The chairman, the chief exec and Elvis

It is a measure of the impact someone has made that even after they have moved on, superstitions about them endure.  For some, there’s an almost religious believe that a huge figure cannot be diminished by retirement, loss of status or even death (there’s a special 1970s category for Elvis and Bruce Lee).

Prepare yourself: Peter Lawwell is not Elvis Presley.  He can’t sing like Elvis, he seldom dresses like him and under no circumstances should you confuse the supernatural powers attributed to ‘The King’ in the late 70s to our former chief executive.

Peter retired on appointing Ange Postecoglou in the summer of 2021, when Dominic McKay started his summer placement in charge.  By September, Michael Nicholson, previously company secretary and in-house lawyer, was temporarily then permanently given the top job.

18 months after he left, Lawwell agreed to replace Ian Bankier as chairman.  As Celtic’s representative, Peter was on the board of the European Club Association (currently vice chair) and was working with Uefa on the new Financial Sustainability Regulations.  It suited the club and our interests that Peter take the role, allowing him to extend Celtic’s influence at Uefa.

Back when Elvis’ died, football club chairmen carried executive roles.  They often opened the doors in the morning, did the accounts, sorted the banking and were always responsible for player contracts and budgeting.  The role has changed.  Lots.

In a modern PLC, a chairman is a non-executive, “unconnected with the day-to-day management of a business and which is instead concerned with effective management of the board”.  That means they are unconnected to player contracts, signing strategies or – and I cannot be clearer on this one – managerial appointments.

Such matters are reserved for the executive team and any major shareholders they are answerable to.  At Celtic, this is Michael Nicholson and Dermot Desmond.

Peter Lawwell was a huge influence in Scottish football and a significant figure in Europe.  Without him at the helm in 2012, Newco Rangers would have been voted into the SPL, debt free and ready to go again.  Back then I got some credit for starting a campaign on this issue, but take my word for it, all credit was due to Peter.  He fought and won the most intense battle Scottish football has ever seen, and like Keyser Soze, he left everyone searching in the shadows.

We scarcely got to see Dom McKay and Michael Nicholson has had two and a half years of low-profile management, a benefit of inheriting a club on the up.  As a consequence, when people think ‘Celtic board’ they assume Elvis lives.  In every meaningful way, Elvis has left the building.  He doesn’t sing the songs or choose the band.  If you think otherwise, you’re howling at the (blue) moon, and ironically, applying absolutely no pressure to the wound.

    I’m no moon howler and don’t subscribe to the view Peter Lawwell (PL) is in a position to significantly interfere in CEO Michael Nicholson’s duties but there are good reasons why supporters think he will have some influence on recruitment not just via his son but also on his past record , where good reasons exist to mistrust him and anything you say in his defence.

    ## As I said in intro I’m not a believer that PL rules the roost, one being I have met both he and Michael Nicholson and whilst MN is quiet by nature I don’t see him taking the job without putting certain assurances in place to retain his autonomy and self respect. I have heard of an instance where he has done that and know he was responsible for starting the process that saw reimbursed Res12 legal cost finding its way into The Foundation’s 2022 Christmas appeal.

     

     

    I think that during the years in pursuit of Res12 MN acted as honourably and truthfully as he could under direction.

     

     

    I wish I could say the same for PL in terms of honesty for the following reasons:

     

     

    R1. PL’s denial of seeing the 5 Way agreement at 2019 AGM has masked that he never answered the question in full where he was asked if anyone from Celtic was involved in 5 Way Agreement.

     

    Rather than answer that he laughed that he hadn’t even seen it and stood by that when question asked again at 2023 AGM.

     

     

    It stretches credibility too far to believe that no one in the executive team at Celtic played a part in the 5WA negotiations and PL was not kept abreast of its development. If that is true then they should all be sacked for the damage the 5WA has done to integrity of Scottish football.

     

     

    In the 5WA there was a clause R2ngers used to stop SFA doing any domestic investigation that required any contentious matters arising from 5WA to be referred to the Court of Arbitration for Sport. That was in 2012. In 2013 Res12 asked that UEFA investigate the process under which a UEFA licence was granted to Rangers in 2011.

     

     

    Why were shareholders not told UEFA could not be the adjudicating body and the matter would have to be taken up with CAS via the SFA rather than SFA only, confined to Scotland because of an Agreement Celtic accepted? If because no one at Celtic knew about the contents of the 5WA that is a sanctioning matter, if someone did know but said nothing that is a sacking matter.

    was handed over to PL and MN, witnessed by blogger James Forrest and CSA Vice President John Andrews. That was a meeting you declined to attend.

     

     

    Both witnesses can testify that the suggestion on document handover was the document should be taken to UEFA to either state UEFA FFP in respect of overdue tax had been observed in 2011 or there had been a breach and if the former then Res12 simply ends on basis of no breach.. If the latter, then Celtic have a problem.

     

     

    At the end of the 2018 AGM I was approached by John Andrews who said it was obvious Celtic had not acted on the information provided in August having used the argument it was an issue to be settled between the SFA and R2angers!

     

     

    R3 Subsequently at the 2019 AGM PL provided justification for removing shareholder locus to pursue Res12 stating that breaches of FFP in the monitoring period did not attract sanctions (like a license refusal ) until the following season.

     

     

    Whilst this is true, the breach did not take place in the Monitoring Period that started 26 May 2011 but in the Granting period ending 26th May and the document handed over in August 2018 would have proved (or not) that a breach had occurred in the Grant period had UEFA been asked to look at it.

     

     

    (The 2019 AGM is the same one that the half reply to the 5WA question was made, referred to earlier.)

     

     

    Truth and Reconciliation.

     

     

    Why your blog fails to change minds and is reflected in comments on it is the belief that PL misled shareholders in the pursuit of Resolution 12 from 2013 .

     

     

    In doing so trust was broken between The Board/PL and until that is addressed it renders your efforts at redemption that I would welcome with open arms ineffective.

     

     

    The full truth would be a more rewarding path and courageous path to reconciliation than half truths and dare I say it lies.

     

     

    So in that spirit I offer this in PL’s defence and in the pursuit of the truth in the hope of it resulting in reconciliation for not pursuing the justice and SFA reform that Res12 sought.

     

     

    It is possible PL may have been under pressure from Infantino at UEFA after May 2012 when PL wrote this letter to Regan at SFA, copied to Infantino at UEFA in respect of Rangers use of ebts.

    Infantino was in charge of the development of FFP so would know UEFA rules back to front. He would know about Art 47 requiring a “fair presentation” of accounts.

     

     

    Did the accounts Rangers provided from 2001 in respect of EBTS meet the fair presentation requirement, especially after 2005 when HMRC questioned their lawful use when asking about side letters to De Boer and Flo in respect of DOS Ebts and from 2007 when HMRC Determinations of tax owed due to Big Tax Case ebts arrived at Ibrox?

     

     

    Did those accounts for those years under HMRC question reflect a contingent liability arising from the questionable use of ebts with secret side letters?

     

     

    The money paid into EBTS was described in total in the Rangers accounts but not who to and for whom Rangers would be liable to pay unpaid back tax because of side letters that is a contingent liability with reasons..

     

     

    Attention to this aspect was drawn from a Court of Arbitration for Sport ruling on Giannina FC about overdue tax that uncovered the use of 5 private agreements with players not fairly accounted for under Art 47 of FFP and a further reason to refuse Giannina a licence see –

    Was PL under pressure from Infantino to keep the lid on the feared consequences of Rangers being granted UEFA licenses during all of the time they used ebts unlawfully?

     

     

    Is there a reply from Infantino to the May letter that explains me hearing “You do not want to bite the hand that feeds you” (without the hand being specified?)

     

     

    So if PL wants to lose his Elvis status as someone not to be trusted, I believe the only path is one of truth then reconciliation that can end of the toxic division that exists between the support and The Board and is a betrayal of the ethos of truth on which Celtic was founded .

  25. A great piece by P67, I am only sorry that I was not in a position to answer yesterday.

     

     

    It is all based on fact and not by the bile that drives those who spit out the names of PL, DD, ML, and the Strachans, on here and other forums.

     

     

    Celtic is in a strong position because of DD and PL, not despite them.

     

     

    The barrack-room lawyers, albeit starting out with good intention, made not one iota of difference to the outcome of the Ibrox club’s demise and its subsequent re-emergence with a new company number – Sevco Scotland trading as The Rangers.

     

     

    Res 12, 5 Way Agreement et al became a vanity and virtue-signalling sideshow that goes on to this day, twelve years later – a hammer to beat the Celtic board for apparently doing nothing -and still the dogs do not put down the bone. The whole thing is now as relevant as the anti-supporters of the GB and the mob that tarnishes our name singing about dead Rangers people and “joining the IRA” at home and away fixtures. Celtic (PL) of course was doing very important work behind the scenes and creating no ballyhoo, unlike the “we know better” mob, which gestured and ruminated in ignorance for its own amusement.

     

     

    Rangers did not receive adequate punishment for their actions, however the consequences suffered were far greater that we could have ever hoped for, or, demanded – starting up again in the fourth-tier, taking five years to climb back, badly wounded, to the top tier, years of banishment from Europe and all players who could command a significant transfer fee TUEPED out of the premises.

     

     

    Celtic didn’t get down into the hole with Rangers when the sh*t storm was raging, as many on here wanted; had it gone down that road we would have got splattered in a melee of “they said, we said” and the perception of the world at large would have been that it was an ‘Old Firm’ bust-up, or, even worse, that Celtic was intent on kicking its closest rival when it was down. Those echoes would still remain today.

     

     

    Finally it does no good at all to bring up the name of Dominic McKay as a stick to beat the board. He was lauded as a messiah, all past Celtic triumphs and successes were as nothing as soon as he entered the building. Those who fondly look back (and still post) on his ‘ten minutes’ at Celtic should remember the following facts. We lost Eddie Howe, a manager whom we had gone all in on, and James McCarthy was given a four year lucrative contract. Thirty odd trophies and being the most financially successful entity ever in Scottish sport apparently meant nothing. Peter Lawwell and Michael Nicholson stepped in and secured Ange and the rest is history. Dominic McKay was an oval ball in a round hole and his leaving was in the best interests of our club.

    Was Dominic McKay (who I have previous business experience of) managed effectively ? The chair was not a strong one at the time and DD was not so close to it all. If he had been on a tighter brief or better supported could it have worked ?

     

     

    Who negotiated the JJ and GG deals. These seem to have been flawed.
