Directors and shareholders in limited companies cannot be pursued by creditors under normal circumstances but special provisions exist for ordinary creditors and the tax authorities to pursue officers in a company if their behaviour transgresses acceptable standards.

The Social Security Administration Act 1992 allows HMRC to issue Personal Liability Notices to officers in a company for the recovery of company tax if they are guilty of fraud or “more serious levels of neglect”.

HMRC say:

Generally HMRC may consider a case to involve more serious neglect where it can be established that against a background of persistent failure to pay the contributions due the company was making significant and/or regular payments:

to other creditors

or

to connected persons or companies

or

in the form of director’s salaries

A case may also be judged to involve more serious neglect where ‘culpable officers’ have been associated with previous liquidated companies or other companies that have demonstrated a failure to comply with the statutory requirements of the Income Tax PAYE and NIC legislations.

While I am sure Craig Whyte has acted with the utmost probity Duff and Phelps early comments that Rangers used tax as cash to operate the company with will concern many.

Rangers accumulated £15m in tax debt during Whyte’s tenure.  In addition to his outstanding guarantees to Ticketus the Rangers owner will be alert that the administrators report could cast his actions in a poor light with respect to some of the above scenarios.

The £15m HMRC are demanding for this season is not cash Whyte received, Rangers used that money to fund a domestic and European football campaign.  Rangers owe that money and Craig Whyte is unlikely to forgo his security (Ibrox stadium) without his potential tax and Ticketus positions being covered.

Any attempts to resolve the matters surrounding Rangers which does not provide funds for this obstacle is doomed to failure.

  3. It is now incumbent on the SFA to hold an independent einquiry into the obvious fact that to reach the upper echelons of Scottish refereeing circles a person has to be of questionable character. This is the second season in a row that this has come to the surface. This can no longer be brushed off as paranoia, it is now fact that these guys are quite prepared to concoct, collude and lie to back each other and their appalling decisions up. We all know who started, and encouraged, the present set up and, lo and behold, this very week he still has the front to back up this behaviour by his followers and blame Neil Lennon prior to any investigation even being announced.

I don’t know if you watched and listened to the post Paul 67 of a couple of weeks ago when he asked us to chill out a little after a bad weekend and listen to the song ‘The Celtic Family’. This song written and sung by two bhoys ‘fae’ Dundee, Lochee actually has no bigotted words, connotations or sectarian message it only emphasises what Celtic and its supporters stand for. It was written by me and ‘melodeon dek’ played all the instruments,button accordian,base guitar,violin,acoustic guitar and mandolin. A copy was given to Neil Lennon at the last league match versus Dundee Utd. at Tannadice in December and a copy handed into Celtic Park for Tony Hamilton asking him to consider playing it at Celtic Park. To date he has not played it or replied to my letter. What does that tell us about the powers that be at Celtic Park. This offer was given with no strings attached. Is ‘The Celtic Family’ myth or reality. KTF.

    I’ve developed a wee theory that the reason why some folk do not like Neil Lennon, or worse detest him, is that he brings out the Neil Lennon in them.

     

     

    Did anybody hear that Motherwell supporter on Clyde, as he was describing how Neil Lennon acted I was envisaging his mood as he was making the point and the face I saw was the face of Neil Lennon that the caller was describing.

     

     

    Neil Lennon holds up a mirror to some people and when they react with the venom in that call it is because he reflects what they detest about themselves but are unaware of what their reaction is telling them.

     

     

    They have to be to expose their ugly inner selves to the public.

    The report I read said other Hearts fans tried to set fire to the banner at the Motherwell bowling club.

     

     

    It’s not clear if it made it to Hampden.
