Directors and shareholders in limited companies cannot be pursued by creditors under normal circumstances but special provisions exist for ordinary creditors and the tax authorities to pursue officers in a company if their behaviour transgresses acceptable standards.

The Social Security Administration Act 1992 allows HMRC to issue Personal Liability Notices to officers in a company for the recovery of company tax if they are guilty of fraud or “more serious levels of neglect”.

HMRC say:

Generally HMRC may consider a case to involve more serious neglect where it can be established that against a background of persistent failure to pay the contributions due the company was making significant and/or regular payments:

to other creditors

or

to connected persons or companies

or

in the form of director’s salaries

A case may also be judged to involve more serious neglect where ‘culpable officers’ have been associated with previous liquidated companies or other companies that have demonstrated a failure to comply with the statutory requirements of the Income Tax PAYE and NIC legislations.

While I am sure Craig Whyte has acted with the utmost probity Duff and Phelps early comments that Rangers used tax as cash to operate the company with will concern many.

Rangers accumulated £15m in tax debt during Whyte’s tenure.  In addition to his outstanding guarantees to Ticketus the Rangers owner will be alert that the administrators report could cast his actions in a poor light with respect to some of the above scenarios.

The £15m HMRC are demanding for this season is not cash Whyte received, Rangers used that money to fund a domestic and European football campaign.  Rangers owe that money and Craig Whyte is unlikely to forgo his security (Ibrox stadium) without his potential tax and Ticketus positions being covered.

Any attempts to resolve the matters surrounding Rangers which does not provide funds for this obstacle is doomed to failure.

    I understand Hassan’s solution because I can empathise with his perspective. He is quite right to say that this level of uninvolved also-rans competing against an ever more dominant big two is a package for losing fans.

     

     

    However in order to promote his sole solution, namely the Big Two (soon to be one) give their money to strengthen the rest, he dismisses all alternatives as “not going to happen”. However, he fails to sell what’s in it for us.

     

     

    We, Celtic, are about to enter a period where we can make some inroads into the title and trophies lead that Rangers have over us because they have cheated and financially doped their way to success. Any handing over of our money to promote competition will harm our aims for success and aids our competitors, including the soon to be weakened Rangers, Newco, or even a resurgent Hearts.

     

     

    With he state of Scottish football finance, we will be lucky to remain competitive in Europe during this next period of overall downsizing. If we give our money away, all we will achieve is to make a mediocre league harder to win. It will not restore any Golden era.

     

     

    My favoured solution remains for Celtic to get out. The SPL is too limiting for our ambitions but, if we have to remain, I want the payback of a lengthy list of league wins till we get parity and overtake their record.

     

     

    I cannot see merit in Hassan’s solution but it is a good provoking argument.

    I think that most of us would agree that Celtic getting out of Scotland is the best solution all ways round.In the absence of that being realistic in the near term, the prospect of us winning 20 or so league titles in a row will wear thin for everybody including us. Probably too early for that discussion just at the moment – maybe a few league titles down the line and we will all be craving some real competition.

     

     

    I remember us blitzing teams by 4,5 or 6 on a regular basis in the early MON years – it became uninspiring after a couple of seasons…

    I know what you mean – but at the same time, Parkhead became like a chapel with a few sweety papers getting rustled when the 6th or 7th went in.

     

     

    I will enjoy overtaking their tainted trophy haul as much as the next Tim, but I am sure it will all get a bit tedious in the not too distant. I am not advocating leniency for phoenix huns in any way shape or form, but it would be better all ways round if Hearts, Dundee Utd or Aberdeen could give us a run for our money.

    I don’t remember being bored by our 9iar or that our attendances dropped off. Maybe it would have been the 10th or the 11th or 12th that would have seen ennui set in but I doubt it.

     

     

    Of course if you set the predictive target at a ludicrous level, such as 20iar, you will get agreement. But has any team ever won 20 league titles in a row in any country in any sport? Unlikely.

     

     

    I cannot foresee too far in the future but I would be surprised if our dominance is so great that we will win the next 10 SPL titles even if there are 10 more SPLs to be won.

     

     

    I also don’t recall the boredom of 5:0 victories and moaning that it should have been 7. In fact, I genuinely recall more moaning when we struggled or lost or drew during the MON era. We never managed more than two titles in a row under MON so there was never the dominance you have mis-remembered.

     

     

    If we have to stay in this mediocre level of competition, then I can do with another 9iar. I can guarantee I will enjoy and thrive on it.

    This is a ramble, a mea culpa, ignore at will.

     

     

    The “Hard Man” idolatry in the Scottish Psyche

     

     

    That would be a thesis to present. I suspect many on here were victims, observers, or pretenders to that paradigm.

     

     

    Truth for me? I’ve met very few hard men in my life, and the ones I met were unpleasant characters, people I wouldn’t want to spend time with.

     

     

    I disassociate them from strong men, whom I knew a plenty, but – in contrast – knew themselves, their principles, and stood by them.

     

     

    What’s this got to do with Celtic? Underpinning strength, is integrity; a harsh self-analysis and honest appraisal that recognises strengths and weaknesses. This type of strength yields a tough gentleness, a confidence that enables the bearer to be softer than cotton, in the knowledge that – come the crunch – they won’t yield. This allows for a welcome, and openness to all, because there is nothing to fear. Celtic is, for me, an immigrant club, supported by immigrants and Scots who align themselves to inclusiveness. More than a club.

     

     

    I like to think I’m gentle, but I never mastered the integrity and therefore the toughness.

     

     

    Here’s the mea culpa bit.

     

     

    In Scotland, when you’re growing up, you’ve got to be either big, funny, or fast. I was neither of those, but I couldn’t take intimidation. I cracked the survival code at school, I don’t remember the age. One big Davy, wanting to make an example, chose me.

    Few weeks later early shift , i was stopped by Super cops on my way to work.

     

     

    No offences, didnt ever drink when having to drive early next day.

    There’s a line between anti-football and just not being as good as Barcelona. Although no side really is, they can be got at, as RM and Chelsea, and indeed the Spanish league sides who have taken points off them have proven. We’ve done it against Barca, been adventurous, made a game of it, and ultimately you and I would be fairly pleased if we beat them 1-0 in a EC semi. I think the anti-football thing is more a thems at home to Man U or Stoke every week – a steadfast refusal to play the ball on the deck, precious little passing, hoof it up front or out the park – Chelsea were a bit more than that, and with their calibre of player darn well should be – just a million miles away from being the footballing side Barca is.

     

     

    As someone once said, a two-legged cup-tie is a one-off – Chelsea are better in the EPL. Last night was just the epitome of La Liga being better than the EPL.

    You have to admit, the bleedin obvious; Barca are the finest – and most attractive – football team in Europe (and possibly beyond, I dont know).

     

     

    Playing anybody but Celtic, I want them to win, just to watch more of what they do – which I can’t quite work out.

     

     

    You can’t blame teams for deploying strategies and tactics which recognise this. Sometimes they’ll get lucky, somtimes they won’t. I still want the Barca style to triumph.

    I could never bring myself to use it. Despite the angst, the frustration and yes the downright anger that the little cherubs sometimes stir within me, I could never hit them with a bit of leather, no matter how much good I would think it would do.
