Could Dunfermline vote itself to be relegated?

179

Positions are already being adopted for the anticipated Scottish Premier League vote on whether or not to vote a Rangers Newco FC into the SPL in the event Rangers go out of business in the coming weeks.  Financial self-interest may determine how votes are cast.  First to show on leaving the SPL meeting yesterday was Dunfermline chairman, John Yorkston, who shopped short of saying he objected to Rangers Newco being invited into the league, but did say: “As we speak today, if [Rangers] come out of administration I personally feel it’s a clean slate job. If it’s liquidation, it’s a completely different kettle of fish.”

Dunfermline, of course, are hot favourites to be relegated from the SPL this season but if a club above them failed to pay their taxes and went out of business the Fife club would remain in the SPL.  Even John Yorkston would find voting Rangers Newco into the league instead of his own team would be “an awkward one”.

Put the moral argument aside.  Forget about the consequences of setting an irresponsible precedent, hard cash might be enough to have Dunfermline join Celtic and vote against Rangers Newco. The Dunfermline fans would surely never forgive their board for voting themselves to be relegated?

The national sport is a national disgrace.

The only way for Scotland to redeem itself is to disband the sfa and start again

The stance adopted by the SPL yesterday in relation to the outstanding monies due to Dunfermline is interesting. It appears agreement has been reached with the administrators to settle this in order to avoid further sanctions (more points deductions ?)

I noted in the SPL rules it stated that all ticket monies had to paid within 10 days of the game being played, that would mean the ticket money due to ICT is due tomorrow do we know if that has been paid or any agreement reached ?

In addition I thought Dundee Utd are still due their share of the gate money for the recent Scottish cup tie ? Why have’nt the SFA been commenting on this ?

The crucial aspect of an EBT is how it was operated.

In the case of The Hun – Hector has to prove that EBTs were being used simply as a means of disguising a contractual payment. Did the beneficiaries of Hun EBT’s wait till they received their loans or did they receive up front /regular payments ? —— Yes or no ?

    We will know soon .

    Tick tock !

    No to Newco

I don’t know who the panel are that are, investigating the huns but, I heard the first name – Billy Nimmo Smith ? wtf.

The way I see it is that, it’s freemasons, investigating freemasons ?

    Whats the point ?

  5. On Talksport: Doncaster seems to know his stuff. Sounds like a (good) politician, but he contradicted his earlier stance on the TV deal. Now says our games with thems is part of the current deal.

When Smith was asked what he thought of losing titles, he went down the wrong road linking it to the newco situation and he wasn’t corrected by those two sycophants.

Listening to Donacster on Talksport he has not been clear on who actually votes a Newco into the SPL. He said the SPL Board but this has to be questioned (as I know MWD has).and clarified.

Keys and Gray summed it up as Newco starting back in the SPL, they are ignorant of the values issues (being so steeped in the business end it is like explaining a charity flag purchase to a merchant banker) but this whole idea that an SPL parachute is a foregone conclusion has to be challenged at every step.

    Clarity from Doncaster would help.

We need clarification on the process so that we

  7. Silver City Neil Lennon (11:34): “It’s only £2 for every man woman and child in the UK. You can have mine. Besides, it’ll scare the living daylights out of other tax dodgers.”

It will actually take money from the pockets of everyone in the UK in one way or another, but as I have said before, the quoted £49M-£74M shortfall in tax income to the UK government could build 3 or 4 brand new state of the art secondary schools or hospitals.

I would rather the money be recovered and put to that end than simply let them write it off and reform, debt free, to rise from the ashes and continue as if nothing happened, save that they have “(2012)” in their legal company name.

As for “[scaring] the living daylights out of other tax dodgers”… it will actually demonstrate to cowboy builders and rogue traders up and down the land that they can build up as much debt as they can obtain, then simply liquidate their business and reform under another name, while all the innocent, law-abiding third parties to whom they owe money will be left high and dry, having been cheated out of their hard-earned cash.

“No” to liquidation. “Yes” to stripping them of tainted trophies, docking points and making them pay back every penny they owe.

Just looking through a couple of huns sites to see what they are saying. There is a google ad at the top of one site stating, and I quote:

“British Expat Switzerland. Avoid British Tax. Get your pension out of the UK now. Free advice.”

    Still scrolling thru m’self but:

Doesn’t Google try to tailor ads according to the searches you personally conduct rather than they being generic to the particular site you are “looking through”?

Not interested in Swiss bank accounts are you……:-)

  9. Is the vote for/against Newco staying within the Prmier League a secret vote or open, does anybody know?. I have a feeling, only a feeling mind you, that a few other teams may vote against hunman. Hope I’m correct.

He is renowned for his whitewashing skills, his are not surgical moves with a brush, more of a splash another bucket over it.

Thankfully his remit is very limited

  11. The Hugh Adams’ revelations show that, prior to EBT’s, the huns had been engaged in blatant tax evasion for many years.

Surely this will have to be considered by the Tribunal, or be part of an appeal by HMRC should thems prevail.

Another big problem is that those who in some countries you would hope would expose the problems ie the media, are in the main part of the problem themselves. If we had a greater divide between the media and the footballers then perhaps journalists would be more willing to tell the truth and expose wrong doing.

Keevins, Taylor, Nevin and Young are great examples of media representatives with very little independent thinking. I’m not convinced they are necessarily pro or anti Celtic but they are reporting for their own self interest whether that is personal fame or the selling of papers/radio ads.

As Tom English is reported to have said last night, I don’t know since I refused to watch, our game needs an independent enquiry that does not immediately go to the current ‘names’ as they are the problem not the solution. Now would be a great time for wholesale changes to sweep away the built in conservatism of our current football institutions

If a Newco is parachuted into the SPL then Scottish football is a sporting competition where cheating , deception, swindling and defrauding is officially sanctioned. No thanks !

    No to Newco !

  14. hen1rik:

Surely there are contextual differences in these instances? I can’t see how the business context can be paralleled with a football one…but then what do \i know about the law?

All this legal subterfuge is the reason why I utterly despise the whole legal profession and the institution of “law”…an absolute joke. Honest man and lawyer don’t go in the same sentence! Soon there will be more lawyers than people…feed them to the poor!

    Lawyer joke:

Lawyer: Let me give you my honest opinion?

Client: No, I’m paying for professional advice.

A lawyer is an expert on justice as a prostitute is an expert on love.

A lawyer just like politicians can be summed up in the old Groucho Marx joke:

Those are my principles. If you don’t like them I have others.

I leave you with the fine legal jargon of Groucho’s fictional lawyer:

Groucho: All right- huh- the first part of the party of the first part shall be known in this contract as the first part of the party of the first part. Look why should we quarrel about a thing like this? We’ll take it out, eh? ( with that Groucho rips a part off the top of the contract).

Chico: Yeah. (he rips the top off his contract) It was too long anyway. What we got left?

Groucho: Well I’ve got about a foot and a half. Now it says that the second part of the party shall be known in this contract as the party of the second part.

Chico: Well I don’t know about that.

    Groucho: Now whats the matter?

Chico: I don’t like the second party either.

Groucho:Well you have come to the first party. We didn’t home till around four in the morning. I was blind for three days.

Chico: Hey, look! Why can’t the first part of the second party be the second part of the first party? Then you got something.

Groucho: Well, rather than go through that all again, what do you say?

    Chico: Fine.

    (They both rip together).

The tearing of the contracts continues until there is only a shred left, which they don’t bother to sign, preferring instead a verbal agreement, such is their distrust and contempt for the legal language. Conventional legal discourse is literally torn apart and is replaced by a negotiated discourse of their own making.

    Imagine a world without lawyers…

Fired this to Kets and Gray.

When Mr Donacster said a vote to allow Rangers 2012 would be foe the SPL Board that is not what the rules provide for.

In a matter as serious as this which risks contavening the sporting integrity values of UEFA the other SPL clubs should have a say (and the rules allow this) that will direct the SPL Board.

Dunfernline are unlikely to vote to be relegated and Celtic are certainly not going to vote on integrity grounds (ask them) so it is anything but a foregone conclusion Rangers 2012 will be allowed straight back into the SPL.

It was wrong of you to give that impression. I can appreciate that the business end of soccer often overules the sporting end but without sporting integrity there is no business.

I suggest you get a researcher to check the rules and ask the SPL to clarify. This is a story.
