Killie’s Johnston ignores consent rights of victims

We have lots to do today so I’m not going to waste much of your time on the nonsense spouted by Kilmarnock chairman, Michael Johnston, yesterday, but it is important to respond to his claims.

After confirming Kenny Shiels will remain Kilmarnock manager next season Johnston said:

“As a solicitor, the difference between a CVA and a sale of the assets by the administrators to a new corporate entity doesn’t really have much of a difference for the creditors.”

The difference is consent.  Creditors consent to a CVA, they do not consent to the establishment of a new corporate entity.  Mr Johnston can speak as a Rangers fan or Kilmarnock chairman all day long without fear of contradiction, but if he speaks as a solicitor, he really should respect the weight the law gives to consent.

In law, acting with or without consent can be the difference between jail or freedom.

Johnston goes on to say:

“It is the same amount of money that’s going to be available to the creditors at the end of the day by and large.”

Yes, the same amount of money that has been declined by creditors.  Offering them this cash when they have already refused it, and pretending they should have no concerns is crass stupidity.

He adds:

“But there are legal differences and what people have to bear in mind is that a football club has always been viewed by the football authorities as being something separate from who owns the football club.”

In the history of Scottish football this has never, ever, ever happened.  Third Lanark, Airdrieonians, Gretna, all failed to reach agreement with creditors, all went out of business.   When Mr Johnston said “always” he should have said “never”.

And Mr Johnston, please remember, acting with a financial or other type of victim’s consent is good.  Acting without a victim’s consent is very bad.  Trying to equate these two scenarios is disgusting.

    Michael Johnston, as a solicitor, if someone is found guilty of, let’s say, five murders, do they get five life sentences, or does the judge hold his hands up, “enough is enough, how much punishment can one man take” and stop at one?

    I have acquainted myself with real history,not just the propaganda we’re fed.

     

    My conclusions vis a vis the scandal of Satan F.C?….the O.O. has gained even more disproportionate power in Scotland and Scottish football and now ‘laws’ are just being created on the hoof and the existence of RFC will be maintained at all costs,even if it means the death of professional football in Scotland. All this to perpetrate and intensify bigotry,intolerance and hatred.

  21. Johnston actually puts jabba and Chico to shame regarding rangers cheerleading. It would be interesting to know what the Kilmarnock fans think of their chairman putting another clubs survival over their own.

     

    I feel this whole situation will not end well for Scottish football. I believe regardless of the evidence against them the will be in the spl with very little sanctions. I hope I’m wrong.

    The point I was trying to make was that the support is the brand or do you cedit the excellent performance of the Celtic support last night to PL’s shrewd marketing?

     

     

    The Celtic brand is only successful because of our unparallelled support borne out of our support’s rich cultural history not because the club is marketed so successfully by the Celtic board!

  27. I am sick of people in positions of power peddling the myth that the football club and the company can be separated. They cannot. They are one and the same. The Company sells season tickets, merchandise, pies, sponsorship space and produces football matches for the entertainment of its customers. The Company owns the stadium, the player registrations, the training complex, the intellectual property, and the share in the league. The Company is liable to maintain payments to its employees, trade creditors and in respect of its statutory responsibilities.

     

     

    What does the club do if it is independent of the Company? The answer is, nothing. Company=Club. The very fact that the SPL require to devise a mechanism for “transfer” of a league share to a newco removes anmy doubt. You cannot transfer anything to yourself. The club cannot transfer a league share to itself. A company CAN, however, transfer a share to another company. But that’s just the thing, it is ANOTHER COMPANY, a new thing. A New Club.

     

     

    The idea that a New Club can waltz straight in to the SPL is insulting to anybody who values sporting integrity. There is a 160 year history of association football in this country. There are clubs like Falkirk, Hamilton Accies, Partick Thistle and counteless other Junior and Amateur teams who have contributed to that tradition.That their efforts in cutting costs, living within their means and putting up with the attendant sporting ramifications ought to be rewarded by witnessing some new thing which happens to own a stadium once used by a former club waltzing straight into the most prestigious and financially rewarding division in the country is a disgrace, pure and simple.

     

     

    Incidentally, much as we have started using the newclub terminology, we have to be disciplined in maintaining the correct narrative that a newclub would NOT be re-entering, or “getting bak in” to the league. Nor should be refer to it as “Rangers”. I have heard “Zombie FC” and “Frankenstein FC”, the latter of which I prefer. perhaps Paul67 could provide a definitive name for them to rally round.

    In the first half I have to say I got a lot of encouragement except for Commons supreme quality at giving the baw away.

     

     

    The support !!! They deserve a better product to play in an honest league at the very least. It should be the first action on any list within FIFA never mind UEFA

    Once again, I think it’s more than a little unfair to criticise PL for talking about the Celtic brand when he’s been asked to respond to a report about our brand power.
