Irony behind robust SFA rules

The statement released by Duff and Phelps last night revealed the substance to the lobbying that had taken place since the original punishment handed out by the SFA judicial panel:

“The decision by the appellate tribunal to uphold the sanction, namely the suspension of registration of players for one year, is not competent in the view of the club and its legal advisers.

“Such a sanction was not available to the tribunal”.

The suspension of player registrations was not one of the suggested punishments on the menu for the judicial panel but the rules allowed them to vary from guidance and choose whatever punishment they believed appropriate.

The appeal correctly found that the judicial panel were not were not subject to an exhaustive list of possible punishments.  Duff and Phelps main hope was that the SFA rules were unclear and poorly constructed, as they were before an overhaul last year.

You don’t need to look too hard for the irony.

    It’s becoming more and more apparent that the main stumbling block in the whole process of cleansing Scottish football is a certain Neil Doncaster.

     

     

    He is continually muddying the waters about CVA and NewClub, intentionally dragging his feet over the dual contracts invetigation, and stoutly defending the position of a club that has blithely corrupted his very own SPL competition since its inception.

     

     

    Whereas Stewart Regan in recent days and weeks has at least made some progress in adressing the cancer that is RFC(ia), Doncaster remains the stubborn immovable object in the face of the irresistible force of justice.

    Not posted for a while but I see Mr Doncaster has finally found his voice this morning…..

     

     

    NEIL DONCASTER has warned Rangers NOT to expect special treatment from the SPL.

     

     

    Gers are fuming after failing to have stiff SFA sanctions overturned on appeal. But SPL chief Doncaster said: “We will continue to deal with clubs equally under the rules. Our job is to apply those rules, without fear or favour to every single one of the 12 member clubs. That’s what we will do.

     

     

    “It’s our job to explain that what we are doing is treating people equally. If everyone understands that then what will be the reason to be aggrieved about the outcome?

     

     

    “Every club will be treated exactly the same. I can’t get into ‘special cases’.

     

     

    “Our job is to apply the rules fairly and evenly to every SPL club.”

     

     

    Things could get even worse for stricken Gers when league bosses meet at Hampden on May 30 to vote on changing their rules on financial fair play.

     

     

    Their proposals could see Rangers hit with a ten-point penalty for two more seasons if they exit administration through a newco.

     

     

    Gaffer Ally McCoist claims Gers are so vital for Scottish football they shouldn’t be hammered.

     

     

    But Doncaster — who met Ibrox buyer Charles Green at Hampden yesterday — added: “The questions Rangers were asking were the obvious questions, where we are and where we plan to go. We spoke to members of the board from the SFA and also executives of the SPL. It’s been a very productive day.

     

     

    “We are happy everyone is positive in looking for the best for Rangers and the SPL.”

     

     

    Green is still battling to take Gers out of administration through a CVA and not a newco.

     

     

    Crucially that would see them dodge a three-year suspsension from European football.

     

     

    Doncaster, though, argues there is not a huge difference between the two options.

     

     

    He said: “Whenever I speak to people about the distinction between a CVA and a newco what I keep being told is it’s simply wrong that any club should be able to create a newco and shed debt. As if a CVA doesn’t lead to the shedding of debt.

     

     

    “Administration is the protection the court gives you when you can’t pay your debts.

     

     

    “There are two ways out of that — one is a newco, one is a CVA.

     

     

    “Of the six administrations which have happened down south in recent years two went with a CVA and a newco — Crystal Palace and Plymouth — and there were four where there was no CVA and a newco.

     

     

    “But the distinction between the two is relatively fine. I am baffled as to why such a distinction is drawn.

     

     

    “When Livingston were relegated to Division Three did they cease to exist and start again? Of course they didn’t.

     

     

    “It’s not OK to waive £90million of debt, of course it’s not. But it happens. In football as in business.”

     

     

    The SPL are still investigating the alleged ‘double contracts’ at Ibrox but Doncaster revealed no verdict is likely soon.

     

     

    He added: “It will take some time and, ultimately, it’s being done by our lawyers.

     

     

    “How long will it take? How long has the HMRC case taken?

     

     

    “These things take as long as they take.”

     

     

    Meanwhile, Ibrox fans could push ahead with their plans to boycott away matches after Gers lost their appeal against the £160,000 fine and transfer embargo imposed by the SFA.

     

     

    Fans’ spokesman Andy Kerr said: “After losing the appeal we will now consider what might be the best action to take in the interests of Rangers.

     

     

    “There will definitely be a call not to support away matches because that is directly impacting on other clubs who are members of the SFA”

    Absolutely.

     

     

    HMRC will deliver a commentary on Ranger’s tax shenanigans but, true to form, I would expect Rangers to stick to the line ‘it was their advisor’s fault’ as their fall-back position. However, the blame for the double contracts can’t be diverted anywhere other than Murray and the Ranger’s board and, of course, the double contract participants.

     

     

    The double contracts is the deal breaker and I’m not convinced Doncaster will be in any hurry to reveal the results of the investigation, hopefully the FTT report will highlight it and push Doncaster into action.

  15. Doncaster has no class and no vision, the SPL’s TV deals is one of the worst in Europe with comparable leagues yet it is held up as some kinda Sky Holy Grail.

     

     

    Get your finger out man and apply the rules stop talking about applying the rules and just do it.

     

     

    If this was any other club it would have been dealt with months ago.

     

     

    Why we have a failure like Dungcaster running our league is testament to the abject lack of vision and guts in our national game, under these circumstances Celtic have done an incredible job of surviving and thriving..

  16. Doncaster’s back peddling furiously after realising that his initial comments 2 weeks ago sounded like an invitation to newco to come back into the SPL with little/no penalties. Someone has had a word in his ear.

     

    However, his original comments are more than likely the ones he, and the chairmen of the majority of SPL clubs, believe in and will be pursuing should fc taxdodgers are liquidated.

     

    For Doncaster and the majority of the SPL there will be a newco in the SPL next season, there will be no points penalty and there will be minimal financial penalty. They’re just trying to work out the ‘spin’.
