Cost to acquire Ibrox likely to be high

Directors and shareholders in limited companies cannot be pursued by creditors under normal circumstances but special provisions exist for ordinary creditors and the tax authorities to pursue officers in a company if their behaviour transgresses acceptable standards.

The Social Security Administration Act 1992 allows HMRC to issue Personal Liability Notices to officers in a company for the recovery of company tax if they are guilty of fraud or “more serious levels of neglect”.

HMRC say:

Generally HMRC may consider a case to involve more serious neglect where it can be established that against a background of persistent failure to pay the contributions due the company was making significant and/or regular payments:

to other creditors

or

to connected persons or companies

or

in the form of director’s salaries

A case may also be judged to involve more serious neglect where ‘culpable officers’ have been associated with previous liquidated companies or other companies that have demonstrated a failure to comply with the statutory requirements of the Income Tax PAYE and NIC legislations.

While I am sure Craig Whyte has acted with the utmost probity Duff and Phelps early comments that Rangers used tax as cash to operate the company with will concern many.

Rangers accumulated £15m in tax debt during Whyte’s tenure.  In addition to his outstanding guarantees to Ticketus the Rangers owner will be alert that the administrators report could cast his actions in a poor light with respect to some of the above scenarios.

The £15m HMRC are demanding for this season is not cash Whyte received, Rangers used that money to fund a domestic and European football campaign.  Rangers owe that money and Craig Whyte is unlikely to forgo his security (Ibrox stadium) without his potential tax and Ticketus positions being covered.

Any attempts to resolve the matters surrounding Rangers which does not provide funds for this obstacle is doomed to failure.

  7. Like many, I’m not happy with the outcome of the Judicial Panel Tribunal today.

     

    If this is yet another pair of match officials found lying to our manager then what are we doing cutting any deal with them.

     

    I can only hope the truth comes out, but these two should never again officiate at a match where the result of that match affects Celtic.

     

    P.S. Not only does Neil risk life and limb for our club, he also risks his sanity.

     

    He deserves 100% support from each and every one of us and we should be proud that he leads our club.

  8. Celtic stating they are happy confuses me,we have them dead to rights,lying again,linesman to Ref,and fourth official.

     

    Unless we have been given assurances re the next NL case and the Newco saga,then I’m afraid as a Club we are easily pleased.

     

     

    I would have preferred we forget the potential ( if they exist ) assurances and go for dismissal of the officials involved plus request comparison justifications vs other mgrs for similar offences.

  10. I agree with those unhappy about Celtic’s official reaction. Maybe they’re waiting to see the outcome of the other tribunal. So far as has been made publicly known, there is no proof that Brines and Murray lied, at least as far as the tribunal is concerned. If this has been proved, Celtic CANNOT let the matter rest. Sacking them both is just the starting point. I would demand serious financial compensation for being cheated by those same officials. That surely would be the SFA’s punishment, as they provide the officials.

  17. Just think the retirement age for referees has been cancelled, now we can have Brines, Collum, Murray, O’Reilly for a lot longer. Remember always they will be measured on :-

     

    – their fitness

     

    – their ratings

     

    – their ability to give penalties to Rangers ( or any other Newco)

     

    – their ability to send off Celtic players in big games, Ibrox, Tynecastle are marked highly.

     

    – their ability to lie and make major mistakes when reporting on any game involving Celtic

    I think a deal has been done, that’s twice SFA officials have been caught lying and cheating now.

     

    Celtic will i’m sure have other evidence of their bias and the SFA may or may not have knowledge of such.

  20. very bemused by our official reaction here, hoever we have not seen or heard any concrete evidence of lying. I too think there is more to come and so far by saying next to nothing, our club is not playing the game too badly.

     

    Do I think they lied ? probably but what I think does not matter. Keep playing the long game is the correct way.

If any of the lying cheating MIB’s ….. ever… ever are involved in any game that has an affect on CFC then the whole game of Scottish football is a bogey, if I was a bookmaker I would refuse bets on Scottish football, its fraudulent and there’s a cost to pay for cheating if its deliberate.

    David Whitehouse, joint administrator, said: “We have had a series of constructive discussions with bidders. We have made it crystal clear to them all that to announce a preferred bidder we need definitive, unconditional bids on the table.

     

     

    “It is also important to let fans know that at this stage there is a world of difference between people indicating their intentions – even though they are well meaning – and putting them in black and white.

     

     

    “We understand there are complex issues for bidders to deal with and we do not doubt that all parties want to attain control of the football club. We understand also that those interested in buying the Club are working hard to resolve all outstanding issues.

     

     

    “We are continuing to make representations to all stakeholder groups – including the football authorities – to give clarity on outstanding issues which will help existing bids move to unconditional status.”

     

     

    Unconditional bids with still so many unknowns is madness!

     

     

    The earliest they will get any clarification from the SPL is 30 April, and I’m sure the SFA will not be in a position to give any cast iron guarantees even then.

     

     

    What about the outcome of the BTC?

     

     

    The panic coming from the Double Ds is palpable, and they know that if they can get a PB on board, they can continue to hold out some hope of a CVA, and delay the inevitable for a short time.
