Gang of 10 Arab Spring rebuked by Duff & Phelps

Comments from Duff and Phelps yesterday that they were not in favour of changing the SPL voting system were intriguing.  Kilmarnock chairman, Michael Johnston, was pretty blatant about his agenda when speaking to the BBC on Saturday, suggesting the actions of the Gang of 10 was a “pro-democracy movement” similar to the Arab Spring, saying:

“It might make it easier for the [Rangers] administrators to get whatever they are going to try to achieve whether it is a CVA or new company to be informed and re-joining the SPL and SFA.

“The support of the 10 clubs might be needed at some point.”

Too right the support of the other 10 clubs might be needed at some point if a new company is to join (not re-join, for goodness sake!) the SPL and SFA.

Back in October last year we predicted Rangers would be liquidated, a Newco would be formed and would be voted straight into the SPL, with only Celtic arguing the need to maintain sporting integrity.  Everything we have heard since has reinforced this view.

The debate among the Gang of 10 has matured so far they see no issue in openly offering to support a Newco’s entry into the league in return for money (which we predicted earlier this month), mostly generated from Celtic fans, as it happens.

We await Johnston responding by sticking to his high-minded principles and telling any Newco they will not enjoy Kilmarnock’s support.

Duff and Phelps still have an enormous amount to achieve before they will even be in a position to apply for entry to the SPL on behalf of a Newco but if they do, they will surely offer the Gang of 10 a take-it-or-leave-it proposition. The Gang of 10 will take it. This debate is not about democracy, it’s about directors at clubs like Kilmarnock, who I believe now have debts of over £10m, finding a way to deal with their years of unchecked overspend.

The debate around St Mirren director, Ken McGeoch, would surely outrage sensibilities in any country in the world so I’m pleased his fellow directors have called for his resignation.  In November last year McGeoch invited Rangers company secretary Gary Withey to a meeting at the St Mirren boardroom where he revealed player contract details.

St Mirren are up for sale and could be purchased for what previously amounted loose change at Ibrox; McGeoch met Withey to discuss him purchasing the club from his fellow directors and shareholders.

For a Rangers director, influence like that should be impossible to acquire.

There is now a small part of me that would like to see these nutters actually succeed in taking over Rangers so that we can enjoy the hilarity for a few months before they plunge back into administration. I’d expect lots of bizarre, meaningless press releases for us to laugh at featuring words like “dignity”, “honour”, “pride”, “institution”, “decorum”, “noble”, “surrender” and “no”.

    Craig Whyte tells Duff and Phelps he would rather see Rangers go into liquidation than sell to Paul Murray

    CRAIG WHYTE yesterday promised Rangers’ administrators he would rather see the club go into liquidation than sell his shares to Paul Murray’s Blue Knights.

     

     

    Record Sport can reveal the men from Duff and Phelps were locked in emergency talks with Whyte, left, in London last night in a bid to force him to back down from his stance that is pushing the club closer to oblivion.

     

     

    They believe they can still put a plan in place that would appease Whyte and clear the way for Murray and his group to takeover.

     

     

    But while those talks were ongoing an increasingly frustrated Murray was left to consider withdrawing his rescue bid for the stricken SPL champions unless Whyte’s majority shareholding can be secured legally through the courts.

     

     

    The administrators’ failure to forcibly remove Whyte means the disgraced owner still technically clings to enough power to veto any offer for shares.

     

    Last night administrator David Whitehouse arranged a hurried meeting with Whyte and was desperately attempting to persuade him to act in the best interests of the club.

     

     

    Whitehouse emerged from those talks confident a “structure” can be arranged that would allow Whyte’s shares to be handed over although possibly not directly to Murray.

     

     

    But with no watertight agreement in place, ex-director Murray remains understandably concerned. He fears proven liar Whyte will not back away from his stance, even if it results in Rangers going out of business.

     

     

    Murray was binned from the board by Whyte last year after mounting furious opposition to the takeover which has proved to be the most disastrous deal in the club’s 140-year history. And as the drama unfolded a dispirited Murray told Record Sport: “There have been conflicting reports in recent days about the validity of Whyte’s position.

     

     

    “I’ve spoken to the administrators about this today and been told by them that Whyte is not prepared under any circumstances to sell his shares to my consortium.”

     

     

    It is understood these circumstances would even include the threat of Rangers going into liquidation.

     

     

    Murray added: “The administrators have told me they are prepared to take legal action to deal with this issue.

     

     

    “While I was pleased to hear them say that, as things stand the Blue Knights cannot be successful. I have little choice but to consider our position.

     

    “What is the point in us presenting a bid we know will not be accepted?

     

    “Unless I can legally obtain Whyte’s shares I cannot enter into discussions about how best for the club to exit administration through a CVA (Company Voluntary Arrangement).

     

    “This is fundamental to our plans to stop the club going into liquidation. While I am hugely disappointed in Whyte’s actions I can’t say I’m surprised due to the reported many liaisons between Craig Whyte and the previous owner last year”

     

    Despite the administrators writing Whyte off as an “irrelevance” Murray believes the Blue Knights’ bid will be dead for as long as the Motherwell man is still entitled to call the shots.

     

    Murray’s bid has received the backing of the club’s three major fan groups but yesterday’s developments mean it could be left to one of four other bidders to strike a deal with Whyte and stop Rangers being plunged into liquidation.

     

     

    But that too could prove difficult as Record Sport understands the Blue Knights’ cash offer was the second biggest – bettered only by a Chicago-based consortium which includes Club 9 Sports and parent company Prometheus.

     

    The only other serious contender at this stage is Edinburgh-born millionaire Brian Kennedy but his financial package falls short of the amount the Americans have pledged to plough into a CVA pot.

     

    The administrators say they have received a fourth offer from an unnamed UK group and have also been in talks with a consortium from Singapore, fronted by Glasgow-based businessman Shazad Bakhsh.

     

    But neither of those bids are believed to be among the front-runners and both could be eliminated in the coming days as Duff and Phelps attempt to compile a short-list of preferred candidates.

     

    Murray and his Blue Knights had been almost certain to make it to the final cut but Whyte’s threat to block their bid has thrown a major spanner in the works.

     

    And that will infuriate the club’s supporters, many of whom have been pinning their survival hopes on Murray.

     

    A source close to the discussions said last night: “The next 24 hours could prove critical to the club’s chances of staving off liquidation especially if O.G Rafferty of CQN fame is on the money.”

     

    “Paul Murray has been firm on his position that the Blue Knights want to exit administration through a CVA and protect 140 years of Rangers’ history.

     

    “Brian Kennedy has made it clear he would attempt to do the same thing. But we know little about the intentions of the others and that is a major concern.”

     

    To further complicate matters, there is a pressing need for the administrators to accelerate the process amid growing fears that more delays could make it almost impossible to prevent liquidation.

     

    Our source added: “The timescale is also becoming a serious concern. Legally, the process of putting a CVA together demands a 28-day period during which any creditors have the right to appeal.

     

    “There are a great deal of other aspects that must be attended to quickly. Unless a takeover is concluded in the next two weeks it will be very difficult for any new owner to avoid a liquidation scenario and the more dirty linen that is revealed the quicker Craig Whyte might be prepared to do the previous owners dirty work for him. That will depend on what fees have been arranged between the two business men”

    Lafferty claimed Rangers have a batter squad in the aftermath of the latest Old Firm clash

     

    ALAN STUBBS has urged Celtic to win the SPL by a record margin and ram Kyle Lafferty’s boasts down his throat.

     

    The former Hoops defender afforded himself a wry smile when he read Lafferty’s withering put-down of the champions-elect.

     

    In the wake of Sunday’s Old Firm victory, Northern Ireland international Lafferty claimed Rangers are the best team in Scotland.

     

    Despite Celtic currently holding an 18-point lead in the title race, he also suggested they are bottle merchants when it comes to the crunch.

     

    It is not the first time we have been down this road as there have been a host of Old Firm players prepared to talk the talk only for the trophy count at the end of the campaign to suggest they’ve been unable to walk the walk.

     

    Kris Commons’ bold pronouncement last term that Celtic were younger, fitter and stronger also came back to haunt him when they failed to end their bitter rivals’ stranglehold on the SPL title.

     

    While Stubbs has no doubts Lafferty’s comments were made to stir up a reaction across the city, he feels the best response will be for Celtic to eclipse Rangers’ record SPL winning margin of 21 points, achieved under Dick Advocaat in season 1999-2000.

     

    Stubbs, now on the coaching staff at Everton, believes that has to be the target for Neil Lennon and his players.

     

    He said: “Celtic would still be well ahead even if Rangers hadn’t been deducted 10 points and you can’t lose sight of that. Certain players have a habit of shouting their mouths off. That’s just the way they are.

     

    “I’m sure when Kyle Lafferty looks back he will realise the best team are currently sitting at the top of the league. Rangers are a long way off the pace and I think for Celtic’s sake it would be good if they won the league by more than 10 points.

     

    “If they don’t then the deduction will be mentioned at every turn when you look back at this season. Lenny and the boys will be desperate to win the title by as many points as possible.

     

    “They will be hurting after the weekend as it was a convincing win for Rangers. They will be desperate to win the title by a record margin.

     

    “That has to be the aim. That’s the best way to answer what Lafferty has to say for himself. Do your talking on the pitch, not in the papers.

     

    “If Celtic win the league by the biggest margin then there can be no dispute. You don’t have to say anything else because the table will speak for itself. If I was the manager, that would certainly be my target between now and the end of the season.

     

    “The players will be down after Sunday and this taunt will be the ideal motivation for them. The result at the weekend enabled Rangers to win back a bit of pride and there is no doubt they outplayed Celtic.

     

    “They were first to every ball and rose to the occasion whereas Celtic didn’t. Given all that’s gone on recently you can probably understand players trying to get a fly dig in.

     

    “There has been so much turmoil at Ibrox and emotions are running high. If the boot was on the other foot, I’m sure it would be exactly the same.”

     

    Winding up the opposition and mocking their achievements has long been a part of the Old Firm experience.

     

    Former Rangers striker Nikica Jelavic was also at it earlier this season when he infamously claimed the title race was over after Ally McCoist’s players surged 15 points clear in October.

     

    Going back 12 years to a squad that featured Stubbs, Parkhead assistant boss Johan Mjallby waxed lyrical about how Celtic were a class apart on the eve of a Glasgow derby only for Rangers to promptly stuff them 4-0 at Ibrox.

     

    But Stubbs says Mjallby, Commons, Jelavic and Lafferty would all struggle to hold a candle to motormouth Jonathan Gould. He revealed the Celtic players used to dread picking up the papers on the morning of a big game if the likeable big keeper had been speaking to the press.

     

    He said: “Every time Gouldy spoke to the papers we used to think, ‘Oh no, what has he said this time?’

     

    “He was one of the nicest guys you could ever wish to meet but he just couldn’t help himself. He used to come away with some belters and just had this habit of putting his foot right in it.”

     

    Despite Lafferty’s latest assertion about Celtic’s lack of mental resolve in big games Stubbs has no doubt they will be worthy champions.

     

    He added: “When Celtic trailed 3-0 at Kilmarnock earlier in the season there were a lot of people starting to doubt Lenny.

     

    “Those were testing times but he responded magnificently and I think he learned a lot from that about how to be a manager.

     

    “The team have responded to him incredibly well and that is what has effectively won them the league.

     

    “To win 19 games on the trot in any league in the world is impressive and to say they haven’t got any bottle is just being churlish.

     

    “Celtic will be crowned champions because they are the best team in the country. The league table doesn’t lie.”

    Unless I am wrong ( which isn’t unusual , according to the wife)

     

    Does the publication of a second contract not prove that they didn’t disclose full details of players payments to the SFA and so played players not properly registered in many of their games , over several years. Why then is it taking so long to punish them accordingly.

     

    Really need some answers and soon , this stinks of the biggest cover up / whitewash in scottish football history.

  28. The saga of the cash strapped southsiders would be hilarious was it not so serious.

     

     

    The fans group after all of their great fundraising have enough to pay a couple of wee bills. Well, it’s a start I suppose. If they keep going for another few hundred years or so they should be able to pay them all off.

     

     

    But what gets me is how they think they can choose which bills to pay. Now surely the money has to go to the administrators who, in theory at least, are working in the interests of all creditors?

     

     

    And this SFA hearing today would be a great place to have a hidden camera. I’d love to hear the admins argue that Rangers did nothing wrong, it was all their legal owner’s fault. Imagine the precedent that would set if applied as a legal principle. No company would ever be liable for anything; it would all be down to the owner.

     

     

    It’s about time the guys from the Tribunal got their collective fingers out at published the Big Tax Case decision. That will bring all these hopes of a plan to save the club to a crashing halt.

    For a kick-off, HMRC have taken them to FTT(Tax) on the BTC. They also forced them into administration over a separate tax bill for unpaid PAYE/NIC, and are pursuing the wee tax case over the DOS. That doesn’t strike me as “inaction”.

     

     

    WRT the footballing authorities, remember all the times we have said of the SFA, justice must be done, but must also be seen to be done? The same rings true here.

     

     

    The potential ramifications of the undisclosed payments issue are huge. The rules are clear: where a player receives football payments which have not been disclosed to the SPL and SFA, that player has not been registered properly with either the SPL or the SFA. Every game in which an improperly regsitered player has been selected results in a 3-0 loss for Rangers. The solicitors have to go throguh the paperwork and reconcile what has been disclosed to the SPL with what has actually been paid to rangers players going back 14 years. That’s almost certainly more than £300million of wages to get through. Then you have to look at rangers team sheets for 14 years worth of SPL fixtures. Also, players contracts change, so player x on an EBT until 2007 would be ineligible (potentially) but not all the way through their time as a Rangers player. Accordingly, the reconcilliation exercise is complex and necessarily time consuming. If there is to be public confidence in their findings, Harper MacLeod have to be seen to be taking their time. Moreover, the appoitnment of an indepedent commission, probably chaired by a Law lord, will look at the report and determine further investigations or possible sanctions. This is also likely to take time but, in the context of securing public confidence in the eventual outcome of the process, this is time well spent.
