Final day to appeal Lord Glennie decision set to expire

Charles Green, like Whyte and Duff & Phelps before him, is asking for admittance to the SPL on the basis that Rangers FC is a distinct entity from its legal identity.  While this theory has been strongly advocated by SPL chief executive, Neil Doncaster, by necessity, if you claim the football benefits of being ‘Rangers’, specifically player registrations, you also inherit Rangers penalties.

Although Rangers clearly won their challenge to Lord Carloway’s 12-month ban on player registration at the Court of Session last month when Lord Glennie referred the matter back to the SFA Appellate Panel, as the full ramification of the decision became clear to Green, who then had an irrevocable contract to buy Rangers or its assets, he floated the idea that he might appeal.

The SFA, correctly, decided not to instruct the Appellate Panel until the 21 day period when an appeal can be raised, which elapses today, has passed, just in case Green tells Lord Glennie he’s got it all wrong.

All this has been terribly confusing, not to mention expensive, for Scottish football, but with yesterday’s news that Rangers have a prima facie case to answer for subverting Scottish football for over a decade, the obstacles before Green are clearly insurmountable.  There is reason to believe we can quickly reach some clarity.

The SFA must, without delay, convene the Appellate Panel to consider Lord Glennie’s instructions and apply an appropriate penalty on the various legal and ethereal bodies which claim to be ‘Rangers’.  If the Appellate Panel suspend or expel what is left of the football club from the SFA, as must surely be expected, all questions about fan pressure, morals and votes become moot.

In this case, history will record the folly of Green’s appeal to civil law as the act which finally killed off any chance of ‘Rangers’ surviving, conveniently letting the SPL off the hook, while Green would be obliged to dispose of the stadium for a modest return to those capable of forming a genuinely new football club at some point in the future.

After reading those FF apologies I must admit to the shedding of a tear and to feeling a little guilty for being part of the biggest conspiracy in World football since the games introduction in the late 19th century. To have had a small (minuscule even) hand in the events leading up to the near inhalation of their glorious institution and the possible destruction of any rebirth of the greatest club to have ever played on British shores or further afield I must take this opportunity to apologise for my part and my sins.

    Police were worried at the numbers who were keen to join the march to tell Charles Green he is not wanted.

     

     

    And they feared they would not be able to cope, as their intelligence reports were telling them that anything up to 50,000 supporters were set to muster in Bellahouston Park before marching on The Stadium.

    Sports writer.Walter Smith and Dave King have expressed grave concerns about the ability of Charles Green’s consortium to fund Rangers.

     

     

    Smith spoke out after revealing that his consortium has withdrawn its £6m bid for the club after failing to receive information about Green’s investors, their working capital, or the business plan. King expressed his own criticisms after a second meeting in 24 hours with the Englishman.

     

     

     

    Smith’s consortium, which is backed by Jim McColl, one of Scotland’s wealthiest individuals, and Douglas Park, the transport tycoon, formally withdrew their offer yesterday. The £6m bid was lodged with Zeus Capital, the investment fund that Green fronts, on Monday and despite repeated claims from Green, Malcolm Murray, Brian Stockbridge and Imran Ahmed, the board members, that Zeus have no intention to sell, they returned with a counter-offer.

     

     

    This was a ploy that Smith, McColl and Park refused to consider, since they have received no comfort about who has funded Zeus Capital’s takeover, how much short-term capital they have raised and how they plan to take the business forward. Green and others have repeatedly denied that Malcolm McDonald, the former Sheffield United chairman, and Rafat Rizvi, a British citizen once wanted by Interpol after being accused of stealing assets from Indonesia’s Bank Century two years ago, are among the investors, even though Herald Sport understands both men enthusiastically discussed their involvement in the run up to last Thursday’s purchase of the assets.

     

     

    “I would like to clarify the background to the offer of £6m for the assets of the club which I announced on Thursday 14th June,” read the statement released by Smith. “The offer was made to the administrators before the Charles Green consortium had concluded their transaction to acquire the assets at £5.5m from the administrators. We felt it necessary to have a fall-back position to secure the club’s future. We have since made the same offer of £6m to the Green consortium through Zeus Capital.

     

     

    “Our offer has been rejected and they have made a counter-offer inviting us to join their consortium. However, the current business plan is not in accord with our understanding of the present circumstances of the club and the way forward. We would prefer to leave them to proceed in their own way and we wish them good luck in their endeavours.

     

     

    “Members of our consortium had met with Charles Green and Zeus Capital prior to [last Thursday’s] CVA meeting and it had been agreed that we would be provided with significant information which would give us comfort as to the identity of the consortium members, their strategy and their funding capacity. This information had not been forthcoming by the date of our offer. We are therefore withdrawing completely from the process to enable Charles Green and his consortium to move forward.

     

     

    “We very much hope the verbal assurances they provided to us – and the public statements made – are adhered to and that the club will therefore be financed and managed with appropriate governance and can go forward in a sustainable manner.”

     

     

    Green had pledged to raise £30m by the end of July, but there are now serious concerns about the group’s ability to meet this month’s working capital commitments, with the wages to be paid on June 26. Herald Sport believes that Green’s Sevco consortium has lost one of its backers. Although he pledged to name all investors on the day of the asset sale, Green’s group has only named a small number, one of which – Ian Hart – immediately refuted the claim and declared himself a financial supporter of Park and McColl.

     

     

    In a statement released yesterday, Murray also claimed that Green’s consortium had spoken to the Rangers Fans Fighting Fund, and claimed they agreed with his call for the club to move forward. However, members of the RFFF were angry at being used for credibility, since they are not due to meet Green and Murray until today. It is thought Murray later agreed to reword the statement.

     

     

    Season ticket sales continue to be slow, with the majority of fans uncertain about the intentions of Green’s consortium, while sponsors are also pulling out. Many supporters fear that the club could sleepwalk into another Craig Whyte situation, since the previous owner could not fund the club, leading to administration last February. King, too, is worried about a similar outcome and said in an interview with the BBC that he believes Green’s plan is to profit from Rangers rather than rebuild the club.

     

     

    “Charles Green is the only game in town,” said King, who is not planning to invest in the new regime. “The club needs money and I really don’t know how he’s going to find it. I’ve looked at the business plan and he’s going to run the club to make a profit. I don’t think that’s possible. I believe for Rangers to be the Rangers we all want it to be, it requires investors to subsidise losses for a number of years.

     

     

    “The only way to make money is to aggressively cut costs, so Rangers will survive but it won’t be the Rangers in three years that it could be. It’s a lot of money from investors that are not yet in place. He owns the club but doesn’t have any money.”

     

     

    Herald Sport also understands that no Rangers players have received any contact from Green, even although the club is duty bound to set a date for the transfer of their contracts, and so allow them the opportunity to refuse. There has also been no contact with the Professional Footballers’ Association Scotland.

     

     

    “I am not in this for personal gain and what is of paramount importance is the club regains stability both in financial and footballing terms,” said Murray. “We can say to supporters that the assurances the Walter Smith consortium are looking for regarding financial probity and high standards of corporate governance will be met. The board would urge all Rangers fans to now get behind the club.”

  21. Rangers: the four options

    On July 4, all 12 SPL clubs will vote on the request by The Rangers Football Club to be transferred the league share from Rangers Football Club plc.

    There are three potential scenarios facing the newco Rangers from this vote, and a fourth depending on the outcome of the SFA reconvening its Appellate Tribunal. Here, Herald Sport examines all four possibilities, the circumstances that would lead to them occurring, and how Rangers and Scottish football would respond . . .

     

     

    RANGERS STAY IN THE SPL

     

     

    If eight clubs vote in favour of The Rangers Football Club receiving the transferred share then the newco will play in the top flight this season. The choice facing each club is to evaluate the damage to their business model of an SPL without Rangers, which diminishes the broadcast deal, other commercial contracts and revenue from the Ibrox club’s travelling support, against the dismay of their own fans, many of whom are threatening to boycott games, and are not buying season tickets, if the newco is admitted.

     

     

    How would Rangers respond?

     

     

    The club itself would no doubt prefer to play in the SPL, but the likelihood is that sanctions would be applied. At the very least, the other clubs would in return for a yes vote demand that the newco agree to accept any penalties liable to the oldco following the SPL’s investigation into EBTs, but also a change to the 11-1 voting rights that have essentially allowed the Old Firm a veto over all decisions. If points and financial penalties are also levied on the newco, then Rangers may be less inclined to favour this option, and the Ibrox fans are increasingly agitating for the club itself to choose to move to third division.

     

     

    How would Scottish football respond?

     

     

    A growing movement among grassroots fans has built against the readmission to the SPL of the newco Rangers. Many chairmen fear that fans will turn against their own clubs if it votes in favour, and boycotts have been threatened for games involving the newco. There is also the danger that ill-feeling spreads and becomes a lasting threat for Scottish football.

     

     

    RANGERS DROP INTO FIRST DIVISION

     

     

    An idea gathering traction. There is a belief in at least one SPL boardroom that Sky will honour the terms of their deal if Rangers might return to the top-flight within one season. There is no obvious route to sending the Ibrox side down one division, though. The SPL have decided Rangers have a case to answer for their EBT use, with disciplinary proceedings beginning once the July 4 vote has been held, and among the 18 possible sanctions is a catch-all penalty that allows the SPL to decide an appropriate penalty. This could be docking enough points from last season to relegate Rangers, and bring Dunfermline Athletic back into the SPL, or to decide that demotion is suitable punishment, and so bring Dundee, who finished second last season, into the top flight. It could also herald the establishment of SPL2, or even a merger between the SPL and the SFL, leaving the SFA as the sole governing body.

     

     

    How would Rangers respond?

     

     

    The scenario pre-supposes Rangers’ guilt in the EBT case, and that the club would not appeal. However, the owners may consider their business plan is better served by at least one season in the first division rather than being consigned to the third, particularly if the other SPL clubs make it clear that the newco vote will go against them.

     

     

    How would Scottish football respond?

     

     

    There is something of a compromise in this scenario, but that may make it attractive to most stakeholders. If the broadcast contract, and other commercial deals, can be salvaged top-flight clubs will not suffer themselves for demoting Rangers. The Ibrox club would also be receiving a significant punishment that would act as a deterrent to other teams.

     

     

    RANGERS DROP INTO THIRD DIVISION

     

     

    If the SPL clubs vote against the league share transferring to the newco, then Rangers would have no choice but to apply to the SFL. A first division club would be moved up to the SPL – probably Dundee – and the knock-on effect would be an opening in the third division. Other ambitious clubs might also apply, but none could match the revenue-generating power of Rangers.

     

     

    How would Rangers respond?

     

     

    For some fans, this is the only way for the club to take control of its own destiny. There would also be a certain drama and novelty of the club fighting its way back to the top-flight. However this might soon wear off if Ibrox is not full every second week and the away support are visiting Scottish football outposts. For the owners, this would be the worst possible outcome, because costs would have to be slashed to maintain the business’s suitability in the face of heavily reduced income streams. All the top-rank players would also leave.

     

     

    How would Scottish football respond?

     

     

    Supporters of other clubs would be gleeful, and consider this the successful outcome of their campaign to protect sporting integrity. Many of the remaining SPL clubs would suffer, and some would face their own brush with possible administration, and downsizing would be required. The game would, of course, continue. The lower divisions would benefit from the money that Rangers generate – a source who used to work at Sky pointed out that East Stirlingshire v Rangers would generate higher viewing figures than any SPL match not involving Celtic – and Rangers would certainly be purged of the indiscretions of the two previous boards.

     

     

    RANGERS ARE SUSPENDED OR EXPELLED

     

     

    Rangers must give notice today, the end of the 21-day appeal period, that they will be appealing Lord Glennie’s Court of Session verdict to set aside the registration embargo. If an appeal is not received, then the SFA will reconvene the Appellate Tribunal under Lord Carloway, at which Rangers could accept the registration embargo, or leave the Tribunal to deliberate. The possible sanctions are suspension from the Scottish Cup, suspension of Rangers’ SFA membership, or expulsion. A fourth option is a fine, but this has already been imposed on the club.

     

     

    How would Rangers respond?

     

     

    Suspension from the Scottish Cup for the forthcoming campaign would be a relief compared to the other, higher sanctions. There is some doubt about how a suspension from membership would work, in terms of timescale, how it would impact on the employment contracts of players and staff, and the like. Expulsion is draconian, so the shrewder choice might be a suspension that is itself suspended for 12 months on condition that all taxes, wages and football debts are paid on time.

     

     

    How would Scottish football respond?

     

     

    The loss of Rangers to the game in this country would have a lasting and negative effect. The club deserves to be punished for the misdemeanours of the past, but there must also be some proportionality. There is little point in Scottish football damaging itself in the process, so the wider game might be happier with a Scottish Cup suspension, or a suspension that is itself suspended.

  25. COWDENBEATH fans can expect exciting times ahead as they digested the fixture list for the Barrs Irn Bru First Division this week.

     

    The list came out on Monday and it has paired them with old West Fife rivals Dunfermline Athletic on Saturday 11th August at Central Park.

     

    But there was more spice added to the situation with a Sunday newspaper suggesting that there may yet be a late reshaping of the whole league structure which could see the Rangers newco playing in the First Division this season which would effectively be SPL2..

     

    Cowden vice-chairman John Lints said this week that it was indeed strange times in the Scottish professional league but it all added up to exciting times for the Blue Brazil.

     

    He told the Times, “The current educated speculation is that the newco Rangers may be relegated to SFL First Division where they would of course meet Cowdenbeath.

     

    “This would mean potentially two all ticket full houses against Rangers. We are also hoping for close to full houses against Dunfermline.

     

    “Accordingly supporters should now snap up the remaining earlybird season tickets currently available. These are available at the Club Office at Central Park or by phoning John Cameron at the Club Office on 01383-610166”.

     

    If the SPL2 idea comes to fruition it would mean the newco being accomodated in the second tier while either Dundee or Dunfermline would go up to the SPL.

     

    This could clearly make a change in the first fixture if the Pars were to be re-instated to the top division and it could mean that Rangers would fill the gap. It could also bring Sky Television to Central Park as the company has made a pledge of backing the new SPL set-up.

  32. When the SPL clubs meet to consider who gets the spare place I hope Celtic point out at the start that there is no need to consider an application from a club which is not yet a member of Scottish football and the only choice to be made is between Dunfermline and Dundee.
