Irony behind robust SFA rules

The statement released by Duff and Phelps last night revealed the substance to the lobbying that had taken place since the original punishment handed out by the SFA judicial panel:

“The decision by the appellate tribunal to uphold the sanction, namely the suspension of registration of players for one year, is not competent in the view of the club and its legal advisers.

“Such a sanction was not available to the tribunal”.

The suspension of player registrations was not one of the suggested punishments on the menu for the judicial panel but the rules allowed them to vary from guidance and choose whatever punishment they believed appropriate.

The appeal correctly found that the judicial panel were not were not subject to an exhaustive list of possible punishments.  Duff and Phelps main hope was that the SFA rules were unclear and poorly constructed, as they were before an overhaul last year.

You don’t need to look too hard for the irony.

    HMRC never comment on live cases. In any case, they have no more info on the first tier tribunal than anyone else.

    Case heard in private at the First Tier Tribunal

     

    Chairperson and panel of tribunal are in process of writing up findings.

     

     

    The more complex a case is, the longer it takes for the findings to be released. The chairperson and panel members will have heard the evidence from both sides and will have had to consider what the law says and any case law relevant to the case before making its judgment.

     

     

    re Not payment of VAT/PAYE/NI contributions etc. Administration protects the company from creditors and so HMRC will have to wait until a CVA is proposed and presented to creditors before being in a position to comment.

     

     

    Just because HMRC are quiet, doesn’t mean a deal is being done in secret.

    Do you really think the orcs will turn up at the cup final at Hampden tomorrow ? they can hardly muster a large number of fans for there protests so why would this one be different? I think any triuble from the orcs will be by individual nutters or very small groups and will be alchol driven so imo there possible violence is more likely to be in pubs and clubs. H.H.

    One thing that I cant follow in the Rangers continueing saga there must be somone who is responsible for paying salaries and dealing with the Inland revenue at Ibrokes.Now shortly after Craig Whyte took over they stopped paying tax and national insurance now the person or persons who deal with salaries must have realised they were not paying the tax and yet this went on for months and he/she did not raise the alarm or go public with the information and then they say we werent complicit we just didnae know.H.H.

    Financial controller was Ken Olverman whose deeds are clearly attributable to the club, viz:

     

    “Generally speaking, as a matter of law, actions of a single individual can be attributed to the company as a whole. This was a matter considered in the case of McNicholas Construction Co Ltd v C&E Commissioners (2000) STC 553:

    HMRC cannot do anything about RFCIA as they are in administration at the moment. Cast your mind back to 13th Feb, where HMRC had actually had enough and were indeed about to pull the plug, or at least put der orkenkind into administration.

     

     

    There were a number of subtle, but very telling, differences between Hearts situation and that at Rangers:

     

    Hearts are quite openly insolvent. And indeed are insolvent by such a margin that should their debt underwriters pull the plug, they’d immediately be liquidated. Immediately. As such, HMRC had to apply for winding up orders each time they went after payment.

     

     

    Rangers were different, in that their ‘booked’ assets more than covered their levels of debt ergo they were not openly insolvent. As such HMRC could only apply for administration for recovery of debts in the face of continuous non-payment. HMRC would have had no way of knowing the full level of debt and even though the BTC is still a debt (the penalties, as yet, are not), the debts of the club were still covered by assets. It would not have been in HMRC’s best interests, under the perceived knowledge at the time, to do a winding up order on them.

     

     

    As stated, now that the orcs are in admin, there’s very little HMRC can do but wait it out and pounce on any proposed CVA, rending it sheet from sheet. At that point, the administrators, in lieu of a CVA will do the winding up order in place of Hector and Co.

    The longer it takes them to report suggests more doo-doo for the taxdodgers.
