Gang of 10 Arab Spring rebuked by Duff & Phelps

Comments from Duff and Phelps yesterday that they were not in favour of changing the SPL voting system were intriguing.  Kilmarnock chairman, Michael Johnston, was pretty blatant about his agenda when speaking to the BBC on Saturday, suggesting the actions of the Gang of 10 was a “pro-democracy movement” similar to the Arab Spring, saying:

“It might make it easier for the [Rangers] administrators to get whatever they are going to try to achieve whether it is a CVA or new company to be informed and re-joining the SPL and SFA.

“The support of the 10 clubs might be needed at some point.”

Too right the support of the other 10 clubs might be needed at some point if a new company is to join (not re-join, for goodness sake!) the SPL and SFA.

Back in October last year we predicted Rangers would be liquidated, a Newco would be formed and would be voted straight into the SPL, with only Celtic arguing the need to maintain sporting integrity.  Everything we have heard since has reinforced this view.

The debate among the Gang of 10 has matured so far they see no issue in openly offering to support a Newco’s entry into the league in return for money (which we predicted earlier this month), mostly generated from Celtic fans, as it happens.

We await Johnston responding by sticking to his high-minded principles and telling any Newco they will not enjoy Kilmarnock’s support.

Duff and Phelps still have an enormous amount to achieve before they will even be in a position to apply for entry to the SPL on behalf of a Newco but if they do, they will surely offer the Gang of 10 a take-it-or-leave-it proposition. The Gang of 10 will take it. This debate is not about democracy, it’s about directors at clubs like Kilmarnock, who I believe now have debts of over £10m, finding a way to deal with their years of unchecked overspend.

The debate around St Mirren director, Ken McGeoch, would surely outrage sensibilities in any country in the world so I’m pleased his fellow directors have called for his resignation.  In November last year McGeoch invited Rangers company secretary Gary Withey to a meeting at the St Mirren boardroom where he revealed player contract details.

St Mirren are up for sale and could be purchased for what previously amounted loose change at Ibrox; McGeoch met Withey to discuss him purchasing the club from his fellow directors and shareholders.

For a Rangers director, influence like that should be impossible to acquire.

    With regards to the group of ten they should realise that Celtic is a special case but due to the backward nature of your average Scottish football fan, it will be deliberately ignored. They tolerated for decades Rangers sectarian signing policies and for that they are now paying the price. It was that tolerance that allowed Celtic to become the big monster that it is and it was the unchecked and tolerated practice that allowed this situation to develop. The fact that it is obviously still there has also very much played its part. Imagine you are a young catholic parent and you live in Central Scotland and you want to take your sons and daughters to a game that is non Old Firm. You cant go to Airdrie nor Motherwell not Hearts as your basically not welcome … certainly not made to feel welcome from the banter on the terraces. So what do you do ? you take them eventually to go and see Celtic

     

     

    If every club in Scotland goes to the wall they deserve it. It would be a fitting and just punishment not only for years of tolerating discrimination but also for completely failing to understand the Old Firm relationship and what it entails. Which in the last 20 years has only been used as a concept for Rangers FC to hide behind. Now whether your average non Old Firm supporter was too thick to realise it or thought it opportune for Rangers FC to have this conceptual safety net is a moot point as their tolerance towards it has left them exactly in the state that they find themselves.

     

     

    Even after Rangers FC continual unabashed cheating has been publicised the wee clubs stay mute. Huns without the bus fare surely ….why else have they lost their collective voices over decades. Why are they so quiet just now ? Because they hate Celtic … Catholics and Irish

     

     

    If they do go bust then they can soon phoenix and take their rightful place in the SPL as the legislation will soon be there to accommodate that fact ….. so what is it exactly they are worried about ?

    I believe sharing TV revenue is key to something.

     

     

    Assuming next season’s TV deal is operational; there will be £16m available to clubs each year through this.

     

     

    At present this is pooled with other sponsorship money and divided out to clubs on a pro-rata basis depending on where they finish in the league.

     

     

    The split is as follows:

     

     

    First place – 17%;

     

    2– 15%;

     

    3 – 9.5%

     

    4 – 8.5%

     

    5 – 8.0%

     

    6 – 7.5%

     

    7 – 7.0%

     

    8 – 6.5%

     

    9 – 6.0%

     

    10 – 5.5%

     

    11 – 5.0%

     

    12 – 4.5%

     

     

    From a £16m pot, champions will receive £2.72m, 2nd place will get £2.4m, 3rd £1.52m 4th – £1.36m, 5th – £1.28m down to £720k for 12th place team.

     

     

    If this is split equally then each team would get £1.33m so apart from the top 4 sides, each other team will receive additional money from TV. First and second will receive considerably less but one of those teams (i.e. Celtic) is much better placed to absorb a deficit in funding. Can teams who finish 3rd or 4th accept a reduction of up to £200k a year?

     

     

    Even if this is what they want, is it fair and equitable to all teams?

     

     

    To attempt to answer this, I will consider the number of games shown on live TV and those teams who are shown on TV. The agreement with Sky and ESPN allow both to show 30 games each per season so a total of 60 games a season.

     

     

    Should funding therefore be distributed across the games, e.g. each game is worth 1/60th of £16m so £267k per game. A fair split would be 50/50 to each team or even perhaps 80/20 to home team.

     

     

    So far in 2011/12, 49 live games have been shown so the following shows possible scenarios for each team in the SPL.

     

     

    Implications for each team

     

     

    Aberdeen has been shown live 7 times, 5 at home, 2 away. Assuming a 50/50 split in TV money from games, they could expect to have earned £933k. An 80/20 split (home and away) would give them approx. £1.17m. The 12 way split would give them £1.33m and if they remain in 8th place they can expect £1.04m.

     

     

     

    Celtic have been shown live 18 times, 2 at home, 16 away. Assuming a 50/50 split in TV money from games, we could expect to have earned £2.4m. An 80/20 split (home and away) would give us approx. £1.28m. The 12 way split would give us £1.33m and if they remain in 1st place we can expect £2.72m.

     

     

     

    Dundee Utd have been shown live 4 times, all at home. Assuming a 50/50 split in TV money from games, they could expect to have earned £533k. An 80/20 split (home and away) would give them approx. £854k. The 12 way split would give them £1.33m and if they remain in 4th place they can expect £1.36m.

     

     

     

    Dunfermline have been shown live 5 times, all at home. Assuming a 50/50 split in TV money from games, they could expect to have earned £667k. An 80/20 split (home and away) would give them approx. £1.07m. The 12 way split would give them £1.33m and if they remain in last place they can expect £720k.

     

     

     

    Hearts have been shown live 8 times, 5 at home, 3 away. Assuming a 50/50 split in TV money from games, they could expect to have earned £1.07m. An 80/20 split (home and away) would give them approx. £1.2m. The 12 way split would give them £1.33m and if they remain in 6th place they can expect £1.2m.

     

     

     

    Hibernian have been shown live 11 times, 5 at home, 6 away. Assuming a 50/50 split in TV money from games, they could expect to have earned £1.47m. An 80/20 split (home and away) would give them approx. £1.38m. The 12 way split would give them £1.33m and if they remain in 11th place they can expect £800k.

     

     

    Inverness CT have been shown live 5 times, 1 at home, 4 away. Assuming a 50/50 split in TV money from games, they could expect to have earned £667k. An 80/20 split (home and away) would give them approx. £907k. The 12 way split would give them £1.33m and if they remain in 10th place they can expect £880k.

     

     

    Kilmarnock have been shown live 5 times, 1 at home, 4 away. Assuming a 50/50 split in TV money from games, they could expect to have earned £667k. An 80/20 split (home and away) would give them approx. £907k. The 12 way split would give them £1.33m and if they remain in 7th place they can expect £1.12m.

     

     

    Motherwell have been shown live 5 times, 1 at home, 4 away. Assuming a 50/50 split in TV money from games, they could expect to have earned £667k. An 80/20 split (home and away) would give them approx. £907k. The 12 way split would give them £1.33m and if they remain in 3rd place they can expect £1.52m.

     

     

    Rangers have been shown live 19 times, 3 at home, 16 away. Assuming a 50/50 split in TV money from games, they could expect to have earned £2.5m. An 80/20 split (home and away) would give them approx. £1.38m. The 12 way split would give them £1.33m and if they remain in 2nd place they can expect £2.4m.

     

     

    St Johnstone have been shown live 6 times, 4 at home, 2 away. Assuming a 50/50 split in TV money from games, they could expect to have earned £800k. An 80/20 split (home and away) would give them approx. £1.5m. The 12 way split would give them £1.33m and if they remain in 2nd place they can expect £1.28m.

     

     

    St Mirren have been shown live 5 times, 4 at home, 1 away. Assuming a 50/50 split in TV money from games, they could expect to have earned £667k. An 80/20 split (home and away) would give them approx. £907k. The 12 way split would give them £1.33m and if they remain in 9th place they can expect £960k.

     

     

     

    So far 34 of the 49 live games have featured Celtic or Rangers. This brief analysis took half an hour. I’d hope the SPL 10 have done something similar to try and at least see what they want from the game.

     

     

    If TV money is to be split, we should seek to ensure a fairer spread of games so that we are not always heading to Aberdeen or Inverness for early morning kick-offs. With 60 games, no team should feature more than 10 times.

    Agree completely. These are the same bowling club secretaries (Aberdeen excepted) that signed the Setanta deal against our advice. Look how that ended up.

     

    We should tell them to go ahead. We’ll set up our own TV deal ala Barca and Real and invite Dundee, Ross County and the rest of the 1st division if they fancy packed stadiums twice a year and a fee for televised games they participate in. Doubt the standard would be much worse.

     

    Maybe Yorkston can close another couple of stands to help with running costs in his new league with no TV deal and no crowds.

    Some of the comments after the game were dispicable, i hope some of the posters look back with embarrasement and disgust to some of the things they posted.

     

     

    Who need bombs and bullets when some of your own fans are so willing to stick the knife in, if that had been any ordinary game played on a level playing field we could probably take a more critical look at the manager and teams performance, but there is no way that was any ordinary game played on a level playing field.

     

     

    The MIB’s performance was reminicent of the “sinister minister” at his worse, i said right on kick off there is no way we are going to be allowed to win this game, by 5 mins in i was doubly sure.

     

     

    Murray and Brines performed the role impecabbly, Murray influencing the game just enough to favour the home side in every 50/50, Brines on the touchline waiting like a coiled spring to pounce as soon as Neil looked like doing anything other than gee up the team, the sendings off were just typical, the first was never a red card, it wasnt even a foul, Wanyama was stupid to go in studs up, but if he had to go , surely so did Whittaker?

     

     

    I totally agree with BHRT post yesterday about taking a step back directly after the event, the LL no Neil is always going to tell it how it is and the questions are loaded right from the very beginning, deep breath and count to 10 at times, measured answers, give them nothing, questions to answer at the SFA bring it on.

     

     

    The next week likely sees the FTT deliver the damning blow to RFCIA and C4 Alex Thomson hopefully will deliver the smoking gun into the public domain, and if half of what OG Rafferty was alluding to yesterday is correct then watch them squirm, it really is armageddon for them.

     

     

    I will finish my little rant with this, please please before you post any criticism of Neil and the team directly after a poor result, step back and think about we are up against, think about what Neil has to suffer on a daily basis, think about how well this young team has performed, and think of what you are, a Celtic supporter!

    Membership, Promotion and Relegation

     

    A2.1 The League shall consist of 12 leading association football clubs in Scotland. The association football clubs eligible to participate in the League in any Season shall, subject to the Articles of Association and Rules, be those Clubs which participated in the League in the immediately preceding Season, except that, subject to Rules A2.2, A2.3 and A2.4, the Club finishing in last place in the League in the immediately preceding Season shall not be eligible to participate in the League and shall be relegated to the SFL and the Candidate Club shall be promoted from the SFL and admitted entry to the League.

     

    A2.2 Subject to Rule A2.7, the Candidate Club for any Season, if it is to be promoted from the SFL and admitted entry to the League, and the Clubs participating in the League, must satisfy the Membership Criteria.

     

    A2.3 In the event that the Candidate Club for any Season, if promoted from the SFL and admitted entry to the League, would, in the opinion of the Board in its absolute discretion, fail to fully comply with the Membership Criteria and no waiver, relaxation or period of grace is or has been granted to the Candidate Club in terms of Rule A2.7, then the Candidate Club shall not be promoted from the SFL and admitted entry to the League and the Club which would otherwise have been relegated from the League to the SFL in accordance with Rule A2.1, shall retain its place in the League.

     

    A2.4 In the event that any Club, in the opinion of the Board in its absolute discretion, shall or if it were to participate in the League in any Season would, fail to fully comply with the Membership Criteria and no waiver, relaxation or period of grace is or has been granted to that Club in terms of Rule A2.7, such Club shall be subject to such sanction or sanctions and such action may be taken as the Company in General Meeting shall, in its absolute discretion, determine.

     

    A2.5 The Membership Criteria are:-.

     

    A2.5.1 A Club participating in the League must be a member of the SFA.

     

    A2.5.2 A Club participating in the League must have registered or be deemed to have registered its ground in accordance with Rule H6.1.

     

    A2.5.3 A Club participating in the League must:-

    A2.5.3.1 itself, or through a subsidiary or holding company of such Club, own its Registered Ground; or

     

    A2.5.3.2 have such other rights of occupation or tenure in its Registered Ground as may be approved by the Board.

     

    A2.5.4 Any ground which a Club or the Candidate Club registers or is deemed to have registered as its Registered Ground, must, by not later than 31st March preceding any Season and for the whole of that Season:-

     

    A2.5.4.1 subject to Rule H6.8, have satisfied and satisfy the Stadia Handbook requirements for a Club taking part in the League;

     

    A2.5.4.2 have provided and provide individually numbered seats in areas under cover of a roof for not less than 6,000 spectators; and,

     

    A2.5.4.3 have had and have adequate winter pitch protection, as provided in Rule H6.7,

     

    A2.5.5 Clubs shall take all steps determined necessary by the Board to implement the development of youth football in Scotland in line with the requirements, philosophy and recommendations of the Company.

     

    A2.5.6 Where a Club or the Candidate Club registers or is deemed to have registered as its Registered Ground for any Season a ground at which it is intended to play League Matches on a pitch utilising a synthetic or artificial playing surface then such Club or Candidate Club must have made an application to the Board in accordance with Rule B23.1.3 by not later than 31st March and must have been granted an approval by the Board in terms of that Rule by not later than 1st June, both preceding such Season.

     

    A2.5.7 Clubs and the Candidate Club shall from and including 1 January 2010 comply with the Financial Disclosure Requirements.

     

    A2.6 Any application for approval for the purposes of Rule A2.5.3.2 or application for a waiver, relaxation or period of grace for the purposes of Rule A2.7, must be made in writing to the Secretary not later than 31st March preceding any Season or, as the case may be, first Season, in relation to which the ground for which such approval, waiver, relaxation or, as the case may be, period of grace is sought, is to be registered or deemed to be registered in accordance with Rule H6.1, as the Registered Ground of the Club or Candidate Club concerned.

    A2.7 The Board may in its absolute discretion waive, relax or grant a period of grace in respect of any Club’s or Candidate Club’s requirement to comply with any part of the Membership Criteria and/or Rules A2.6 and H6.1.

     

    A2.8 The Board may undertake or instruct to be undertaken such inspection and may require such verification to be exhibited by a Club or Candidate Club as the Board considers appropriate to satisfy the Board that there is, has been and will be compliance by each Club and a Candidate Club with the Membership Criteria.

     

    A2.9 The implementation of the Membership Criteria shall be capable of appeal in accordance with the provisions of Section G of the Rules.

    Relationship between Clubs and the League

     

    A3.1 In all matters and transactions relating to the League and Company each Club shall behave towards each other Club and the Company with the utmost good faith.

     

    A3.2 No Club, either by itself or its Club Officials, shall by any means whatsoever unfairly criticise, disparage, belittle or discredit any other Club, the Company or the League or in either case any such other Cub or the Company’s directors, officers, employees or agents (which shall, for the avoidance of doubt, exclude supporters).

     

    A3.3 A Club shall not either during its membership of the League or at any time after its membership has terminated disclose or divulge either directly or indirectly to any person, firm or company whatsoever or otherwise make use of any Confidential Information as to the business or finances of the League or any of its dealings, transactions or affairs or as to any other matters which may come to its knowledge by reason of its membership without the Board’s prior written consent save where required by law to statutory and regulatory authorities (including by the SFA in accordance with the SFA Articles) and to such employees of a Club to whom such disclosure is strictly necessary for the purpose of their duties and only then to the extent so necessary.

     

    Membership of the Company

     

    A4 The owner and operator of a Club participating in the League shall become a member of the Company by acquiring one Ordinary Share therein at par for cash, such Ordinary Share to be acquired, through the Secretary, in accordance with the provisions of the Articles of Association. The owner and operator of a Club ceasing to be entitled to play in the League shall cease to be a member of the Company and shall relinquish its Ordinary Share at the end of the relevant Season in accordance with the Articles of Association.

    Alterations to Rules

     

    A5 Any alteration, deletion or addition shall be made in or to these Rules or the Articles of Association only in accordance with the Articles of Association and shall in each case be subject to the approval of the SFA in accordance with the SFA Articles.
