A victory for ugly men everywhere

Manchester City manager Manuel Pellegrini has managed to register his image rights on the off-shore tax-efficient territory of Guernsey.  Income received there for use of his rights everywhere else will not attract the kind of tax mere mortals pay in their daily lives.

Pellegrini, 60, developed a genial personality to combat profound ugliness, an affliction which has affected him for decades, so news that his image has commercial value is a wonderful boon for the multi-millionaire.  Manchester City will also benefit as any monies they pay for use of their manager’s image will not attract tax or National Insurance contributions.

Uefa president, Michele Platini, who has never had to worry about ugliness, now has a different challenge.  Whether or not to abandon his well-meaning Financial Fair Play aspirations, or get ugly on those who try to usurp his best intentions.

    Has it ever been divulged who is actually the bona fide legal owner of the assets? This is the true mystery of the debacle.

    In terms of the agreement at the South Gauteng High Court, sitting at the Palm Ridge Magistrate’s Court, King pleaded guilty to 41 counts of contravening the Income Tax Act and agreed to pay a fine of R80,000 per count, or R3.28m.

    Mr. Cardigan coming out from under recently it would appear that somebody thinks big changes are about to occur. He perceives that kind of thing and is sniffing around the perimeter for crumbs from the main table. He seems to have issued a veiled piece of advice to the orcs that the protests are doing no harm and may actually be a good thing – strange that. Or maybe not.

    Can I just point out that the Scottish Legislature only has jurisdiction over events that occur in Scotland and so conducting yourself in any which way you want in England, France, Spain or Mongolia could not be, and is not, governed by the law of Scotland.

     

     

    Accordingly, singing or chanting or doing something which may be deemed to be unlawful in Scotland may well not be unlawful at all anywhere else.

     

     

    Now, it is more than a few years since I gave up treading the legal boards and in that regard I would refer one and all to the opinions of my learned friend PF Ayr as they are certain to be far more valid and …. ahem….. carry far more weight than my own rambling thoughts ( and yes I know I am going to get a smack for that crack when he next sees me! ) on matters legal.

     

     

    However, back in the day one of the things I loved about legal practice was that occasionally…… just occasionally…… you got the chance to tilt at windmills……. and on the odd occasion you got to bring “The Big Guy” down…….. with the Big Guy being the Government or any other large powerful institution.

     

     

    There are some very clear and simple laws in this country, one of which is that no one is allowed to kidnap or detain another person against their will. Similarly, you are not allowed to inflict pain or harm someone as that will constitute an assault.

     

     

    So far so good.

     

     

    An exception to the two laws stated above is when a policeman acts in the proper and lawful execution of his… or her…. duty.

     

     

    An officer of the Law, when on duty, is granted what is known as the legal privilege to act outside the laws which would otherwise apply to the rest of us provided that he, or she, is exercising these special powers in good faith and in the reasonable exercise of their duty.

     

     

    I cannot recall off hand all the cases and statutes that have developed this branch of the law over the years– and it is not necessary to do so— but I think it is safe to say that any piece of criminal legislation can only be effectively enforced by a police officer if that officer is acting within the scope of the powers given to him or her as a Police officer.

     

     

    The argument that we see tonight is not actually about who sang what, or whether the song is a republican one, a loyalist one, an offensive one or a sectarian one, nor is it about whether the people charged are fans of Celtic FC or any other football club.

     

     

    No– the important thing is to stop and consider whether the actions of the police in arresting and detaining any of these people in the manner that they did is within the law.

     

     

    Whether those charged with offences are guilty of anything is irrelevant, although it goes without saying that there seem to me to be some pretty big holes in the legislation as framed as the way the law is being interpreted seems to lead to a legal nonsense with alarming frequency.

     

     

    However, that is by the by.

     

     

    There are many offences, and many circumstances, under which a party is charged by the Police and subsequently released until such time as they are summoned to court.

     

     

    That is standard practice.

     

     

    There are also times, when a party who has been charged with an offence is detained pending a court appearance. This should only happen in certain strict circumstances such as when there is a real risk of the person fleeing the jurisdiction of the court, or when the person is a serial offender, or where there is a real risk that the person will re-offend if they are allowed to remain at large.

     

     

    Equally, a Police officer is entitled to investigate an unlawful event or what might be deemed a breach of the law, but of course he has to have a reasonable suspicion that an offence has been committed. Further, in investigating any potential offence, the police officer must exercise their extraordinary powers in good faith and with respect to the public at large— They must not exercise those powers unreasonably or in bad faith as if they do, they are liable in damages and such a situation will be enforced through the courts if you push it.

     

     

    I do not know the details of each case that the police actioned today, but the question to be asked is “were the actions of the Police reasonable in all the circumstances?” or were any of their actions in detaining people exercised in bad faith? Were they acting under a warrant from the fiscal, and if so what was said in support of that warrant in each case as the fiscal also has a duty not to act without proper cause.

     

     

    Note that none of this is dependent on whether the accused is guilty of any crime or not, as that is an irrelevance because the police must act properly at all times and in all circumstances.

     

     

    I have seen many instances where Government departments and others have been threatened with a claim for damages because they have abused a court process or a police power and they soon fall into line when they realise that if they overstep the mark then someone will sue their Elkie Brooks off and probably cost someone with scrambled egg on the hat to lose their job.

     

     

    Horses and Janefield Street spring to mind.

     

     

    Tilting at Windmills….. I recommend it.

    The quality of photography that can be obtained using mobiles (cell phones) is exceptionally high quality these days. In the circumstances you describe we should never hesitate in obtaining photographic evidence.

     

     

    Just as an aside:-

     

     

    Are defence lawyers still expensive ? maybe CQN should have a Defence Fund.

    When l was Very young about a Dozen Police beat my Dad to near death..Took him his brother and 2 guys who worked for him to a Railway station handcuffed the other 3 to railings and took my Dad round the Corner..

     

     

    As a Teenager l found the A4 black and white photos..over 200 Stitches to the head..it was impossible to see any skin Colour on his back.. Black and blue..my dad has never spoke to me about this..
