Whitewashing in the age of Judicial Reviews, fans united, we’re gonna do it anyway

Mike Ashley’s petition for a Judicial Review of the processes the SFA followed when finding Dave King fit and proper to run a football club is a lightbulb moment. The decision, taken by the SFA board, was not unanimous. I am sure some pointed to King’s enormously controversial past and alerted supportive voices of the potential for trouble ahead.

The dissenting voices were voted down, but just like Heidi Poon, their unwelcome guidance will ultimately be found to be assured.

What Ashley has demonstrated is that anyone can ask for a Judicial Review. CQN’ers could ask for one into the scope, probity and remit of the Lord Nimmo Smith Commission, for example. I discussed this some time back with an advocate who suggested we hold tight.

The SFA and SPFL must tread carefully, they are no longer in control of events. It would be wise for them to wait until the Supreme Court appeal notification deadline passes before choosing any path.

In the meantime, whoever decided to fan the flames by launching the “no appetite” blocking strategy should calm the waters. There is enormous appetite to look into what many within and outside of Scotland are calling the biggest cheating scam in British sport.

People are angry right now, not at the cheating they have suspected for years, but at the authorities attempt at whitewashing.

There are demonstrations and boycotts being discussed. Millions of words have been written.

Groups of Celtic and Hearts fans are becoming unnervingly cooperative, good grief! See what you’ve done, Mr “No Appetite” man? Supportive understanding is NOT how I usually relate to Hearts, Hibs, Aberdeen, United or Dundee fans. Even Motherwell fans!

Before the PPI industry start sending “Is there a Judicial Review you’d like to instruct” recorded messages to our phones….

A calming word from the SPFL, in the first instance, should be issued. All it needs to do is acknowledge the Court of Session verdict, and that the notification deadline for a subsequent appeal has not passed. This would commit to nothing, but it would also supersede the earlier attempt to whitewash, and perhaps allow some to get back to doing their day jobs.

For the record, a whitewash will simply not be possible. The fan-mechanisms, honed in 2012, are fired-up. We’re gonna do it anyway.

On Ashley, I’ve said this before about him, our enemy’s enemy is not our friend. Ashley has good reason to raise legal actions against those who subverted his interests at Newco, but he is not someone you or I would want associated with our football club. Those who campaign to remove his influence from their clubs (including Newcastle) do so with sound reason. Even if their tactics harm their club far more than Ashley.

    I had a flicker if hope when Celtic Nation (the Carlisle based outfit) were cantering through the pyramid league structure. alas that came to nowt.

     

     

    Then you look at some other examples, like Fc United of Manchester; it cam be done.

     

     

    It’s a slow decline for us here in monetary and therefore football terms.

     

     

    But then there’s our own and the club’s souls to consider too by staying in a cesspit.

    As you keep telling us scotland is a rancid racist bigoted little nation, how right you are, I ran away many years ago cos of the reasons stated, I was found out to be a Tim in the workplace, as I said it took a few years, but they got there eventually, and the only people who could protect me were in fact at the front of the Q to destroy me, how ironic, thank you Ireland for taking me in, I will forever be in your debt.

     

    Now consider the hacks in scotland, what are they to do, speak out ? do they put their family and jobs on the line ?

     

    Do our suits speak out and jepordise the future of the club ?

     

    Sometimes I wish they would.

     

    There is a time and a place for speaking out, and I agree that the suits are feckin winkers.

     

    The problems will not be solved by our suits speaking out against the corruption, it’s the year 2015, and things are as bad today as ever imo, speaking out sometimes makes things worse, and no, it’s not an excuse, it comes from experience.

    Unfortunately, all the judges at ringside seem to be ignoring the KO, whilst the hacks don’t want to report the result, but would prefer to stick to the judges scorecards.

     

     

    The audience seems strangely fixated by the journalists too. We’ll wait and see if the champs’s management back him, cause they have a track record of being more concerned with the purse from a re-match.

    Funny thing a season book, an act of faith to buy a ticket for every match for the next nine months. In return you get to sit in the same seat.

     

     

    Without them the club has exposure to all sorts of factors from a poor run of form to the weather and the financial implications that follow.

     

     

    Now, an empty national stadium or a boycott of the SFA Cup would send a strong message.

    I also said years ago that Celtic playing football in scotland was akin to a Jewish club playing football before the war in nazi germany, I was told that I was mad, maybes, but the similarities are there.

     

    I was then told that this in the 2000s and nothing that would ever happen today, those who said that obviously hadn’t heard of the bother over the water in the north of Ireland, or the killings that are happening the world over, never say never, I understand their fear of speaking out.

    Just read back, I can appreciate your anger but like some I would prefare to see if there is an appeal (2nd Dec I believe) then if there is not one, our board should make their stance.

     

     

    If the board don’t, then we know we are getting taken for patsys.

     

     

    On a side note… I reckon our board are hoping thems will self combust, so they need to say nowt.

     

     

    Even if that does happen, I still want our board to be vocal on the cheating and strip the titles. HH

  16. A Rangers (2012) shareholder has served a Petition on the SFA for a Judicial Review relating to King passing a fit and proper test. The SFA released a statement acknowledging receipt and saying that they intend to defend.

     

     

    Celtic (1888) shareholders have been trying unsuccessfully to get the SFA to answer their questions re Res 12.

     

    A judicial review would mean that the SFA would have to find their voice.

     

     

    When we ran the new club ad in the Sunday Herald a well known, leading Scottish lawyer (who I have every reason to trust) told me that we should go down the Judicial Review route and that of course we would win.

     

     

    The LNS defence being put forward by them is that ‘ it was agreed that it was a final decision’ regardless of subsequent appeals etc. No mention of subsequent wrong doing re withholding vital information by those involved in the scam in the first place. A judicial review would sort this out too.

     

     

    Apparently you can apply to the court for an order that regardless of the result, each side pays its own fees. In our case, supporters banding together etc, it is likely to be granted.

     

     

    We have lawyers – solicitors and advocates – that may assist as much as possible.

     

     

    Ashley, with his deep pockets, has shown the way.

     

     

    He has looked at the corruption in the Scottish game – and remember the SFA actually fined HIM! – and knows that this is the way to flush them out.

     

     

    If we had a handle on likely costs we could raise the money. Come away wit them being a NEW CLUB with two low division honors, expose the SFA re Res 12 and get the LNS decision booted into touch, leading to a clear out of the lot of them at the SFA.

    Here’s the thing thats thornin me with Phils blogs. He seems very pro “Big Mike” and is clearly delighting in the trouble this is causing King and co.

     

     

    I’m missing something, because Ashley is plainly driven by the profit motive, sees a significant return on his investment in Newco at some point. According to Phil, the return on Newco currently equates to only one of his Sports Direct stores, so the energy he is devoting to this implies a longer-term and far more lucrative objective.

     

     

    Therefore, this is surely a wee shark, whose business practices should be decried by any worker, who is going to seize control and make them in to a profitable business. Never mind that its pissing off the huns. This is something I’m not particularly keen on.

  19. I believe they have 28 days to apply for permission to appeal.

     

     

    They have 42 days to file their appeal.

     

     

    i think there may be procedures to appeal even if they don’t get permission from Cofs.

    Increasing numbers of journalists are hiding behind the Nimmo-Smith commission, avoiding its numerous debatable aspects (which I will revisit in a future article if you don’t behave yourselves), as if they’ve lost their interrogative and/or campaigning instincts. Perhaps they really believe it fair that Rangers used improper tax avoidance schemes, with the declared intention of facilitating the purchase of players they could not otherwise afford, while deliberately concealing such actions from the football authorities…for 12 years. Either way that attitude is unacceptable and, as has been the case throughout Rangers’ financial demise(s), it shames their profession.
