Parma liquidation precedent would work against Rangers

We have spoken before that preliminary positions are being established ahead of the much-anticipated outcome of HM Revenue and Customs tribunal against Rangers with the possibility that, in the event the decision goes in favour of HMRC, the company could go into liquidation.  This weekend brought a fresh attempt to pitch a positive scenario in favour of Rangers.

One newspaper sought solace in the case Parma, stating that the Italian club was allowed to re-emerge in Serie A after going out of business in 2004.

Unfortunately this is a complete misrepresentation of the facts, as far as Parma is concerned, precedent points to an entirely different outcome.  Parma went into administration on 28 April 2004 after Parmalat, the dairy company which owned a majority of their shares, also went into administration.  Parma remained in administration for three years before emerging after a successful restructuring of their debts.  The club was then bought by a new company – but crucially – continuity of football operations was possible because there was no liquidation and debts were restructured in a way consistent with prevailing administration laws, that allowed a company to continue trading.

This, however, is not the end of the precedent Parma can offer Neil Doncaster and his SPL board.  In 1968 AC Parma went into liquidation and disappeared from existence.  They are an ex-football club, to use a phrase I can see creeping into the local lexicon soon.

Shortly after the failure and permanent disappearance of AC Parma, another club, AC Parmense, who were newly promoted into Sere D, changed their livery to match their better known former-neighbours and changed name to AC Parma.  It was this club, AC Parma-formerly-known-as-AC Parmenese, who were promoted through the divisions and went on to win three European trophies.

Precedent from Italy is clear: if a large SPL club is liquidated an opportunity exists for Clyde FC to change their name, ditch the white shirts, rent a large, vacant, stadium and try to work their way through the leagues. Just as Airdrie United-formerly-known-as-Clydebank, are attempting to do.

There are no free tickets to the elite level of Scottish football.

    Having read the full Traynor article ……

     

     

    Apart from other aspects commented upon Traynor is mixing up two ideas:

     

     

    One of Rangers going into and emerging from Administration as Rangers

     

     

    or

     

     

    Rangers going into administration and not emerging as Rangers, but some new club arising to take their place.

     

     

    The former is only likely to happen if HMRC were to decide that keeping Rangers on life support for three or four years whilst they take what they are owed is not in fact that bad an idea. The EBT case would be won so they can still pursue others and put tax millstones around other clubs necks with the consequent and needed downward inflationary wage pressure being spread right throughout UK football (bar Man City and that will remove competition, such as it is, from the EPL to such an extent that the EPL clubs would vote in their own version of FFP just to constrain Man City).

     

     

    So I would not rule out HMRC coming to an arrangement with Rangers to pay. It would still draw a line in the sand and put unpaid debt back into the public purse not just the £49M that Rangers owe, whilst preventing the integrity of the Scottish football industry being undermined as it desperately tries to deal with the other option HMRC has, which is to demand the lot and put Rangers out of business.

     

     

    In protecting the Scottish football industry by keeping Rangers alive, making the league more competitive for second place in the process (and not ruling out Celtic’s ability to shoot ourselves in the foot) , HMRC is likely to increase revenue, not diminish it, so I am not so sure we will be talking about a New Rangers.

     

     

    The only concern I have with this scenario of time to pay is that in an attempt to compete with us, Rangers will try and pay off their back tax with CL money and will go back to their habit of gambling on CL money whilst fixing the odds as much as they can in their favour. A “punishment” I would advocate should this scenario emerge is that any money earned in Europe by Rangers over and above Europa Cup money does not go to Rangers but is diverted to a fund overseen by the SFA Professional Game Group (on which PL sits) to be spent on developing the game.

     

     

    That would remove the temptation to gamble and then cheat whilst not removing any incentive for Rangers to fairly pay their way if HMRC come to a deal.

     

     

    Standing back and putting all allegiance aside I can see it happening.

     

     

    The other scenario is that HMRC demand full whack right away (and if CW is in charge I would expect them to) and if this happens Rangers would not emerge from liquidation and we have a Newco scenario. What Jabba misses here is that as a new club they cannot play in UEFA competition for 3 years, (thems UEFA rules Jim), whether they get an SPL parachute or not, and there is no need to see that as a punishment any more than is a headache is a punishment for drinking three bottles of Buckie straight.

     

     

    If Government is serious about putting football’s house in order, a victory at the FTT gives them the perfect opportunity to do so. In fact reading between the lines going back a few years to the EU White Paper on Sport that produced UEFA FFP 2010, I would not be surprised if this, sorting out football via tax, was the idea all along nad once HMRC became aware Rangers were dodgy it gave them an opportunity.

     

     

    So watch out for a short time (3 to 4 years) to pay deal. It screws CW but without the earnings cap suggested puts our game at risk to further Rangers skulduggery.

    For those of us who are standing idly by waiting for the EPL to implode in a mountain of debt

     

    Think about this.

     

     

    If the huns can simply say on a Saturday night, “by the way we are skint and cant pay anyone, so we are no longer” and then simply ignore all debt and re appear as the huns part 2 going for 4 in a row on the Sunday morning.

     

     

    Even these debt laden giants from the EPL can follow Jim traynor and rangers example. basically anyone in fitba who owes any money can simply walk away without any reprecsussions

    The sooner that lot die and get buried the better. As James Forrest put on her a couple of years ago, “we should have put a hose down their throats and turned the tap up full”. I liked the sound of that then and I like the sound of it even more now. Never liked them then, never will.

     

    I do not see how something that happens in Italy has anything to do with Newco here, different corporate laws etc (i think they call it corruption).

     

    Anyhows, forget about tax bills, what about lawyers bills, Whytey in 4 seperate court cases last week and I hear from his ex’s lawyers that his ‘finances’ are a laughable.

    Do not forget they and Peter Lawwell in particular were the butt of our ire as we competed one hand tied behind our back for the last four years as Rangers tried desperatelyto dig themselves out of a hole at our expense.

     

     

    Put yourself in their shoes for a minute, last time I looked they were human, so how would YOU feel?

     

     

    This idea that there are heartless automatons with no feelings looking after Celtic is a very damaging idea based on past history pre Fergus.

     

     

    Time we got real as the reality of what Celktic are up against emerges with each passing day.

    The EPL does not have to implode. There is plenty of money in the game, all they have to do is collectively tear up contracts and offer new ones. Imagine having to struggle by on £5k a week.

     

     

    They have to deal with Man City but that can be done with their own version of FFP (or wage control). If enough big English clubs have back tax under EBT schemes to be collected HMRC can agree repayments on a scale that reverses the cash flow from players/agenbst pockets to the taxpayer.

     

     

    Harry Redknapp is but one example of how it can be done. A while back I read the Ivo Belet Report on ther fFture of Professional Football in Europe. The author had grave concerns that found their way into the UEFA FFP rules via a EU White Paper on Sport.

     

     

    I reckon the UK government bought the idea that football had to be brought to heel in the UK and HMRC was the weapon of choice. The Rangers skullduggery was an opportchancity too good to miss.

     

     

    Put it this way, had I been advising Ministers, I would have said its the way to go.

    Hope remains for struggling Airdrie

     

     

    Provisional liquidators called in to Scottish First Division strugglers Airdrie have expressed hope that the club can be saved.

     

     

    They have voiced confidence that a backroom shake-up would allow new investment to come into the club.

     

     

    The Diamonds have called an extraordinary general meeting to discuss a change of constitution which could ensure its survival.

     

     

    Up until now, no Airdrie shareholder has been allowed to own more than 10% of the shares – a matter which has been scheduled for discussion at Monday’s meeting.

     

     

     

    Liquidator Blair Nimmo:

     

    Blair Nimmo, head of KPMG Corporate Recovery in Scotland, has been appointed as the club’s provisional liquidator and expressed optimism for the future.

     

     

    He said: “While the liquidation is a serious matter for the club, I would like to stress our focus will be on creating a firm foundation for the future development of Airdrie FC.

     

     

    “The club has first class facilities and is an important institution within Scottish football – it just needs new investment.

     

     

    “Hopefully a new constitution will be the catalyst which enables the introduction of new investors with the funds, and the ideas, to take the club forward.”

     

     

    ‘Business as usual’

     

     

    In the meantime, Mr Nimmo said it would be “business as usual” at the Lanarkshire club, currently lying at second bottom in the First Division.

     

     

    Airdrie’s problems worsened when it was revealed that Rangers had arrested the club’s share of the gate receipts for Sunday’s Scottish Cup tie at Dundee United.

     

     

    Airdrie’s finances have been tackled by David Murray

     

    Ibrox chairman David Murray applied for an interdict, on behalf of his company Carnegie, for a debt of around £30,000 owed by Airdrie.

     

     

    Mr Murray said: “I feel very sorry for Airdrie and their supporters but we’re running a business. We have given them repeated warnings and felt they were playing on our good nature.”

     

     

    The Scottish Football Association described the move as “a private matter between the clubs” and made clear there had been no contact with either party.

     

     

    Airdrie were at the centre of recent takeover speculation amid reports that Motherwell chairman John Boyle wanted to acquire the Diamonds and create a bigger Lanarkshire club.

    As a Celtic supporter and a football man it has infuriated me that the Poundland team and there Loyal chairman who upheld everything that was Royal have been cheating scottish football for years while at the same time denying her majesty her entitlement of income.We tattie munchers have played strictly by the rules and paid Lizzie her dues even thought we are sure really she is not due it.During this period we have also been cheated on the field of play by those nice masonic men in black.Now one of the peepil has had the cheek to post on CQN to say we dont understand that Scottish football cant survive without the uglies being allowed to go unpunished for there cheating.Someone should really let the peepil know that if they dont get heavily punished which they will be due if they are found guilty in there tax case that Scottish football will be finished as once a cheat allways a cheat and who in there right mind is going to pay money when the know they and there team are being cheated.H.H.

    RTC is hammering away at Stewart Regan just now on Twitter.

     

     

    It’s quite interesting from the point of view that the fellow – RTC – only speaks when he’s on firm ground.

     

     

    Regan of course is avoiding being landed.

     

     

    Nevertheless, it does look as though RTC has some strength in his conviction that the SFA has not been provided with the pukka paperwork from a certain club in the SPL, thus breaching all manner of rules relating to registration and licensing of players and clubs.

    Cheating can become endemic. Using an EBT scheme with separate contracts for players leads to lies to the SFA/SPL.

     

    Lies about tax liabilities to the SFA to gain access to CL.

     

     

    They are like a corrupt empire about to implode. I am confident that they will be back in League 3 for the start of the 2014 season if not before.

     

    We may well have a season of non existenceor at least one of struggling administration.

    The missus has just booked a holiday to Tunisia for 10 days from the 29th of April but my joy was short lived when I then realised that I may well miss the title run in :/ Anyone know the exact date when the season finishes after the split? Just hope we’ll have wrapped the title up by then and increased that 19 point swing by a substantial margin!

By the time you leave only three fixtures should be remaining so hopefully by the the title trophy will have green and white ribbons bedecking it which means you can smile your way through Tunisia and chuckle if you see any xxxxxl strips in the departure lounge
