Whitewashing in the age of Judicial Reviews, fans united, we’re gonna do it anyway

Mike Ashley’s petition for a Judicial Review of the processes the SFA followed when finding Dave King fit and proper to run a football club is a lightbulb moment. The decision, taken by the SFA board, was not unanimous. I am sure some pointed to King’s enormously controversial past and alerted supportive voices of the potential for trouble ahead.

The dissenting voices were voted down, but just like Heidi Poon, their unwelcome guidance will ultimately be found to be assured.

What Ashley has demonstrated is that anyone can ask for a Judicial Review. CQN’ers could ask for one into the scope, probity and remit of the Lord Nimmo Smith Commission, for example. I discussed this some time back with an advocate who suggested we hold tight.

The SFA and SPFL must tread carefully, they are no longer in control of events. It would be wise for them to wait until the Supreme Court appeal notification deadline passes before choosing any path.

In the meantime, whoever decided to fan the flames by launching the “no appetite” blocking strategy should calm the waters. There is enormous appetite to look into what many within and outside of Scotland are calling the biggest cheating scam in British sport.

People are angry right now, not at the cheating they have suspected for years, but at the authorities attempt at whitewashing.

There are demonstrations and boycotts being discussed. Millions of words have been written.

Groups of Celtic and Hearts fans are becoming unnervingly cooperative, good grief! See what you’ve done, Mr “No Appetite” man? Supportive understanding is NOT how I usually relate to Hearts, Hibs, Aberdeen, United or Dundee fans. Even Motherwell fans!

Before the PPI industry start sending “Is there a Judicial Review you’d like to instruct” recorded messages to our phones….

A calming word from the SPFL, in the first instance, should be issued. All it needs to do is acknowledge the Court of Session verdict, and that the notification deadline for a subsequent appeal has not passed. This would commit to nothing, but it would also supersede the earlier attempt to whitewash, and perhaps allow some to get back to doing their day jobs.

For the record, a whitewash will simply not be possible. The fan-mechanisms, honed in 2012, are fired-up. We’re gonna do it anyway.

On Ashley, I’ve said this before about him, our enemy’s enemy is not our friend. Ashley has good reason to raise legal actions against those who subverted his interests at Newco, but he is not someone you or I would want associated with our football club. Those who campaign to remove his influence from their clubs (including Newcastle) do so with sound reason. Even if their tactics harm their club far more than Ashley.

    I hope Kenny Sheils is not equating the treatment he received from the MSM in Scotland with that dealt out to Neil Lennon.

     

     

    In fact none of the treatment he received in his time here was anything like that dished out to his Catholic, nationalist Celtic compatriot.

    Most people down here in England haven’t a clue about the situation,never mind the extent of the theft.

     

     

    They might not give a damn about theft of trophies,but an article describing the failure of an attempt to thieve £90m from the public purse would waken them up.

     

     

    This isn’t a parochial problem. It’s a national problem. Other clubs are gonna get hammered on the strength of these findings. It’s not just Bolton or Middlesborough,Arsenal for instance,and Spurs are in deep too.

     

     

    The lack of comment in the media in England is nearly as bad as that in Scotland.

    And I agree with Paul that Mike Ashley is not someone we should be looking up to – he’s a scumbag, as are Craig Whyte, Dave King and Charles Green. These guys are pond life, ripping people off and preying on other people’s misfortunes. It’s been a great laugh that it’s the Huns they’ve been running, but we should be thankful our club is run differently. I disagree with a lot of things our board do but at least they can account for every penny spent.

    To give Kenny Shiels his due,he might not be on the same side as Neil Lennon.

     

     

    But he knew which side to be on when faced with right and wrong.

     

     

    He was one of the few anywhere in Scottish football to say that what was happening was a complete disgrace.

  7. The SMSM are keeping the lid on the scandal . Any interested english news outlet or paper will contact its scottish office or reporter to find out whats going on only to be told “nothing much”. The SMSM are in it up to there necks along with the scottish football authorities and the rest.

    But just to clear things up , could you reveal the complete list of recipients of EBTs , surely that crackpot Mitchell can’t be on it ,or can he ?

     

    Whilst you are at it could you also explain why some of the individuals who did benefit from the Emloyees Benefit Trust weren’t actually Emloyees at the time ???

    Well researched stuff. Some of the Bampots have written great pieces. Auldheid wrote one for On Fields on the Wee Tax Case for example, laying out the whole argument.

     

     

    I genuinely think because of the silence of the Scottish media that a lot of fans elsewhere in the country don’t understand exactly what it is that happened up here, and is still happening.

     

     

    I think Guardian readers, in particular, would be fascinated.

    But, what I will say is, well done to Peter Martin(McGuire) for refusing to buckle as, Wiggy attempted to sweep the HMRC tax victory under the big masonic-madusa-carpet the other night on – Peter & Roughie on, STV Glasgow. PM insisted to wiggy that there is so much interest in this story that, there is no way that football can move on until the tax evasion charges being levelled at Rangers have been dealt with.

     

    Also….BFSDJ on SSB the other night saying that the huns would appeal…Hugh Keevins said – “You may well appeal and get this issue kicked into the long grass for another year but….one day, Rangers will have to answer why they avoided paying tax through the ebt-scheme for a ten year period!”

    I will definitely recommend some reading (Alex Thompson for example). However, these guys are pros and will get it done right. Conn’s work on Hillsborough and the English FA is excellent. Gibson with FIFA is also great.

     

     

    Once the appeal deadline passes, there is nothing wrong with making the statement that Rangers use of EBT’s was illegal. Ra Peepul will have nothing to hide behind.

    However, whether it is Oldco/Newco, or Sevco – Ashley is opening new fronts in his war – we, decent football fans throughout Scotland, must also ‘step up to the plate’, after the appeal deadline is exhausted, of course!!!

  24. May I say Kudos to the many ‘Bampots’ who are striving to get the truth out there, in the face of formidable establishment opposition?

     

     

    Due to the nature of the beast, even with the considerable resources available to the likes of Mark Daly and Alex Thompson , I think it fair to say that it would be near impossible to prove the involvement of freemasonry in this whole EBT/RFC/Sevco omni-shambles.

     

     

    However, I’d venture to suggest that there’s a whole pile of ‘circumstantial’ evidence which points the impartial observer to the probability of this being the case: not the existence of a ‘conspiracy’ in the narrow sense that all the multitude involved in these affairs have met together in conclave to hatch a plan, and then later again to keep the brotherhood on message.

     

     

    I’ve long held the view that this current generation of Scots is witness to a slow but sure loosening of the nefarious grip of freemasonry.

     

     

    I note also from the Wikipedia entry on Freemasonry that, ‘Masons swear … to support and protect their brethren unless they have broken the law’.

     

     

    If my thinking is correct, this ruling from the Court of Session may give some lukewarm or lapsed brethren an opportunity they have been waiting for …

    Robbo, was was unemployed after leaving Motherwell earlier this year, put out a statement on the club website as a growing number of court actions look set to plunge the three year old club into administration before Christmas.

     

     

    Charles Green and Mike Ashley have got court cases in the next five weeks which will be ‘robustly defended’ (and costly) with the club hoping to host an AGM on November 27.

     

     

    Last week the audited accounts published a going concern warning that £2.5m was needed before the end of the season with some of that cash needed in December. As an accountant Mr Robertson will know that the going concern warning is to do with future funding, not the mistakes of the previous boards.

     

     

    Providing internet bampots with the oxygen of publicity on the club website Robbo stormed: “Personally, I would rather not give these guys the airtime or the oxygen. Different people have different views, and we need to be careful – we only have so much time and there are a lot of things we are trying to improve.

     

     

    “When these guys say things, you can disregard it, but there may come a time depending on what they actually say that we may need to act, but we’ll keep an eye on it, but we have much more important things to do than worry about online bloggers.”

     

     

    Responding to rumours that the ice cream and jelly season is just around the corner the former Fir Park high flyer added: “The club put a statement out last week, and Dave King and the Three Bears said that they will continue to fund the club going forward.

     

     

    “Due to the various court proceedings that are going on at the moment, the (share) listing is not possible at the current time. I met with the guys personally last week, and they are 100% behind the club and I have absolute confidence that they are there to fund the club going forward.”

     

     

    For the avoidance of doubt Robbo, your company chairman was described by a South African judge as a glib and shameless liar. Sports Direct can plunge the club into administration by demanding repayment of their £5m loan but Mr Ashley will stand back and let Mr King press the administration button
