Stupid SPL 2 plan is unworkable

You have been presented with a narrative that we should collapse the Scottish Premier League this summer and have the SFA register a new, two-division, league system to resolve the problems inherent in having too many bodies running our game.  This is complete nonsense.

Those pushing for a SPL 2 are, perhaps with good intentions, trying to pull a deal together to reduce the impact of the demise of Rangers FC buy allowing a phoenix the chance to gain entry into the league structure two levels higher than what they now face.

It’s a stupid proposal.

As things stand, there is no chance of a Newco getting access to the SPL next season.  Despite Neil Doncaster heavily advocating the notion, the idea is simply undeliverable.  Our club has been committed to opposing the proposition from the beginning, while many others now realise they have to observe the strong feelings of their own supporters on the matter.

Doncaster should have realised this was a campaign he could not win before he boxed himself into a corner over it.  SPL 2 is an attempt to address the ‘No to Newco’ concerns while bringing the income some in the game hope Newco will deliver.

The unnamed SFA source who briefed the BBC on this topic last week made no reference whatsoever to Newco, their focus was all on the administrative challenges of having multiple bodies in charge of the game, but this was disingenuous.  If there was a prospect of Newco getting into the SPL we would not be having this debate.

Tell us the truth, be honest, and these random, ill-considered, notions will perhaps be received in a better light.

The hope is that fans of the former club, Rangers, bring their cash along to watch Newco, which would play SPL 2 football next season and would be subject to whatever penalties the various independent bodies impose for years to come for the illegal actions of Rangers.  This would allow Newco to claim the history of Rangers, would perhaps maintain the existing BSkyB TV deal and would meet the ‘No to Newco’ demands.

There are several huge obstacles to overcome.  The SFA will soon instruct Lord Carloway’s Appellate Panel to consider a new punishment for ‘Rangers’ for misdeeds during the Craig Whyte era.  I expect him to suspend the ‘club’ for 12 months. A new independent judicial panel will consider the case against ‘Rangers’ for subverting our game for over a decade through the illegal registration of players.  If/when the First Tier Tribunal finds against Rangers a fresh wave of charges will be brought against any club claiming to hold that identity – as a guide, think of the punishments for the Craig Whyte era multiplied by 12.

These three independent judicial panels will destroy whatever is left of what we used to call ‘Rangers’ and there is nothing the football authorities can do about it.

Sevco, who own Ibrox and have applied for SPL access, already face an enormous challenge to meet trading costs for a year, even in the SPL, never mind a lower league (as Dave King correctly concluded).  They are prime candidates for another insolvency event any time soon.  Best of all, a Celtic fan has now bid for the assets (more on this later)!

Even if Newco overcame these enormous challenges, the SFA and SPL executives, having realised they cannot convince fans of 11 clubs to hold their noses and put up with a Newco-Rangers, will now try to convince former Rangers fans to cough up cash to support a Newco that will be rendered impotent by the most severe penalties in the history of our game.

I cannot see former Rangers fans accepting their role as cannon fodder for St Mirren, Motherwell and (cough) Kilmarnock in a league where the Mighty Celtic romp home by 30 points.

I don’t have an objection in principle to a two-league SPL but plan it properly, don’t allow knee-jerk reactions to dictate thinking.  There’s no point in us getting paranoid about this, it’s not some attempt to help the remnants of ‘Rangers’, it’s just a stupid proposal from people who have yet to see the big picture.

    I know but some folk get very worked up about what Celtic may or may not have said. I think some folk just want Peter Lawwell to stand outside the steps of Celtic Park and shout No to newco as loud as possible to allay any fears they have of siding with Dead parrot FC.

    Rangers (in Liquidation) still have a bunch of players registered to them. They have not TUPE’d over to Newclub as this requires a positive acquiescence on the part of the players and does not happen by default . Press reports indicate Green (the shell collector) has not yet met never mind spoken to the players.

     

     

    If Rangers (in Liquidation) players are sold to other clubs, presumably that is a transaction between oldco and the buying clubs and funds go to oldco. Is there an agreement as part of the asset strip, err sale, that means those funds move to Newclub, or do the proceeds from players sales enter the dead man’s chino trousers, and be available for creditors of oldco?

    I think Celtic are playing this the right way.

     

     

    The impact of not voting in Club 12 to the SPL will be greater on the other 10 than it is on Celtic. It’s not for Celtic to take the lead in this. The other 10 need to decide what is best for them, individually and collectively.

     

     

    Celtic making their position public will do no good to the situation and if anything may rankle the CEOs / Chairmen of the other SPL clubs.

     

     

    Celtic are right to let the others decide Club 12’s fate. It’s time for Hearts or Hibs or Aberdeen or Dundee Utd to step up and out of the shaddows and make their mark on the future of professional football in Scotland. They don’t need Celtic showing them the way or trying to muscle in.

     

     

    As I say, I think Celtic are playing this just right.

    On the TUPE point, I went through a TUPE process earlier this year (I was on the Union Committee responsible for probing the ins & outs of the process and consequences for staff).

     

    We had to have a month’s notice, with letters written to our home address, advising of the plan to TUPE staff to the New Company.

     

     

    If no advance warning was given then staff do not TUPE to New Co.

     

     

    If Rangers players didn’t get written confirmation last month that they are to TUPE, then they wont transfer to new company. Simple as that. And from hearing that the players are ‘in the dark’ they obviously haven’t had that letter.

     

     

    Club 12 don’t have any players. Nor will they for at least another month (so long as they issue their intention to TUPE staff TODAY).

  17. CELTIC Football Club is delighted to announce today that club legend Sean Fallon has agreed to join Celtic chairman Ian Bankier in unfurling the League Championship flag on August 4, making it a 90th birthday celebration to remember for Sean.

     

     

    Sean Fallon is one of Celtic´s greatest servants and he celebrates his 90th birthday on July 31, 2012. Sean’s son, Sean junior, said: “The whole family is absolutely delighted at this gesture. My father is over the moon at being asked to do this and I know he will be a very proud man on August 4.”

     

     

    A story in a Scottish Sunday newspaper last weekend suggested that Celtic had refused to take part in a friendly match against Sligo Rovers this summer to mark the 90th birthday of the former Celtic player and assistant manager.

     

     

    However the family was keen to clarify this and Sean junior added: “The Fallon family has an excellent relationship with Celtic and with our many friends at the club.

     

     

    “It’s extremely disappointing that a newspaper could have potentially soured this relationship by printing such an inaccurate and ill-informed story.

     

     

    “We fully understand that Celtic cannot schedule this fixture at present due to pre-season commitments.”

     

     

    A spokesperson for Celtic said: “Sean Fallon is an extremely popular Celt and one whose magnificent contribution to Celtic’s history is greatly appreciated.

     

     

    “Any suggestion that the club have snubbed Sean by refusing to take part in a friendly match with Sligo is completely untrue and that particular story has caused needless upset to Sean and his family.

     

     

    “We were always planning to honour Sean on his 90th birthday and on August 4, as well as marking our League Championship success before our game against Aberdeen, our supporters will come together to celebrate the huge contribution made to Celtic by one of the club´s greatest sons.”

  23. I don’t believe Celtic are silent on the New Club vote. Celtic are talking to all the other clubs constantly about it. And guess what – it is working. Three clubs declared, three no votes.

     

     

    As soon as Celtic go public anyone voting no will be seen as aligning with Celtic’s view point or being influenced by Celtic. Celtic’s silence is essential to allow the other clubs to be seen (justifiably or not) to be coming to their own decision and being respectful of their own fans’ wishes. Keep it up Celtic.

    I’m afraid this is an error in first principles. The opposite holds true: Employees are transfered to the new owner by default at the point of execution of the business sale agreement. Employees have to actively decline to be transferred under TUPE, in which case they are no longer employed by their former emplyer either.

     

     

    In essence, either the RFC plc players formally declined to be transferred to Sevco, or they are Sevco players. Given that talks are apparently continuing, one has to consider the possibility that the business sale may not yet be formally concluded.
