Ticketus secure their £40m of tickets

None of you will be surprised at today’s opinion from the Court of Session in Edinburgh that Rangers’ deal with Ticketus cannot be set aside, despite some absolutely pitiful reporting to the contrary.  It’s fine to get things wrong every now and then, we all get Duff information on occasion, but please….

It’s worth recording, Ticketus may only have paid £20m + vat but the tickets they own are worth in the region of £40m. High risk investments require a high return.

Rangers’ administrators argued that the deal inhibited their ability to rescue the company but the heroic Blue Knights submitted a bid accommodating Ticketus, undermining the administrators’ argument. If only the Blue Knights were in a position to strike a deal with Craig Whyte they could be regarded as helping the situation instead of being hapless fools.

Next up is HMRC, who have not capitulated and agreed to accept a few pennies in the pound.  They have not agreed to accept anything less than all monies owed.  Soon after that we will hear that no court has been able to set aside Craig Whyte’s security over Ibrox.  The most underappreciated man no longer in Scotland remains the only person with a reasonable chance of phoenix-ing Rangers.

The first 26,000 (approx.) tickets sold to each Rangers game for the next three years are owned by Ticketus.  In the event a phoenix occurs, Rangers will have to revert back to budgets from their glory days of the 1950s – we will soon be told this is a great omen.

    Review

     

     

    The first official Celtic game, played at the old Celtic Park.

     

     

    Strictly, Celtic’s first ever game. The opponents were really a Rangers XI composed from their reserve side (who called themselves “The Swifts”), likely as they didn’t want to lose to a new outfit (just in case). The game was advertised as being against “a side of Rangers”.

     

     

    Celtic wore white shirts with a green collar and a red and green Celtic cross on the breast (see right). These were given to the club by Penman Brothers from Bridgeton Cross.

     

     

    Neil McCallum had the honour of scoring the first Celtic goal, a feat of which he and all others attending on that day likely will never fully have known the importance of it for the whole of Scottish footballing history and to the many fans to come. One goal was chopped off for being offside which became the standard for Celtic in years to come in games against Rangers!

     

     

    Due to that the team was formed within Irish circles in Scotland, the players were all picked from respective clubs with Irish social links, and so naturally the team was thus composed of players who were Catholic. This was due to circumstances alone and there is no record of any policies to say otherwise. Non-Catholics played for the side very soon enough, and no policy was ever put in place to stop any being allowed to play for the club at any point in our history, a standard by which has been a hallmark of Celtic FC where “a man is judged by his football alone!”

     

     

    An attendance of 2000 watched the game.

     

     

    Response to the game was positive:

     

     

     

    “It would appear as if the newly-formed Glasgow club, the Celtic F.C., has a bright future before it. At any rate, if the committee can place the same eleven in the field as opposed the Rangers last Monday evening, or an equally strong one, the Celtic will not lack for patronage and support. A good team is essential to success, and this fact the committee have not lost sight of. It will be interesting -to many of our readers to know the composition of the team which represented the new organisation in its first club match. Here it is :—Goal, Dolon (Drumpellier) ; backs, Pearson (Carfin Shamrock) and McLachlan (Whitefield); half-backs, Maley (3rd Lanark), Kelly (Renton), and Murray (Cambuslang Hibs.); forwards, McCallum (Renton), Maley (3rd Lanark), Madden (Dumbarton), Dunbar (Hibs.), and Gorevin (Whitefield)—a pretty good eleven. The Rangers were without D. Gow, J. R. Gow, Hotson, Peacock, Allan, and Aird ; but had Suter (Partick Thistle) doing duty—the remainder being drawn from the Swifts. The match was a capital one, fast and friendly—the home organisation playing with a combination which could scarcely have been expected for an opening display. The Celtic retired victors by 5 goals to 2—a result which must be indeed gratifying to their supporters. After the match, over 70 gentlemen sat down to supper in the Hall, East Rose Street, where a pleasant evening was spent. Dr. Conway occupied the chair, and on the platform were also Messrs. M’Fadden (Hibs.), McCulloch (Our Boys), Grant (Rangers), and the Rev. Brother Walfrid. The latter gentleman, who took a deep interest in the origin of the club, has every reason to flatter himself as to the success of the Celtic. Long may it flourish in our midst.”

    The Rangers kicked off against the wind and at once made an incursion into Celtic territory. With some difficulty Dolan and the backs cleared their charge and play was transferred to the other end. A mistake by Meikle gave the Celts a corner kick. Dunbar placed the ball in front of goal and McCallum was enabled to head the first point of the game.

     

     

    The Rangers, after a pass by Suter, equalised after ten minutes play. Nicol was saving in grand style and , but for his clever goalkeeping, the Celts must have increased their score on several occasions.

     

     

    A foul against the light blues further enhanced the prospects of the home team. The ball was kept in dangerous proximity to Nichol’s charge and to avert what proved to be only a temporary and insufficient relief, the Rangers were forced to concede a corner kick. Like the former, and placed by the same player, Kelly, who was playing a judicious game, headed the second goal a few minutes before half time.

     

     

    The Rangers opened the second half with great vigour. The home defence, however, was not to be overcome. By short passing and keeping the ball low, the Celts carried it to the other end where Tom Maley was enabled to score another goal.

     

     

    In retaliation the Ibrox forwards were soon in front of their adversaries’ upright and a second goal was registered by Suter. Ultimately, Maley put in a fourth goal for the ground team. Through the instrumentality of McCallum the same player shortly afterwards notched a fifth point. A sixth point was put through but was disallowed owing to an infringement of the offside rule. The whistle sounded with the ball hovering in front of Dolan.

  4. I see Neil Lennon has been asked to explain his comments regarding the penalty decision in the cup final last week .

     

    Is it only Neil Lennon who can be pulled up for his comments ? , I seem to remember ally mccoist and terry butcher having a lot more to say after games this season and nothing done about it .

     

    Also , the speed with which this has been done , we are now a few weeks after the tax avoiders v killie match at ibrokes and still nothing done about the sectarian singing. This was followed up by more sectarian singing at the away game v Dundee utd , still no action !

     

    And most definitely more of the same tomorrow .

     

    Perhaps the football authorities could explain to me why there appears to be such a different reaction to these events .

     

    Just to conclude my rant , watch out tomorrow for the different way the two sets of supporters will be policed . Blind eye or heavy hand , I will let you decide which support receives which treatment .

  5. Conflicting reports on Lord (Paddy) Hodge’s ruling yesterday. The consensus on RTC seems to be settling around a victory of sorts for both sides, but one which doesn’t help RFC to any great degree.

     

     

    Crucially if the Duffmen (Oh yeah!) want to rip up the contract, they must show that this would be in the interests of all creditors (including Ticketus). Ticketus’ response to that has been to promise litigation, immediately.

     

     

    So ripping up the contract becomes a massively risky path to take, one which could tie RFC up in litigation for months if not years.

     

     

    Meanwhile, no accounts have been produced, European football is almost definitely gone for next year, and there must be real questions whether RFC can get their license to even play in Scotland next season.

     

     

    This is before the BTC or various outstanding footballing compliance issues hit.

    There’s more than a hint here that Ticketus will litigate further if they don’t get what they want.

     

    ’34] Mr Clancy submitted that there were strong grounds for criticising this line of authority… He acknowledged however that I was bound by the authoritative decisions of the Inner House and therefore reserved his right to argue against those decisions in a higher court.’

     

     

    To me the important thing is that as things stand following yesterday’s judgement the Ticketus deal can be dumped if the huns are liquidated. Ticketus had argued that their rights under the contract would survive liquidation. Lord hodge said they wouldn’t. That makes liquidation more likely with lots of litigation to follow follow.

  19. Paul’s comment on pitiful reporting is spot on and it continues in The Herald this morning. Their front page has a story entitled “Court ruling raises stakes in Rangers takeover fight”.

     

     

    What follows is a remarkable spin on the court “decision”. The nub of the story is that the judge kind of nodded and winked at duff and duffer and said while he cant rule on ignoring the case it was kinda okay for the duffers to pretend in all wasnt happenning.

     

     

    This joke of a story is of course just that – a joke. In essence The Herald are encouraging the duffers to ignore the legal contract despite the court being unable to come up with that conclusion. The duffers say they can ignore the ruling because it might be in the best interest of creditors – hilariously then ignoring the fact that ticketus are then also creditors and in fact the main creditor.

     

     

    So the strangest administration in history continues and the media remain complicit. What is it about Rangers that brings out the very very worst of people?

    No surprise that CQN has not provided a link to this story.

     

    Paul67’s article was a case of wishful thinking and jumping in before fully investigating the judgement.

     

     

    Some other quotes –

     

     

    “Lord Hodge has made it clear the Ticketus arrangements do not mean Ticketus has property or real rights over seats at the stadium or, indeed, the proceeds from the sale of future season tickets.”

     

     

    Lord Hodge said courts “would be slow to disrupt” the administration process by considering any legal move to force the Ticketus deal to be honoured.

     

    He also rejected a move by Ticketus to place a trust over the proceeds of the sale of the tickets, to try to make the deal unassailable, ruling that it had “purely personal contractual rights”.

    If the administrators breach the deal, it is understood that the agency, while an unsecured creditor, would have to chase majority shareholder Craig Whyte for any losses.

     

    And, while Whyte believes he has preferred creditor status with first claim on assets such as Ibrox and Murray Park, the court-appointed administrators believe this is invalid because there is no evidence he put any of his money into the club.

     

    Court papers show the first confirmation that the administrators’ legal advisers believe the Ticketus deal with Whyte is illegal on the grounds that it was indirectly providing financial assistance for the acquisition of Rangers shares, contrary to the Companies Act 2006.
