Irony behind robust SFA rules

The statement released by Duff and Phelps last night revealed the substance to the lobbying that had taken place since the original punishment handed out by the SFA judicial panel:

“The decision by the appellate tribunal to uphold the sanction, namely the suspension of registration of players for one year, is not competent in the view of the club and its legal advisers.

“Such a sanction was not available to the tribunal”.

The suspension of player registrations was not one of the suggested punishments on the menu for the judicial panel but the rules allowed them to vary from guidance and choose whatever punishment they believed appropriate.

The appeal correctly found that the judicial panel were not were not subject to an exhaustive list of possible punishments.  Duff and Phelps main hope was that the SFA rules were unclear and poorly constructed, as they were before an overhaul last year.

You don’t need to look too hard for the irony.

    Have to say I enjoyed reading the article on the bbc about the rangers supporters assembly spokesman andy kerr having the gall to believe they are in any position to be making threats to anyone.

     

     

    I was only having a conversation with my brother an hour ago about their supremicist reaction to any punishments handed out to them.

     

     

    I thought the placards reading ‘SFA Sanctions cost Jobs” being marched by the hoardes en route to Hampden was the most hilarious I was going to see.

     

     

    In reference to a £140k fine and 12 month signing ban for cheating and refusing to pay taxes.

     

     

    No mention of the list of creditors, the length of your arm out thr front door down the street and stretching around the corner.

     

     

    But for Andy Kerr to threaten to call on Rangers to withdraw from the Scottish Cup at a time when entering the Scottish Cup in the 3rd Round is starting to look like the best case scenario for them…

     

     

    For Andy Kerr to threaten to call on Rangers to refuse to allow players join the Scotland squad at a time when it has just been revealed that all of the scottish internationals have savagely reduced transfer fees due to be enabled within the next 2 weeks…

     

     

    For Andy Kerr to threaten to boycott what is looking very possibly to be grounds with capacities that do not exceed 2-3k people tops – the likes of the Stranraers of this world…

     

     

    Better still – he is making threats on behalf of a football club whose entire future existance is out of their own hands…

     

     

    This supremicist mindset just makes the mind boggle it really does.

    I just realised what an almighty legal nightmare this is going to be for everyone involved. When the balloon goes up, what a fight this is going to be.

     

     

    The punishments, and consequences, of “being Rangers” are only going to mount up. The NewCo route is attractive to them, in a sense, but only in terms of their ability to escape the punishments they are due.

     

     

    But what happens if those punishments “follow” them?

     

     

    HMRC cannot, normally, chase a Newco. But when that NewCo has the same name, same corporate logo, its “corporate history”, its trading stamp, a similar employee pool and retains the better part of its customer base, with any number of long term previous deals still “standing”, what happens if HMRC decides to test the theory with a court case? If Rangers are also still in the SPL, essentially the same organisation with a different company number, would you fancy their chances of avoiding the hammer? If they are spending money?

     

     

    Their history comes complete with the toxic waste. If they NewCo it’s bon voyage Rangers as we know it and a fresh start in the lower league, history gone, perhaps even a new badge ….

     

     

    I can see lawyers getting fat for years to come. I can see this being a mess of Biblical proportions. I can see fun times ahead.

    UEFA have to step in and pot the SFA on gardening leave,pending sackings.They must know the governing body have been far too close to this club for years(to say the least).The SFA are in danger of setting dangerous precedents to save their favourite club,which may in the future be used by other clubs in other countries.UEFA must know the 2 contracts have contaminated every competition they have entered,cue the lawsuits.
