appeal”.

If Green expects HMRC to read this letter and to countenance a change of tact he has a regard for his own abilities which are, frankly, a little curious.  No mere mortal could write a letter and bring about any change in such a dispute, which leads us to another question, is Charles Green a mere mortal, or does his aim occasionally stretch beyond his reach?  I’m sure we’re not dealing with a Self-Certified-Superman.

The point to this exercise is that while Green’s newco is not liable for another company’s taxes, his football club inherited the SFA place vacated by Rangers, including pesky football liabilities.  Fifa and SFA rules on paying social taxes are clear – avoid them illegally and face disciplinary action.

As the matter is on-going, the football authorities have yet to issue any disciplinary action for the non-payment of taxes for the five players Rangers conceded to the FTT.  Should the courts ultimately decide in favour of HMRC for the balance of players still being disputed, a fresh wave of disciplinary measures would be due against Green’s club.

Last summer we discussed how the toxicity which was attached to the club Craig Whyte inherited, and then relinquished in a worse state, would make going forward as a Newco with any connection whatsoever to the SFA membership of Oldco very difficult.  Many, including the Blue Knights consortium, concluded it didn’t look viable.

It still doesn’t. Scottish football needs to consider how to deal with the long term consequences of these matters.

  1. Some Juventus news.

     

     

    The club has 12 players away on international duty with various squads – including Asamoah at the AFCON with Ghana who have reached the sf, as have Nigeria.

     

     

    Juve coach Antonio Conte seems to be giving the impression that he is becoming a wee bit concerned about the upcoming tie with Celtic, and has hinted that he is giving serious consideration to fielding Anelka in Glasgow.

     

     

    We shall see!

    The fitness issue was put to bed a couple of seasons ago after an 11 game unbeaten run Paddy played in. Up to three games a week no problems. He was dropped because a managers a fav became available that needed games to get match fit and we lost games.

     

    Paddy’s only problem is he is not a managers fav.

     

    And within a couple of weeks of being dropped the usual drivel about his fitness became gospel again.

    Have to admit I quite like the look of Steak Edinburgh…..but Tempus looks good too, although potentially a bit more “fancy”?

    theres a steak restaurant called Kyloe which is situated above The Rutland right on the west end of Princes Street. theres also a restaurant called “Steak” which is on Picardy Place at the east end of town. Kyloe definitely has the better reviews out of the 2 but it could be very busy. west end of town is better for pubs and clubs after the meal anyway.

    I’ve been spoiled by the shedloads of excellent curry houses in Glasgow.

    It’s my understanding that FIFA and UEFA both define Football Clubs as legal entities. Therefore UEFA and FIFA are of the opinion, Rangers FC is no more. Given that’s the case, how can they flout their own rules and insist Charlie pays taxes owed by a dead Club?

     

    Inheriting the SFA membership doesn’t mean inheriting the debt. Had Spartans inherited the SFA membership, would they be liable ?

     

     

    Was it not part of the agreement with the SFA that in order to get the ‘associate’ license, SevcoFC had to agree to pay any debts owed by RangersFC? Whether monies owed to the taxman was part of the deal I would sincerely doubt.

    There’s also a couple of places that do a nice variant of a steak, which they call a steak bake.

     

    I am told demand can be extremely high at peak periods, and unfortunately you can’t pre – book, although there are rumours they cater for bulk orders, but only in the south side of Glasgow.

    Between 6th Nov 2010 and 1st Feb 2011, Celtic played 16 games.

     

     

    Paddy started 7 of them, completing 90 minutes on 4 occasions.

     

     

    He came on as a sub in a further 8 games.

     

     

    Of those 16 games, Celtic W11 D 4 L1.

     

     

    He then made 8 sub appearances for the rest of the season.

     

     

    In the following 16 games (for comparison) after 1st Feb, Celtic W11 D2 L3 – this run includes 3 games against the Dead Ones.

     

     

    Your point about whether the manager has favourites and Paddy is not one of them is an interesting one and I honestly wouldn’t know.

     

     

    The main beneficiaries in terms of appearances when Paddy dropped out after 1st Feb was Samaras and Ki both of whom I’d have in the team ahead of Paddy any day. But that’s just my opinion.

    Cheers for the stats, I was pretty sure the games he played a major part in (time) we completed an 11 game unbeaten run, at the time I remember the fitness question was put to bed and did not return until after a few games out. Point being during that spell people stopped questioning his fitness.

    There has been much written and chewed over on the topic of what a ‘club’ is for the purposes of footbal Governance, but here is the essence, distilled from firstly the SFA’s Club Licensing rules, and secondly, UEFA’s Club Licensing Rules:

     

     

    “Licence Applicant: The Licence Applicant may only be a football club, that is the legal entity fully responsible for the football team participating in national and international competitions and which is the legal entity member of the Scottish Football Association (Full or Associate Member).”

     

     

    “Club: Legal entity fully and solely responsible for the football team participating in national and international club competitions which applies for a licence.”

     

     

    One of the intriguing aspects of the Nimmo Smith Commission is the prospect of LNS reconfirming his view that the ‘undertaking’ bought by Sevco is the ‘club’, which is contrary to the above rules, while in the face of liability for sanctions, Green changes his mind and argues the opposite position.

     

     

    We’ll see I suppose.

    Today’s news about him being dropped from the euro squad without replacement tells me he is not a managers fav, far from it, it looks like the manager/club is angling for constructive dismissal.

  30. Chairbhoy, I believe going into administration and liquidation and not paying tax is different from illegally avoiding paying tax. It’s the latter Fifa are concerned about. The former is dealt with as part of other processes.

     

     

    Chaplin, yes, that remains sound advice. Always an ace up his sleeve.

  31. TwoMacaroons, I think Phil was flagging that the 22 million was not all fresh equity pumped into the Club by way of Share Issue. A huge chunk of it consisted of side deals and it looks like one of these deals has unravelled and Phil said this Asian Consortium were CONSIDERING applying for a winding up order to get their money back. Chuck flew out to Dubai next day, perhaps he is in negotiations with them perhaps he is seeking a replacement Investor, who knows? one thing for certain all is not what it seems to be at Sevco, they are still in big trouble.
