Season will be decided on the field, not in the courts

I received a text early evening on 18th August last year: “Gongalves starts”.  Former Hearts player, Jose Gongalves, was one of a handful of players FC Sion signed illegally in the summer 2011 transfer window and he had been named to start against Celtic in the Europa League qualifier, first leg.

As a contest, the tie was over.  There followed two matches with considerable effort and drama from both teams but the eventual outcome was, literally, never in doubt, the courts would have their way.  Sion would be expelled from the competition and Celtic would progress to the group stage.

Today Celtic’s only remaining competitor from the chasing pack for the SPL title is up in court to face the HM Revenue and Customs.  The courts will have their way again but although you may feel the outcome of Rangers tax case is inevitable (I do), the impact on this season’s league championship is less assured.  Should they lose, Rangers have the option to appeal, postponing any negative impact on the company until next season at the earliest.

If Rangers have, or can generate, enough cash to keep the lights on this season the league will be nip and tuck until the end of the season. The tax case will attract most attention but if you are looking for indications of how the season is likely to go, keep an eye open for cash related incidents.

Well done to Rangers’ broadcast partner, STV, for their story this morning on SPL discipline.  They report the Ibrox club have the worst disciplinary record in the league, having accumulated a total of 41 bookings, contrasting starkly with the cool class at Celtic Park who are best behaved in the league with only 20 bookings.

With Beram Kayal out for the season Ki Sung-Yeung is the Celtic player closest to a suspension, a further three yellow cards would put the Korean over the threshold.  Rangers have Lafferty one booking, Edu and Bocanegra two, with Goian, Broadfoot, Bartley and Whittaker all three away from a suspension.  Lee McCulloch has only been booked twice this season but shows enormous potential.

    The decision Hugh is based on integrity for standing up for the honest Clubs and their Supporters. And IF and it is a very big IF our Board colluded to keep them in the league when they have blatantly cheated, we as Supporters are entitled to let our Board know we will make a stance for the honest people, which includes all you on the internet…

     

     

    That my friends on the internet is a point of principle not based on hatred…

     

     

    Wish that call had come on sooner I would have phoned and spelled it out for Hugh. Maybe he will read the blog…or maybe not.

    Yeah, that was my take on it.

     

     

    They mentioned the term “Hive Down” which I have never heard before and I’m not that sure I fully grasped the concept, but I saw that the main difference was in who the Reciever would be acting on behalf of.

    The strange thing about that incident, is, that it was one of three similar cases.

     

     

    Beck ,was one. Aird of St. Johnstone, was another.

     

     

    The third, was a winger from P. Thistle, whose name I can never remember.

     

     

    All three guys were about the same height as Jimmy and all three involved Jinky retaliating from a tackle from behind. Tackles that he never saw coming.

     

     

    Prior to that time, wingers never back tracked, but such was JJ’s ability to destroy left backs, reinforcements were needed.

     

     

    Jimmy took all sorts of abuse from the Greigs and Lunns of the game, because he could see them coming and was prepared.

     

     

    It was the tackle from the back that brought on the red mist.

    Whyte holds the “floating charge.” He has first dibs and can appoint a reciever. That assures that he gets paid. Here’s the fun part mate.

     

     

    Unless Whyte is what he says he is, a guy who wants to take Rangers forward, the second he gets his money, or the bulk of the assets, he will head for the hills.

     

     

    Whatever is left is what the administrator gets to sell off or restructure. It’s the administrator who gets to decide on the viability of a pre-pack, and to do so they need HMRC to approve it, as they are the largest creditor overall.

     

     

    Now, if Whyte really IS interested in making a horse-race of Rangers, if he really does think it’s a viable business, he can try to do a deal which sees him owning the whole club. But there are legal problems with that, and HMRC would probably challenge it. Would they win? Who knows, but as Whyte’s dirty laundry would all have to be aired I wouldn’t fancy his chances.

     

     

    The most likely scenario is that he grabs what he can and then leaves, stating the complete impossibility of making a rescue personally. That would leave what remains of the club in the hands of … vultures mate, essentially. A corpse to be picked over.

     

     

    Whyte has done them up like a kipper. They don’t realise it yet but he has.

    Not really, I think it entails accruing a greater proportion of indebitness so that the HMRC can’t block a pre-pack/ receivership route, where the only winner is CW, and the rest can sing for their dosh.

     

     

    But I’m not sure on that.

    The post on RTC meentioned hiving down the assets to another entity owned by CW if I read it correctly, this was the bit that confused me.

    I believe they do, RTC has hinted that they exist, Dawell reiterated tonight that they exist, he said previously that he has seen some of them, and I understand the basis of the big tax case is dependent on them existing.

    If my understanding of the “hive down” is right, it would need to be done now, not a part of a CVA or a deal with a reciever. And it would look, to all the world, like an asset strip in order to defeat a debtor and the liquidation process, and could end with Whytey in cuffs.

     

     

    A hive down, essentially, is where you move assets from one company to the ownership of another, in which you have an interest. The tax authorities are no mugs, and have seen it all before. They would have his testicles in a jar before allowing it.
