Smith, the SFA, Everton and EBTs

Walter Smith was not named by BBC’s Mark Daly as a recipient of an Employee Benefit Trust in the recent documentary, however, before this matter is put to bed I expect more names to emerge.  As soon as Smith makes himself available to a proper journalist he will be asked:

Did he receive EBT loan payments from Rangers?

If so:

Did he repay those loans or hold his cash while the club ran out of money and died?

Was he in receipt of a letter from Rangers confirming he was not required to repay?

Did his then employers, the Scottish FA, know he was perhaps receiving money from a member club while employed by them?

Are SFA employees contractually inhibited from taking payments from a member club or required to inform the SFA board of any payments received by a member club?

Did his earlier employers, Everton FC, know if he was receiving money from another club while employed by them?

Was Smith contractually inhibited from taking payments from another club or required to inform Everton of any payments received from another club?

As manager of Rangers, was he involved in negotiations with players who had EBTs or was he another one who concentrated on administrative and legislative duties?

Was he one of the men SFA president, Campbell Ogilvie, suggested failed to reveal side contracts to the Rangers board?

Rangers’ liquidators, BDO, will forensically pour over most of these questions, so Smith’s answers will be verifiable.

No one who played an active part in Rangers EBT scandal will come out of this clean.  The ramifications multiply if Rangers were discretely paying any senior employee of another club.

I simply cannot imagine the justification for a member club discretely paying a senior employee of the SFA.  Frankly, it would be beyond every Celtic fan’s most paranoid fantasies.  I am sure Mr Smith will quickly and easily be able to reassure everyone.

An interesting twist in Smith’s bid for the assets of Rangers is that if he is to inherit Green’s application for a SFA licence and take a controlling interest in the club, Green is obliged to do due diligence on Smith to determine if he is a Fit and Proper person.  Perhaps Mr Green can use the above as his due diligence questionnaire.

One final thought.  In the unlikely event that it is established that one senior SFA employee was receiving discrete payments from Rangers, we need an immediate and independent inquiry to establish how many others received such payments and what they were for.

As a matter of some urgency I would recommend Stewart Regan brings himself up to speed on this one. I am sure his president is banging the table as you read this insisting the chief executive gets to the bottom of this. It’s not as though he is heavily conflicted and the SFA is in dire need of an independent president to steady the ship.

My friends in Celtic, this just got interesting.

    In excess of £6m was the bid rejected, so can’t see him leaving for anything under £8m which is great business for a player that doesn’t actually start every game!

    Remember this is a sting. The object of a sting is to take what you want in such a way that those stolen from cannot respond or undo your theft.

     

     

    Let’s be clear at this point. BOTH clubs are still ‘alive’. Oldco has not yet been formally liquidated. It cannot die at this point because it needs to be alive to ‘transfer the share (SPL)’. If it’s actually deid, then it’s deid and a transfer cannot be enacted. You need both entities alive to effect a transfer.

     

     

    This why D+D are still ‘administering’.

     

     

    This is why the SPL position is now central to the sting.

     

     

    Wattie entering stage left is part of the sting. Perhaps this has been in place all along and all the players know this. Who knows.

     

     

    As regards ‘sponsors’. They are sponsors of oldco. They have no relationship with Sevco. They cannot ‘withdraw’ sponsorship from something they don’t sponsor.

     

     

    Sponsors out is another deflection.

     

     

    Eye on the prize.

    Very interesting blog from sports lawyer Dr. Gregory Ioannidis.

     

     

    He talks about the licensing hoops that a totally new club would need to jump through to be able to play next season – if it was a member of a league.

     

     

    He also discusses the legal interests of other clubs and mentions that there are two clubs that may make a legal challenge to any new club being given a vacant SPL place when they have a footballing claim to that place.

     

     

    And a tweet from the same gentleman: “Off to advise two clubs in the northern part of the UK on an important & unusual sports law matter.”

    Not being au fait with the world and commerce, I would imagine that if a company ceases to trade or remain in business, then any sponsorship that the ex-company had would automatically cease.

They were discussing how England are crap at most sports, and that every time they go to a big football tournament like the World Cup or the European Championships, their media think they have a divine right to win it, and they always flop miserably.

    He looks the part, but, has a level of inconsistancy which is to be expected,due to his youth.

     

     

    Another couple of seasons should bring him closer to his full potential.

     

     

    I believe that if Kayal hadnot beeninjured, we wouldn’t have seen as muchof Wanyama, certainly not in midfield.

     

     

    By all means, adjust his contract,but, at this stage, the EPL would “kill” him.

    Looks like there will be a slot opening up at the bottom of SFL Division 3, we should make a claim for that slot for a Celtic B Team.

     

     

    It would help develop the countries best youth system & would bring in crowds to the lower divisions, that can only be good for the Scottish game and the bid should be welcomed by the SFL.

     

     

    Hope Mr Lawwell is working on this….

  21. Sky Sports sources understand Celtic have rejected a bid in excess of £6million from Rubin Kazan for South Korea international Ki Sung-yueng.

     

     

    The 23-year-old has impressed at Parkhead since joining Celtic from FC Seoul during the January transfer window in 2010 and he helped the club win the SPL title last season.

     

     

    He has made 85 appearances for the Bhoys, although he missed the run-in to the last campaign due to a hamstring injury.

     

     

    Ki’s form during his time with Neil Lennon’s side has often seen him linked with other clubs, and Tottenham Hotspur were mooted as admirers last month.

     

     

    However, Ki responded to those rumours at the time by insisting he was not looking for a transfer after previously suggesting he would be prepared to discuss a new contract in the summer.

     

     

    Russian side Rubin Kazan, though, appear to be trying to test Celtic’s resolve, with the Bhoys having already turned down an opening offer.

     

     

    It is understood that Celtic are expecting Rubin to make an improved bid for Ki, while there remains interest from the English Premier League.

     

     

    The ongoing speculation regarding Ki’s future at Parkhead comes at a time when fellow midfielder Victor Wanyama is also being targeted by other clubs.

    I know it’s just Vic’s agent doing his job and trying to get his client an improved wage, but I hate seeing speculation about our best players.

     

    Hopefully, there will be no repeat of the events at the beginning of last season when Kayal shamefully downed tools to get a better deal. With the CL qualifiers coming up, all contract issues must be resolved during the close season.

  26. It is very encouraging to read that Celtic have rejected 6m for Ki. I think he is a great talent who still has a lot to give, although that doesn’t mean that a further bid of 8 or 9 million being accepted would disappoint me. As long as the board recognise that certain players are not for sale at any price, and others for the right price.
