Whitewashing in the age of Judicial Reviews, fans united, we’re gonna do it anyway

Mike Ashley’s petition for a Judicial Review of the processes the SFA followed when finding Dave King fit and proper to run a football club is a lightbulb moment. The decision, taken by the SFA board, was not unanimous. I am sure some pointed to King’s enormously controversial past and alerted supportive voices of the potential for trouble ahead.

The dissenting voices were voted down, but just like Heidi Poon, their unwelcome guidance will ultimately be found to be assured.

What Ashley has demonstrated is that anyone can ask for a Judicial Review. CQN’ers could ask for one into the scope, probity and remit of the Lord Nimmo Smith Commission, for example. I discussed this some time back with an advocate who suggested we hold tight.

The SFA and SPFL must tread carefully, they are no longer in control of events. It would be wise for them to wait until the Supreme Court appeal notification deadline passes before choosing any path.

In the meantime, whoever decided to fan the flames by launching the “no appetite” blocking strategy should calm the waters. There is enormous appetite to look into what many within and outside of Scotland are calling the biggest cheating scam in British sport.

People are angry right now, not at the cheating they have suspected for years, but at the authorities attempt at whitewashing.

There are demonstrations and boycotts being discussed. Millions of words have been written.

Groups of Celtic and Hearts fans are becoming unnervingly cooperative, good grief! See what you’ve done, Mr “No Appetite” man? Supportive understanding is NOT how I usually relate to Hearts, Hibs, Aberdeen, United or Dundee fans. Even Motherwell fans!

Before the PPI industry start sending “Is there a Judicial Review you’d like to instruct” recorded messages to our phones….

A calming word from the SPFL, in the first instance, should be issued. All it needs to do is acknowledge the Court of Session verdict, and that the notification deadline for a subsequent appeal has not passed. This would commit to nothing, but it would also supersede the earlier attempt to whitewash, and perhaps allow some to get back to doing their day jobs.

For the record, a whitewash will simply not be possible. The fan-mechanisms, honed in 2012, are fired-up. We’re gonna do it anyway.

On Ashley, I’ve said this before about him, our enemy’s enemy is not our friend. Ashley has good reason to raise legal actions against those who subverted his interests at Newco, but he is not someone you or I would want associated with our football club. Those who campaign to remove his influence from their clubs (including Newcastle) do so with sound reason. Even if their tactics harm their club far more than Ashley.

    Although I do notice the piece is timed at 11:40pm, so maybe TonyD is correct in suggesting it may have been penned under the influence of strong medication.

    Regardless, they took wages, never paid taxes, where not registered, and the people running the game, held back important evidence from a law Lord, or else the Law Lord was in on it? It’s a simple investigation, but not behind closed doors with colour coded names being banned about, it all has to be out in the open independent enquiry or who ever it is, no BS people where under the impression this was all above board, and it hasent been no stone should be left unturned, every club supporter here in Scotland is involved.

     

    To let this be swept under the carpet is what will happen if all the clubs don’t get involved mark my words, they are betting that the storm will blow over and all will be well, a dangerous game I would say, I doubt if fans of Scottish clubs are that stupid to ignore this, I doubt it very much.

Having desperately scrambled for a technicality as to why the issue has to remain closed the propaganda machine turned to quislings and sell outs to blast out the even handed view that the matter is closed. Still faced with the return of the fans’ 2012 tsunami we are now having project fear dusted down. This will be the biggest mistake of all.

     

     

    Strip the titles, ban Murray, Ogilvie and Dickson from football life, make it clear that expulsion of the club would be the only outcome had liquidation not happened, end the same club farce.

     

     

    Then we all move on, including the current Rangers.

    the SFA are trying everything in their power and stuff not in their power to refuse to answer the questions. we are issuing a third letter (the second through a legal firm) to get them to respond on what they have done about the information they received with the first letter, they keep demanding the identities of those who supported the resolution. Looks like they have taken a leaf out of Ally’s book, ‘who are these people, I think we should be told’ rememeber that ?

    If we were to be philosophical for a moment Christians believe love never fails. My experience is that is true, but knowing what love is and what it requires is a life learning lesson.     So The Telegraph article like all of which we have been barraged with is a load of fearful tripe and this is why.

     

     

    The fear of compensation is really a bogey if every club seeks it. Where will the money come from? Scottish football is a closed INTERDEPENDENT industry that, if it goes the full compensation hog, will just eat itself.

     

     

    That just isn’t going to happen. Stupid as football is it isn’t that stupid. So it’s much more likely deals will be done that meet the need for sporting justice without commiting financial suicide.

     

     

    That brings me to a simple question. Why is taking titles away in light of all the evidence they were dishonestly won by a means that required full registration details under the rules not to be disclosed in order to get the advantage SDM admits ebts were used for to remunerate players?

     

     

    It’s not as if it is TRFC who risk losing the titles. They were won by RFC. OK same club poo comes in here but clearing up that mess of their own making is a nettle SFA and SPL need to grasp.

     

     

    Is all this propaganda at the end of the day driven by the fear of a number of asterisks appearing in the football history books against trophies RFC “won”?

     

     

    Why is that so terrible as it’s only official recognition of what every non TRFC supporter believes. Add to that that the same club believers will simply believe the titles were fairly won anyway and it really all becomes much ado about nothing after the loving decision is made.

     

     

    So we need patience to give it time for that to happen and hope that authorities will find the courage to overcome their fear.

    Upon your retirement in 2009, you perhaps looked forward to a well earned rest, maybe away from the glare of publicity, and a chance to spend some time with your family after a distinguished career in public service.

     

     

    It appears that you are to be denied this.

     

     

    In 2012 you undertook to chair an independent enquiry into whether or not Scottish Premier League rules were broken regarding the non disclosure of payments to players at Rangers football club between 2000 and 2011.

     

     

    Based on the evidence you were given, and the instructions you undertook, you gave your verdict in February 2013.

     

     

    I am in no way implying any sort of misdemaeanour, nor any kind of undue influence in reaching your conclusions, which I am certain you arrived at with enormous diligence and a genuine desire to deliver a verdict which was honest, transparent and final.

     

     

    However, I wonder, if in light of recent events, you may find it neccessary to make a public statement.

     

     

    What worries me is that, as with all reports of this kind, your good name and reputation, which you have spent a lifetime working for, will forever be tarnished due to association with the conclusions in your report.

     

     

    You see, the report will always be referred to as “The Lord Nimmo Smith Report “.

     

     

    By newspapers, on the radio, in television, and of course, by the general public.

     

     

    I am concerned that the conclusions you reached, based on the evidence you were presented with, have now invalidated the report you have put your name to, in perpetuity, and a lifetime of distinguished service will be erased as you will forever be remembered as the man who delivered the verdict that “no sporting advantage ” was gained by the extraordinary payments scheme, when it has now been established that there was.

     

     

    I feel it is only fair that you should uphold your right to reply, and publicly announce your own reasons for the conclusions you arrived at.

     

     

    It is your name that is on the report. It is your name that will always be on the report.

     

     

    Whatever else happens as this scandal develops, and when further questionable practices are revealed, I feel that you should move to explain the basis of your verdict, and allow the public, and perhaps more importantly, yourself, to at least be reassured that Lord Nimmo Smith should not be the first name that is recalled, and therefore forever associated, with what may yet prove to be the biggest sporting scandal, not only in British sporting history, but quite possibly in sporting history worldwide.

    The SFA are defending the action.

     

     

    It will be for the courts to decide whether the action is competent.

     

     

    So far as I understand it, judicial review only applies to public bodies and I’m not sure that the SFA is a public body.

    bottom line is, resolution 12 has been through the Celtic AGM and minuted twice in the Celtic AGM minutes, the SFA invited us to write directly to them, they made the request via the club secretary.

     

    There is no legal requirement or SFA regulation that requires personal detail disclosure, I personally interpret the demand to know who these people are as intimidation, the SFA cannot hold water never mind protect sensitive personal details and we know how some people have been targeted, intimidated and assaulted.

     

    The trick is, the SFA have had the tax report and advocates interpretation of the issues with his summary that there is a case to answer, irrespective of who provided this information the corporate compliance officer has a duty to investigate serious allegations supported with evidence. As yet we do not have any indication that any such investigation is under way which could be interpreted as a dereliction of duty, no ?

    Roddy Forsyth has form, I’m not the least bit surprised by this ridiculous article, the idea that if a Club won a trophy retrospectively, they would be liable for player bonuses but not entitled to any prize fund is nonsensical as is the whole piece.

     

     

    He is the BBC’s Scottish Football correspondent, I.e. If there something going on in Scottish Football and say Five Live want to report it, Roddy Forsyth is the go to man, he has been spouting this rubbish as long as I can remember but it became worse, much worse at the time of the referees strike and then through the liquidation of Rangers with all it’s fall-out. He has run his pro SFA, pro Rangers and anti-Celtic agenda with a passion to match the most bigoted journalist (sic) in Scotland. It is paid for by the BBC and gives the SMSM a voice in England.

     

     

    He is not to be trusted, as today’s article clearly shows.

     

     

    The reason, all involved in the five way agreement must be hugely anxious about the outcome of the BTC and just want it to go away, the water under the bridge narrative will reach a crescendo because if the Scottish Football authorities and Oldco/Newco have to deal with the repercussions of the tax avoidance and follow on cover up, it could be immense.

     

     

    As I pointed out last night as part of the five way agreement and for Sevco Scotland getting amongst other things, Rangers FC’s SFA membership, Sevco Scotland agreed to take on all of Rangers FC’s Football liabilities.

     

     

    That means anything from taking away of titles and therefore the forfeiting of Prize money, to any fines levied for over a decade of tax avoidance and any sanctions/punishments that are due to Rangers FC will be visited on Sevco Scotland Ltd or The Rangers FC Ltd as they are now known.

     

     

    The reason Sevco are so anxious and there many friends from the Football authorities, the media and beyond is that these sanctions will put Newco Rangers over the edge, the Oldco Rangers with the associated sanctions and liabilities both Football and otherwise will be so toxic no, third Rangers will want to touch it with a barge pole. That means the History myth, like Rangers MK I @ II will be obliterated IF and it’s a BIG IF – the tax avoidance issue is dealt with without fear or favour.
