Smith, the SFA, Everton and EBTs

Walter Smith was not named by BBC’s Mark Daly as a recipient of an Employee Benefit Trust in the recent documentary, however, before this matter is put to bed I expect more names to emerge.  As soon as Smith makes himself available to a proper journalist he will be asked:

Did he receive EBT loan payments from Rangers?

If so:

Did he repay those loans or hold his cash while the club ran out of money and died?

Was he in receipt of a letter from Rangers confirming he was not required to repay?

Did his then employers, the Scottish FA, know he was perhaps receiving money from a member club while employed by them?

Are SFA employees contractually inhibited from taking payments from a member club or required to inform the SFA board of any payments received by a member club?

Did his earlier employers, Everton FC, know if he was receiving money from another club while employed by them?

Was Smith contractually inhibited from taking payments from another club or required to inform Everton of any payments received from another club?

As manager of Rangers, was he involved in negotiations with players who had EBTs or was he another one who concentrated on administrative and legislative duties?

Was he one of the men SFA president, Campbell Ogilvie, suggested failed to reveal side contracts to the Rangers board?

Rangers’ liquidators, BDO, will forensically pour over most of these questions, so Smith’s answers will be verifiable.

No one who played an active part in Rangers EBT scandal will come out of this clean.  The ramifications multiply if Rangers were discretely paying any senior employee of another club.

I simply cannot imagine the justification for a member club discretely paying a senior employee of the SFA.  Frankly, it would be beyond every Celtic fan’s most paranoid fantasies.  I am sure Mr Smith will quickly and easily be able to reassure everyone.

An interesting twist in Smith’s bid for the assets of Rangers is that if he is to inherit Green’s application for a SFA licence and take a controlling interest in the club, Green is obliged to do due diligence on Smith to determine if he is a Fit and Proper person.  Perhaps Mr Green can use the above as his due diligence questionnaire.

One final thought.  In the unlikely event that it is established that one senior SFA employee was receiving discrete payments from Rangers, we need an immediate and independent inquiry to establish how many others received such payments and what they were for.

As a matter of some urgency I would recommend Stewart Regan brings himself up to speed on this one. I am sure his president is banging the table as you read this insisting the chief executive gets to the bottom of this. It’s not as though he is heavily conflicted and the SFA is in dire need of an independent president to steady the ship.

    It can be different. As things stand, the name of the company who own the assets etc is Sevco 5088 Ltd and if this company wishes to change its name, it will have to file a request with companies house and I don’t think it will be allowed to call itself “The Rangers Football Club Ltd” until insovency proceedings have ended and “The Ranagers Football Club Plc” is officially dissolved.

     

     

    Officially for contracts and such like they could call themselves Sevco 5088 Ltd trading as The Rangers Football Club and I think this would be permissable under the regulations.

     

     

    In this case for all intents and purposes the company will be known as The Rangers Football Club.

    Quite obviosly, the MSM will never challenge the fact that Rangers no longer exist. Equally obvious is that the fact of their demise is being ignored in the sense that the New Company is being seen 100% as Rangers. That New Company will be afforded the same preferential treatment from the Establishment. What, exactly, have we won and what have They lost?

  9. The dual contract investigation needs to determine if games were played involving ineligible players. If there were then results should be re-written accordingly.

     

     

    It’s a history exercise not a sanction exercise.

    Now I maybe niave and you could put me right but what would have been wrong with a more conventional approach, surely this would have realised a better dividend for all stakeholders….

     

     

    Shareholders aren’t a consideration as they only get paid anything if the company is liquidated and all creditors receive 100% of what is owed. What is then left is divided among all shareholders.

     

     

    In terms of creditors, all those things you suggested would have given them a better chance of getting something back but the admins main concern was saving the business. Cutting costs to the bone may not have been enough to even keep them going and being able to fulfill fixtures.

     

     

    There were things that could have been done but it was clear from the outset that creditors were going to be shafted one way or another.

  15. @Folly Folly – There have been so many causes to smile this year, one of the best Celtic years for me. Up there with ’88, popping Champagne in North Stand in ’98 and watching the Euro run of Seville.

    From now on we should never ever refer to them as rangers. Simply refer to them as NEWCO. Whether you are talking to friends, on a phone in or banners at Celtic park refer to them ONLY as “NEWCO” this will get it right up them and allow us to highlight that rangers are no more! Instead of “oh the rangers are shite” use “oh the NEWCO are shite” etc. spread the word hail hail

    The new rule 11 does not help much. How can anyone know if someone will own and operate a club? There are no criteria specified to assist with this decision. The rules were a mess before and they still are.

  28. If they have no link to old Rangers´’ financial problems then, likewise, they have no links to its players, staff, history, etc.

     

    Funny how everyone connected to them are voicing the first part but ignoring the second. The SFA and the SPL included.

    The SFA’s lack of a clear and committed stance on this is a sure sign we are going to get screwed over. They have had months to prepare for this eventuality, to know what they were going to do and say so how come it is just . . . silence? Says everything.
