Smith, the SFA, Everton and EBTs

Walter Smith was not named by BBC’s Mark Daly as a recipient of an Employee Benefit Trust in the recent documentary, however, before this matter is put to bed I expect more names to emerge.  As soon as Smith makes himself available to a proper journalist he will be asked:

Did he receive EBT loan payments from Rangers?

If so:

Did he repay those loans or hold his cash while the club ran out of money and died?

Was he in receipt of a letter from Rangers confirming he was not required to repay?

Did his then employers, the Scottish FA, know he was perhaps receiving money from a member club while employed by them?

Are SFA employees contractually inhibited from taking payments from a member club or required to inform the SFA board of any payments received by a member club?

Did his earlier employers, Everton FC, know if he was receiving money from another club while employed by them?

Was Smith contractually inhibited from taking payments from another club or required to inform Everton of any payments received from another club?

As manager of Rangers, was he involved in negotiations with players who had EBTs or was he another one who concentrated on administrative and legislative duties?

Was he one of the men SFA president, Campbell Ogilvie, suggested failed to reveal side contracts to the Rangers board?

Rangers’ liquidators, BDO, will forensically pour over most of these questions, so Smith’s answers will be verifiable.

No one who played an active part in Rangers EBT scandal will come out of this clean.  The ramifications multiply if Rangers were discretely paying any senior employee of another club.

I simply cannot imagine the justification for a member club discretely paying a senior employee of the SFA.  Frankly, it would be beyond every Celtic fan’s most paranoid fantasies.  I am sure Mr Smith will quickly and easily be able to reassure everyone.

An interesting twist in Smith’s bid for the assets of Rangers is that if he is to inherit Green’s application for a SFA licence and take a controlling interest in the club, Green is obliged to do due diligence on Smith to determine if he is a Fit and Proper person.  Perhaps Mr Green can use the above as his due diligence questionnaire.

One final thought.  In the unlikely event that it is established that one senior SFA employee was receiving discrete payments from Rangers, we need an immediate and independent inquiry to establish how many others received such payments and what they were for.

As a matter of some urgency I would recommend Stewart Regan brings himself up to speed on this one. I am sure his president is banging the table as you read this insisting the chief executive gets to the bottom of this. It’s not as though he is heavily conflicted and the SFA is in dire need of an independent president to steady the ship.

My friends in Celtic, this just got interesting.

  2. My feeling is that Newclub might be voted in but with a substantial points penalty, possibly for three seasons.

     

    This would mean that TV money would be unaffected.

     

    Clubs would still benefit from Newclub’s away fans.

     

    Clubs would have a better chance of winning something and finishing higher up the league/possibly in Europe.

    Re the transfer of SPL share.

     

     

    Would this have to have the agreement of the current/former shareholder?

     

     

    What I mean is, would it be possible for the share to be transferred to Walter’s men without Green’s say so? (Or indeed, to any other ‘new club’ which springs up over the next few days/weeks/months)

    Scargill ,imo, used the miners as cannon fodder for his political ambition.

     

    His motivation ,imo,was simply the overthrow of the democratically elected govt. of Thatcher.

     

    He remembered that Mick Mc Gahey et. al. had effectively kicked out the govt. of Heath in `74 and perhaps thought he could achieve the same result.

     

     

    My recollection was that on two occasions the miners voted against strike action which Scargill had recommended and that subsequently he decided to ignore the wishes of his members and strike without a ballot.

     

    Many thanks for your courtesy in discussing matters which undoubtedly stimulate passion.

     

    The basic point I sought to make was about the use of the insulting term ” scab ” about someone who disagrees with your point of view and refuses to take the action you recommend.

    The SPL share remains with Rangers FC PLC (in administration). Sevco 5088 Ltd cannot buy it or have it transferred to it.

     

     

    The SPL clubs will collectively decide who a share is transferred to. In theory the Smith consortium could also make an application – although it would have to persuade other clubs that it could acquire a ground to play on, players, staff, etc., etc., first.

In all seriousness, if Davis, Whitaker, Mcgregor, Bocanegra etc. can walk for free surely to God there are a load of teams interested in taking them? I am stunned that a number of them haven’t gone already. What is the problem? Where is the speculation?

    Further point….If I ran a company Joe Bloggs Scaffolding PLC and went into liquidation….surely there are rules in place to prevent me re-starting as J Bloggs Scaffolding using the self same premises etc ? So How can they get away with it

    So they had a ballot, then they decided to strike without a ballot. Which was it?

     

     

    There was no ballot, other than in the Sun newspaper. Scargill didn’t call the strike. The NUM general council – 9 men – called the strike.

    X-Rangers SPL was sold to Chunk Green consortium as part of Liquidation assett sale. The share however in the eyes of the SPL is still with x-Rangers Football Club (IL).

     

     

    SPL will be voting to basically ratify, or not, the transfer of that share from x-Rangers FC(IL) to Newco. If it is not ratified then Newco will have to sell it for £1 back to SPL.

     

     

    Knuckledraggers 1690 Newco do not currently have a claim on that share. However, if SPL vote against share transfare to Chunk Green Newco dont be surprised if Knuckldraggers 1690 Newco apply to SPL to be awarded the share alongside Dundee and Dunfermline who im sure both have reasonable claim to it.

    There could be a few applicants for the share – Sevco, the Smith gang, Dunfermline, Dundee …

     

     

    At present Rangers FC PLC (in administration) holds an SPL share and is entitled to vote come the decision on who will get its share, which is likely to be early July.

     

     

    Now my view is that the SPL Board meeting on Monday should take the share off them. They are no longer a football club and don’t intend to be one in the future. They are not eligible to hold an SPL share – and an ex football team shouldn’t be playing a part in deciding the future of Scottish football.

    Thanks also to the others who confirmed my assertion that the miners did not take a vote to strike. I never claimed that it was a legal requirement, but to launch a strike that permanently closed down most of the coal industry suggests that Mr Scargill & his colleagues were not confident that they had the support of their membership. Had they taken a vote, the press would not have been able to criticise them.

     

    It strikes (no pun intended) me as odd that on a blog which boasts of its inclusiveness, there are some who use language of hatred like “scabs”: it’s also a paradox that among many intelligent & reflective bloggers, there are some who are unable to move on from the Thatcher period – which ended over 20 years ago.

     

    BTW the previous miners’ strike was not in 1969-70 but in 1973-74, at the tail-end of the Heath government.

    Now that it becomes clearer by the day that most SPL clubs will NOT vote in Newco FC, I await the SFA/SPL telling us that it is too much pressure to put on the shoulders of the clubs, so the outcome will be decided by a panel of ‘the great & the good’ of Scottish football, who can be relied upon to make the best decision without fear or favour.

     

    They could not do that, you say.

     

     

    Just watch them.
