SFA accuse Channel 4 News correspondent of “lying” while protecting president Ogilvie

When you have a potential loss to the tax payer of £75m, allegations of tax irregularities, political interference, alleged sporting malfeasance and stand of the brink of the largest corporate failure in Scottish history (discounting the bailed-out RBS) the profile of the story rises above the blogs and regular Scottish media.

Alex Thomson, chief correspondent for Channel 4 News, a man who reports from war zones, interviews prime ministers and presidents, decided to look into how the SFA were handling the current crisis in Scottish football.  Yesterday he blogged on the subject, raising many of the questions we have asked in recent months.

On Twitter this morning he reported his experience in trying to get some sense out of the SFA, this is what he said:

“SFA say President Campbell Ogilvie is ‘distancing himself from the current Rangers investigation’ but did not explain how.

“Campbell Ogilvie ‘did not know’ about EBT contract when he was Rangers FC secretary?

“When we asked why not – that was his job – SFA said they didn’t know.

“SFA say their President and fmr Ranger secretary Campbell Ogilvie will not be interviewed by c4news about what he knew…

“SFA say their President Campbell Ogilvie ‘has no plans to stand aside from his job pending current Rangers probes…

“Interesting SFA have just accused me of ‘lying’, ‘pig-headedness’ and then put the phone down mid-conversation….

“all because I put their own statement back to them that Campbell Ogilvie denied knowing about EBTs at Rangers…

“And suggested there might be a perceived conflict of interest in his current position until the investigations are complete”

Three weeks ago we suggested that Ogilvie’s position as SFA president was untenable, saying “The association cannot have a president embroiled in a tax evasion scam which, even before a verdict has been decided, has already caused untold harm to his former club and the reputation Scottish football.”

The SFA  have been able to dismiss pleas for sporting integrity and ethical standards from the blogsphere while the mainstream media have either chased the hapless fall-guy, Craig Whyte, or refused to take the Improper Registration of Rangers players seriously.

SFA chief executive, Stewart Regan, was flushed out his slumber by Mr Thomson’s comments this morning, Tweeting to the reporter, “Please could you confirm who you have spoken to. thank you.”

Stewart, if you really need to ask that question, you’re in more trouble than I thought. There are several thousand CQN’ers who could help answer that one.

Campbell Ogilvie and the SFA cannot hide from the facts of this crisis.  He is president of the SFA and both he and the association must acknowledge there is work to do.  We can only hope Uefa finally decide to take a look.

My pal's dad who lived a few doors away from me was also a driver with Baxter's buses and when I went to his house for him one evening his dad and Gartshore were outside blethering in the front garden.     Andrew Whitson and Paul Swan are first ‘football bill’ convictions

     

    Two men have become the first football supporters in Scotland to be convicted and sentenced under new offensive behaviour at football legislation.

     

     

    Andrew Whitson, 28, and Paul Swan, 39, both from East Lothian, admitted singing racially-offensive songs on a train from Ayr to Glasgow on Saturday.

     

     

    Whitson was fined £180 and Swan £200. They were also given a one-year football banning order.

     

     

    The Offensive Behaviour at Football Bill came into force on 1 March 2012.

     

     

    Guilty pleas

     

    Whitson and and Swan were returning from the Ayr v Hibs Scottish Cup quarter final match on the 18:13 train when they committed the offence.

     

     

    They were arrested after officers from British Transport Police (BTP) observed them singing songs of a racially derogative nature.

     

     

    Whitson, from Longniddry, and Swan, from Tranent, pleaded guilty when they appeared from custody at Glasgow Sheriff Court.

     

     

    Following the case, Ch Supt Ellie Bird, BTP commander for the Scotland area, said: “These convictions and sentences send out a clear message that this sort of behaviour and criminality has no place in society and certainly not on our rail network.”

    Scottish FA concern over English TV clash with European games

    The Scottish Football Association will complain to Uefa about the playing of Tuesday’s Liverpool v Everton match.

     

    St Johnstone and Hearts were prevented last month from switching a Scottish Cup replay to a Thursday because it clashed with Europa League fixtures.

     

    And yet the Merseyside derby – live on satellite television – goes ahead in direct competition to Champions’ League action – a contravention of Uefa rules.

     

    A Uefa spokesman said: “The English have totally ignored our rules.”

    The McDiarmid Park game would have been televised, so the decision not to go ahead cost Saints and Hearts £82,500 each.

     

    At first, when questioned by BBC Scotland, Uefa insisted that the English Premier League game was going ahead because the European governing body looked on each situation “case to case” and that sometimes “special concessions were granted”.

     

    But then, after further questioning, it emerged that England’s top flight did not even ask Uefa for permission – triggering angry claims of one rule for the rich and one for the poor.

     

    “The English did not even consult us,” admitted the Uefa spokesman.

     

    “The executive committee will now examine the case at the end of the season and sanctions could be taken against them.

     

    “What these sanctions will be is impossible to say.”

     

    However, the SFA is furious about the refusal to allow the Cup tie between St Johnstone and Hearts to go ahead and will now write to Uefa to underline their concerns.

     

    There is talk within Hampden of “wanton disregard” by the English for rules that have hit hard on the already financially stretched Scottish game.

     

    Uefa has ruled that, from next season, you cannot even have a national cup final on the same day as the Champions’ League final.

     

    Last week, the FA Cup replays between Tottenham Hotspur and Stevenage and Birmingham City and Chelsea were shown live on television on the same evening as Champions League matches.

     

    The FA is likely to argue that a congested fixture list limited the number of possible dates ahead of the FA Cup quarter-finals this weekend and that it is likely to suffer financial sanctions from Uefa as a result of the clash with European games.

     

    A spokesman at the Barclay’s Premier League did not wish to comment about the clash with Tuesday’s Merseyside derby.

    Prosecutor Tim Niven-Smith asked Mr Lennon if he had been made aware last March of a “suspicious package” marked for his attention.

     

     

    He replied: “Yes, but before March as well. There was a bullet sent in January and a bullet sent to Lennoxtown, our training ground, around November time.”

     

     

    The advocate depute went on: “As a football manager, how did you feel about the information police had told you?”

     

     

    The Celtic manager replied: “Very disturbing. I have a family, a young son, a partner and a mother and father.

     

     

    “I am a football man. I fail to comprehend the lengths some people would go to.”

     

     

    Phone threat

     

    Mr Niven-Smith put to him that this had ended his international playing career for Northern Ireland.

     

     

    The former Celtic captain recalled: “I was having a pre-match and I got a message to say someone had called the BBC to say that if Neil Lennon played tonight he would get hurt or shot.”

     

     

    Mr Lennon also spoke about Paul McBride, just 24 hours after he acted as pall bearer at the top QC’s funeral.

     

     

     

    Mr Lennon recalled that a bullet was sent to him at Celtic’s training facility

     

    He said Mr McBride had helped him with legal affairs at Celtic, but added: “He was my friend, first of all. A very close friend.

     

     

    “I never saw him work, but I knew that he did stuff for me within the boundaries of the club.

     

     

    “When we socialised we kept football and the law away from the dinner table and chewed the fat about other things.”

     

     

    Mr Niven-Smith: “How would you describe his personality?”

     

     

    Mr Lennon replied: “Huge – just a brilliant man, very inspirational. I loved being in his company regardless of what we were doing.

     

     

    “He was legally brilliant. As a person, you know, it is difficult to put into words.”

     

     

    He then added: “There are two people that have really inspired me. Paul McBride was one and Martin O’Neill (Mr Lennon’s former manager at Celtic and Leicester) was the other.”

     

     

    McCoist ‘altercation’

     

    Mr Lennon also recalled “an altercation of some sort” he had with then Rangers assistant manager Ally McCoist after an Old Firm Scottish Cup tie last March.

     

     

    He said the match had been “tempestuous and competitive” and “maybe a bit more” than other games between the clubs.

     

     

    Earlier the court heard how one of the accused allegedly told a woman to ignore a “bang in the night” if she heard one.

     

     

    Mr Muirhead, 43, was said to have made the comment to his son’s partner, Ayla McCartney, the day before a suspect package was discovered.

    But Ms McCartney told the court she did not remember the remark and that police told her what had been said.

     

     

    The High Court in Glasgow was told of a statement which Ms McCartney gave to police last May.

     

     

    In it, she speaks of the evening before a package was discovered in her street, Montgomery Terrace in Kilwinning, North Ayrshire.

     

     

    Ms McCartney, 23, said Mr Muirhead and Mr McKenzie, 42, had been in her house.

     

     

    She told police “Trevor” asked her what she was doing the next day and she told him she was going to Tesco’s to pay her home insurance.

     

     

    The statement went on: “He then asked me what way did I go down the town. I said I go down the way.

     

     

    ‘Bang in the night’

     

    “Trevor then said: ‘Don’t go to the left and if you hear a bang in the night, don’t look’.”

     

     

    Prosecutor Tim Niven-Smith asked the witness: “Did you say that?”

     

     

    She replied: “No, I did not say that. They (the police) told me who said things. I just agreed with them because I wanted out of there.

     

     

    “They were the ones that had made up their minds that they had done it. They told me that Trevor did not care about his grandchildren and that was why he had done it.”

     

     

     

    A suspect package was also sent to Cairde na hEireann (Friends of Ireland)

     

    The court heard Ms McCartney also claimed in the statement that they were “kinda laughing – Trevor more than Neil”.

     

     

    She added: “I did not know what to make of it. It was all very strange.”

     

     

    The jury was told that Ms McCartney said to police that the pair had left and that she had remarked: “What the bloody hell are those two on?” She also said Mr Muirhead had been “acting weird”.

     

     

    In her statement, she then recalled what happened when police were making door-to-door enquiries.

     

     

    She added: “Although I knew what had happened and had my suspicions, I didn’t know what to say, so I said nothing.”

     

     

    Mr Niven-Smith said to Ms McCartney: “Is it not the case that you are trying to help what is effectively your father-in-law by telling a pack of lies?” Ms McCartney replied: “No.”

     

     

    The prosecutor then asked: “The conversation by Trevor… you say you never heard and that police told you about it?” She replied: “Yes, I just wanted out. I wanted back to my kids.”

     

     

    ‘Orange town’

     

    The trial also heard from Mr Muirhead’s daughter, Gemma.

     

     

    The 18-year-old told the court that he had been a member of the Apprentice Boys of Derry and of the Orange Order.

     

     

    She agreed that he was from a loyalist Rangers-supporting background and lived in an “orange town”.

     

     

    The teenager also denied that she had asked her father or her brother to get peroxide for her, saying she was allergic to it.

     

     

    Mr Muirhead and Mr McKenzie are alleged to have planned to “assault and murder” their three intended victims between 1 March and 15 April last year.

     

     

    The charge claims the pair sent another suspected bomb to the offices of Cairde na hEireann (Friends of Ireland) in the Gallowgate, Glasgow.

     

     

    Mr Muirhead and Mr McKenzie face an alternative allegation contrary to the Explosive Substances Act of “unlawfully and maliciously conspiring” to endanger life or cause serious injury.

     

     

    The pair face a separate allegation of dispatching an item on 3 March to Neil Lennon at Celtic Park with the intention of inducing him to believe that it would “explode or ignite”.

     

     

    Both men are also accused to have made and possessed Triacetone Triperoxide with the intent to endanger life.

     

     

    They are further accused on 9 May in Kilwinning of threatening to plant an improvised explosive device outside a police station knowing the bomb allegations were being investigated.

     

     

    They are finally charged with attempting to defeat the ends of justice by disposing of a quantity of cream peroxide and wiring at a place in Ayrshire.

     

     

    Mr Muirhead and Mr McKenzie deny all charges. The trial, before Lord Turnbull, continues.

  12. The Battered Bunnet on

    Questions a prospective bidder might like to ask the Administrators:

     

     

    1) Are you in a position to sell a majority of the shares in Rangers Football Club plc?

     

     

    Answer: No. Only Craig Whyte can sell the shares. You need to talk to him

     

     

    2) Are HMRC likely to relent on the £15M of outstanding current year arrears?

     

     

    Answer: No. We’re afraid HMRC don’t forgive PAYE debt.

     

     

    3) What is the extent of the liability to the Big Tax Case?

     

     

    Answer: We don’t know yet. We are waiting for that decision to come down from the Tribunal. We do though have a Demand to Pay from HMRC amounting to £24M in taxes and a further £12M in interest. It is likely that the interest will be recalulated upwards in early course. Once we have the decision from the Tribunal, HMRC will apply to another tribunal seeking penalties. We anticipate a further charge of £18-24M of penalties, on top of the existing demand of £36M, plus some further interest. All should be clear by August on that front.

     

     

    4) So we need to wait until August before we know how much we will be liable to pay HMRC in the end?

     

     

    Answer: Yip. that’s about the size of it. Unless we win the Tribunal of course. Cough.

     

     

    5) OK, so who has title to the assets of the company at the moment?

     

     

    Answer: Well, that’s a complicated one. On the one hand, Craig Whyte claims to have a Floating Charge over the assets. He’s rather strong on this point, and certainly the Charge has been properly executed. We think though that we can get a Court to invalidate the Charge on the grounds that Whyte isn’t owed any money, apart from his claim, lodged with us via one of his many subsidiaries, for £18M that was used to pay off Lloyds, plus interest and charges. Oh, and a Facilitation Fee. And some Management Charges.

     

     

    6) So, you need to get the Court to invalidate the Floating Charge before you can sell the assets?

     

     

    Answer: Yip. That’s right. But then we have Close Brothers, who have a Fixed Charge on the stadium, in the sum of £2M plus interest.

     

     

    7) OK, so you can’t sell me the shares without Craig Whyte’s consent, and you can’t sell me the stadium without a Court Judgement. And after that, you need to settle £2M plus interest to Close Brothers?

     

     

    Answer: Yes. that’s pretty much the situation.

     

     

    8) I notice that The Kelvinside Academy War Memorial Trust has a Fixed Charge on Murray Park. What’s all that about?

     

     

    Answer: That appears to relate to future terms of use and disposal of the property at Auchenhowie. We are looking into that at the moment, and hope to clarify the restrictions shortly.

     

     

    9) What is the status of the Debenture Holders?

     

     

    Answer: The Company owes them £7.5M, payable in the event of an insolvency. But they’re pretty much all good Rangers fans and we don’t think too many will object if we simply ignore them and the debt we owe.

     

     

    10) Speaking of debt, what else is kicking about?

     

     

    Answer: Well, of course, as a trading entity the Company has a number of trade creditors, moreso given the tight cash rein used by Craig Whyte. At the moment there is around £1.5M owed to an assortment of football clubs. We’ve also got some finance deals, and of course the remaining leases on the retail premises we closed when we securitised the merchandising operation. Of course, you need to include JJB in the trade creditors list, as they paid 10 years up front for their license, and have 4 years to go. Call it £6M, unless you are happy to continue the deal through to completion in 2016.

     

     

    11) Anything else I should know?

     

     

    Answer: Well, there’s a longstanding arrangement with Azure Catering whereby they paid up front for future catering revenue, and this would need to be addressed with them directly. You’re probably looking at maybe £2M to buy them out though.

     

     

    12) Speaking of buy out, what about the players?

     

     

    Answer: Well, provided the club comes out of Adminstration, they are all still registered with Rangers, and they come as part of the deal.

     

     

    13) But didn’t you amend their contracts recently?

     

     

    Answer: Yes we did. They’re great guys. Took huge paycuts till the end of the season.

     

     

    14) What happens at the end of the season then?

     

     

    Answer: Well, they revert to full wages of course, or they are permitted to leave the club at vastly reduced transfer fees.

     

     

    15) So we either pay top dollar for that bunch of selling platers, or they sky the park for nothing?

     

     

    Answer: Not quite nothing, no, but you are certainly catching my drift Sir.

     

     

    16) OK, let’s talk operating environment.

     

     

    Answer: Let’s. Rangers are a member of the prestigious Scottish Premier League, with access to lucrative European competition every year.

     

     

    17) I thought Rangers would not be able to compete next year in Europe because we had failed to meet the requirements for a Club License?

     

     

    Answer: Yes, that’s correct Sir, but you need to take the longer view. Look at future seasons.

     

     

    18) What’s the script with this Inquiry I hear the SPL have commissioned, looking at the eligibility of players’ Registrations going back 14 years?

     

     

    Answer: Achem. Yes. There is an ongoing inquiry, but Dave King has a sense of it and he’s confident that there won’t be any trouble.

     

     

    19) What kind of trouble are we looking at?

     

     

    Answer: Well retrospectively, we’re looking at stripping of titles and the likes. But that doesn’t concern you.

     

     

    20) Doesn’t that impact upon brand value?

     

     

    Answer: Well, yes of course it does, but not as much as being expelled from the SPL, and being relegated to the bottom tier. Damn. I didn’t mean to say that.

     

     

    21) Expelled? Relegated? You mean, no SPL membership? 3rd Division Scottish Football League type bottom tier?

     

     

    Answer: Yes, regrettably, possibly, yes. But we’ll need to wait and see. We’ve got a lot of friends on the SPL Board, and the President of the SFA is a good Rangers man you know.

     

     

    22) What’s with yon Paul Murray fellow doing a deal with the Ticketus operation?

     

     

    Answer: Well, you see Sir, Ticketus own half of the seats at Ibrox Stadium for each season through to May 2015. Effectively, half the stadium revenue for the next 3 years goes to Ticketus before the first ball of the season has been kicked. Part of the Craig Whyte legacy I’m afraid Sir.

     

     

    23) Half of the season ticket sales? But that’s £10M per season! How much would it cost to buy them out?

     

     

    Answer: They’re very flexible Sir. Probably just a modest return on their £20M debt. Call it £25M and you’re laughing.

     

     

    24) Debt? More debt? How much are we looking at in total Gentlemen?

     

     

    Answer: Well, we have yet to determine that of course, with quite so many issues surrounding cash transactions, securities, ownership, Tax Cases, Debentures and so on. But you can call in 9 figures quite comfortably.

     

     

    25) Anything else?

     

     

    Answer: Well there’s the small matter of the Company’s cash position. We can’t determine that until the High Court rules who rightly owns the money in the Collyer Bristow account. We think it’s ours because it’s the money Ticketus paid for the season tickets, but some pension fund think it’s their’s, placed in trust. There’s also the Merchant House people, and of course, HMRC want it claiming it ought to have been part of the assets frozen with their arrestment following the Wee Tax Case, but let’s not go there.

     

     

    26) How much?

     

     

    Answer: Small matter of £3.6M Sir.

     

     

    27) OK, you’ve been very helpful. In summary, Rangers are for sale if Craig Whyte says so, but he hasn’t. You can’t tell me who owns which assets, how much the assets are worth, or what creditor claims are valid. On top of that, we’re looking at +£100M of debts to assorted entities and the stadium revenue is crippled for 3 years. Finally there is no guarantee of SPL football next year on the grounds that we might be expelled from the league, while Europe is off the card for at least a season.

     

     

    Answer: Very good Sir. That’s about the size of it.

     

     

    28) Do you have the number of the local Taxi company?

     

     

    Answer: Certainly Sir.

    Was at the under19’s game, great first half an hour, with some good performances from Tony Watt, Paul George and the captain and pur big centre half. Enjoyed the game, Tony Watt booked and then chipped away constantly at the ref and a couple of players, good to watch although a bit hobby at times. Liked the shout atbthe start when one of our players swore at the ref and was told by Chris McCart that foul language would not be tolerated and went on about discipline when there were some meaty challenges and some poor ref decisions. Great day out.

    That latter game at Ibrox was the one where Greig stopped the ball crossing the line with the hand at the end of his extended right arm. Ivan Golac was later to comment about a similar incident, ‘That was a penalty anywhere in world football – but not at Ibrox.’

     

    The Celtic players surrounded Gordon in protest. He continued a dialogue with them until he noticed Greig in the Celtic penalty area. Then he sprinted out of the Rangers’ box giving the play-on signal.

     

    After the goal Celtic refused to take the centre for some time until Neilly Mochan came onto the pitch and told them they had to complete the charade.

    They are applying for an administration order rather than the notice of appointment they are currently working under. Court on Monday 19th.

     

     

    Is there any possibility that the court could apporove BUT appoint other adminstrators in their place? Will hector get a say in this hearing?
