No illegal registration punishment, judicial independence scrapped

The Daily Record today report the contents of a document drawn up after a meeting between the SFA, the SPL, the SFL and Sevco suggesting “punishments for Rangers for the Employment Benefit Trust tax dodge used by Sir David Murray’s regime to pay players”.

The document details that Rangers would be stripped of titles and trophies ‘won’ by the club while they fielded illegally registered players, described by the Record as “the harshest ever seen in football”.

While Rangers EBTs had been in the news for close to two years, it was Celtic Quick News who first raised the question of Rangers players being illegally registered in an article on 22 February this year.  Clubs are required to note all payments players receive in connection to football with both the SFA and SPL as part of the player registration process.  Failure to register EBT payments is completely separate to the legality or otherwise of how the EBT was conducted, and until we raised the issue, there was no question over player registration, and no possibility of league titles being stripped.

Two weeks after Celtic Quick News brought the matter to public attention the SPL appointed solicitors Harper MacLeod to investigate the case.  The subsequent report concluded Rangers had a case to answer.

There are a number of alarming aspects to today’s Daily Record report (the newspaper appears to have the main story but don’t notice its relevance):

Sevco should not be involved in any discussion around the guilt of Rangers or any subsequent consequences.  Fan  power in recent weeks had shown that we are not a Banana Republic.  Disciplinary issues are subject to establish procedures.  Any attempt to meet with a party acting on behalf of Rangers to agree an outcome with both the investigating body and the appeals body, before an independent inquiry takes place, contaminates all who participate.

Scottish football has independent judicial procedures for dealing with serious breaches of rules.  Executives from the SFA and SPL have absolutely no authority to set-aside these procedures, nor are they appropriate people to act instead of the independent procedures.

Stripping Rangers of titles and trophies if they are found guilty of cheating is not a punishment; this simply reflects the legitimate winners of past trophies.  When an athlete is found to have cheated to win a medal, his punishment is not the withdrawal of the medal, which is an obvious consequence of being caught, he will also face a sporting or financial penalty, often a ban.

There seems to be no end of attempts to subvert sport in Scottish football.  There must be no backroom deals, not even if they bring a barrel load of trophies to Celtic, we cannot be bought-off by bling.  Independent disciplinary procedures must take place.

Although Rangers failed to register players EBTs, this matter is separate from what the Record calls “punishments for Rangers for the Employment Benefit Trust tax dodge used by Sir David Murray’s regime to pay players”.

If the First Tier Tribunal (remember that?) rules that Rangers broke tax rules the club could yet face football disciplinary procedures for failing to pay social taxes.

Last month we reported that the SFA was set to remove independent judicial oversight from the game as its existence was getting in the way of their plans for ‘Rangers’.  Although the Daily Record seem to be oblivious to the fact, they appear to have found documentary evidence that this is the case.

    Rangers Fans Ordered To Have 100 Lashings

    Spew Rear-gun, the Scottish Farcical Association (SFA) diddy Chief Executive, has ordered that all Rangers fans receive 100 lashings for their unwavering support of the resilient Glasgow club. This follows a series of bizarre penalties from the bungling man in charge of Scottish football where his authority appears to be unquestionable regardless of legality.

     

     

    One such bizarre decision is the announcement on Friday 13 July 2012 in which the NewCo (that means a new company, a new legal entity) are likely to face further punishment due to the OldCo’s (that means, the old legal entity, that has already been punished) problems.

     

     

    Although there is a clear legal distinction between the two legal entities (OldCo and NewCo) as well as the other legal entity (the individual fan), Mr Rear-gun believes that the 100 lashings should prevent “social unrest” and will protect sporting integrity.

     

     

    All Scottish clubs have voted in favour of this punishment on the basis that it continues to punish the Rangers community.

     

    The St Midden board were unanimous in their support of the punishment even though they aware it will destroy their club in the short run.

     

     

    The Invermess CT board have hailed the new punishment as the correct moral action to take. In other news, Invermess has also called for a Meeting of Creditors to announce that, as a result of their vote, the club will go into administration and may be wound up. Several other clubs including Donedee Utd and Killmarnock, have bypassed the unrealism of administration and announced Section 98 meetings to wind up their club voluntarily. It appears these clubs spent beyond their means depending on the source of income from Rangers – there has been no mention of the buzzword ‘sporting integrity’ by anyone whatsoever.

     

     

    Rangers’ first fixture of the 2012/12 SFL season kicks off against Peterheed, while the SPL season has been cancelled due to the lack of clubs.

  17. Courtesy of their club website I have just watched Norwegian side Molde demolish their higher seeded Lithuanian opponents Ventspils 3-0 in Norway.

     

     

    It could easily have been double that.

     

     

    Molde look a very well organised team and their strikers and wide players gave the Lithuanian defence a very uncomfortable evening.

     

     

    What was particularly noticeable was their sharpness, mental as well as physical.

     

     

    I had a look at the Norwegian League table and Molde have played 15 league games hence the reason for them being “in the groove”.

     

     

    Their result tonight just about ensures that they will become a possible opponent for us in Friday’s draw.

     

     

    Last night, another of the “underdogs”, Azerbaijan’s Neftci Baku thrashed their

     

    more fancied opponents, also 3-0.

     

     

    We will have our work cut out to qualify if only for the fact that we are so far behind some of these teams in match fitness.

     

     

    I am still hoping Shamrock Rovers can manage to qualify next week in Lithuania.

    Advised him that was why an oldco transfer was required ….and why that means that they have to be liable for sanctions of oldco because it was their licence they were inheriting

    If Sevco FC manage to take to the field in the forthcoming season I would love it, just love it, if we have a freezing cold winter with plenty of snow and ice.

     

     

    All those pitches in Div 3 without undersoil heating, those young Sevco lads could quickly find themselves with a fixture pile up.

     

     

    And I wouldn’t be surprised if the Ibrox heating system mysteriously does’t work in order to save a few pennies on the heating bills.

    Doc ….again . I fully agree with you……..but it will never happen, since no government will ever have this community vision……..if it wasn’t for individuals giving of their time to work with youngsters in clubs etc we would be in an even worse situation …..i may sound negative, but I am the most optimistic / positive person you could meet, …….i have just grown very frustrated at the political etc priorities down the years ……. The scales of justice are currently in a state of imbalance, and the ‘lip service’ is disgusting.
