Cost to acquire Ibrox likely to be high

Directors and shareholders in limited companies cannot be pursued by creditors under normal circumstances but special provisions exist for ordinary creditors and the tax authorities to pursue officers in a company if their behaviour transgresses acceptable standards.

The Social Security Administration Act 1992 allows HMRC to issue Personal Liability Notices to officers in a company for the recovery of company tax if they are guilty of fraud or “more serious levels of neglect”.

HMRC say:

Generally HMRC may consider a case to involve more serious neglect where it can be established that against a background of persistent failure to pay the contributions due the company was making significant and/or regular payments:

to other creditors

or

to connected persons or companies

or

in the form of director’s salaries

A case may also be judged to involve more serious neglect where ‘culpable officers’ have been associated with previous liquidated companies or other companies that have demonstrated a failure to comply with the statutory requirements of the Income Tax PAYE and NIC legislations.

While I am sure Craig Whyte has acted with the utmost probity Duff and Phelps early comments that Rangers used tax as cash to operate the company with will concern many.

Rangers accumulated £15m in tax debt during Whyte’s tenure.  In addition to his outstanding guarantees to Ticketus the Rangers owner will be alert that the administrators report could cast his actions in a poor light with respect to some of the above scenarios.

The £15m HMRC are demanding for this season is not cash Whyte received, Rangers used that money to fund a domestic and European football campaign.  Rangers owe that money and Craig Whyte is unlikely to forgo his security (Ibrox stadium) without his potential tax and Ticketus positions being covered.

Any attempts to resolve the matters surrounding Rangers which does not provide funds for this obstacle is doomed to failure.

  7. Ten Men – cheers, I hope you are right. Once upon a time in a land that time forgot the managers and officials would have been brought together for a day or two pre-season to ensure everyone knew what was and wasn’t acceptable.

     

    What goes for Neil Lennon has to go for Brown, Mccall, Butcher, McCoist and the rest. At least in the Land of Make Believe that’s what happens.

    I made it clear that I was as ignorant as most on the blog as to how the decision was reached yesterday re Neil’s 2 issues at the SFA.

     

     

    I made it clear that equally ignorant (as me) folk on here jumping to conclusions that the club representatives, management or CEO were in some way caving in to the SFA and letting the support or club down, was ridiculous when they had no evidence of this whatsoever.

    I would echo the RIP for Levon (Buddy Rich’s favourite rock drummer), but there are still two great voices left. The voice of Robbie’s guitar and Garth’s all round musical genius. The brass orchestration for “Unfaithful Servant” is exceptional.

  15. Hi, guys, just thought I’d pop in and give you a few of my thoughts.

     

    Congratulations on winning the League, no complaints from me, the table never lies. You may have a rush of them now I’m afraid.

     

     

    Very careless though losing the two cups, I’d think you would agree that was a poor show by your team, the treble was there for the taking. Then again, as with the League, you may get a few soon, with challenges almost non existant for probably a decade..

     

     

    As to your manager, who by his actions, have relegated your achievements, sorry achievement, to a side note.

     

     

    I have a suggestion for Neil Lennon, a genuine heart felt suggestion.

     

     

    Neil needs an image consultant, honestly.

     

     

    People keep saying away from football he is an intelligent,humourous kind of chap. I think they may have a point because I remember my 5 a side days when sometimes I would turn from a quiet inoffensive office type chap into a raging four letter animal, threatening physical abuse to my opponent, often some of my close friends. Thank god there were no referees, and the rows we would have if it was a goal or not. That was not in, it was past the jaicket, no it wis’nae, it was inside the jaicket. Great days.

     

     

    Neil needs to show the humourous side of himself to us more often, crack a joke, smile, chill. Take a step back from his combatitive nature on TV, it is doing his image no good at all.

     

     

    He needs to get rid, or even temper, the nasty side he shows all too often at the side of the pitch, and in press conferences. Chill, Neil.

     

     

    Be honest, he has even had a go at some of his own supporters at the side of the pitch, if he does that again, one day it might rebound on him.

     

     

    I actually would like to meet the man , buy him a pint, and have a chat with him.

     

    Just to find out the man behind the snarl. I’d advise him if he took my advice life might just become better for him and he might just convince the neutral fan he is a very nice man.

    It’s just amusing is it not? If Neil did crack jokes and have a more casual manner the press would slate him for not being serious enough in his role as Celtic manager. It would NOT matter what Neil Lennon does he would be vilified. The media have their bad man and like to paint the picture daily and print pictures of a snarling man. This country sickens me daily.

     

    What they are doing however is giving Neil Lennon the materials for the most explosive football book ever written. He should tell his full story, open honest and give the truth to all us Tims who only have a slight idea of what it must be like to live in his shoes. I think Neil should moot the idea just to see the journos sweat and panic.

    Once again I have to apologise for being a terrible host. The number of unmoderated replies piles up, readers become frustrated at the lack of updates, and I have started receiving complaints saying that I am letting people down with teasing with promises of exposés that are always in the future.

     

    On the moderation issue, I put my hands up. Between real life and researching materials for this project, it leaves me with little time to participate in discussions let alone referee them. All I can say just now is ‘sorry’, but there is not a lot I can do in the short-term. If someone wants to start a messageboard to allow the various discussion topics from here to be handled by a larger number of people, we can talk about how we could manage this technically. If seriously interested, let me know. However, I can see this presenting difficulties and distracting from the blog itself- which (no surprise) is the bit I like most, but this project has grown to become something in which many people have an emotional claim. So I am open to ideas from anyone who thinks they can solve the concurrent problems of my penchant for privacy, the need to have several people act as moderators, and maintaining a sense of togetherness for both blog and replies.

     

    On the charge that I am not delivering on the teasers that I throw out, I have always said that most information will be withheld until after the FTT findings are published. Nothing has changed. Do not expect a deluge of information in FTT+1. There is value in timing the release of information to apply pressure on those who would rather that this story not be told.

     

    Be assured that there is a lot of information to come out. Some will come out in the mainstream press, some on here and other blogs, and other details will be best explained in a book. Just be patient. Pulling a lot of disparate threads apart to understand what has happened at Rangers over the last decade has been exhausting. The hit-and-run nature of Twitter has made it easier to try to communicate while doing several different things at once- and I did throw out some new information about the extent of Rangers’ use of the EBT scheme- How many players in the Rangers squad (1st team and subs) that won the SPL title on the last day of the season on 22 May 2005 had an EBT? That is correct- every single one of them.

     

    Most commentators on this saga believe that Rangers will be found to have acted illegally and were breaking UK tax law in their implementation of the EBT scheme. If / when this is formalised, the SFA & SPL face an issue which cannot be parried away without causing permanent damage to the Scottish game. The widespread use of the EBTs at Ibrox means that there cannot be any serious debate that Rangers fielded players who they could not afford during this period. Using illegal means to fund their playing staff was cheating. It is that simple. If by some miracle a CVA happens and Rangers survive intact or if the SFA/SPL allow Rangers’ membership share to be transferred to a newco, then punishment must be meted out. That punishment must be proportional to the fact that other clubs suffered huge financial losses as a result of that cheating. The punishment must also include consideration of the damage to the reputation of the Scottish game as well. Anything less and there will be little point in watching Scottish football. Anything less and it will be clear that it is a rigged game with a tilted table and loaded dice- all for the benefit of just a single club.
