Parma liquidation precedent would work against Rangers

We have spoken before that preliminary positions are being established ahead of the much-anticipated outcome of HM Revenue and Customs tribunal against Rangers with the possibility that, in the event the decision goes in favour of HMRC, the company could go into liquidation.  This weekend brought a fresh attempt to pitch a positive scenario in favour of Rangers.

One newspaper sought solace in the case Parma, stating that the Italian club was allowed to re-emerge in Serie A after going out of business in 2004.

Unfortunately this is a complete misrepresentation of the facts, as far as Parma is concerned, precedent points to an entirely different outcome.  Parma went into administration on 28 April 2004 after Parmalat, the dairy company which owned a majority of their shares, also went into administration.  Parma remained in administration for three years before emerging after a successful restructuring of their debts.  The club was then bought by a new company – but crucially – continuity of football operations was possible because there was no liquidation and debts were restructured in a way consistent with prevailing administration laws, that allowed a company to continue trading.

This, however, is not the end of the precedent Parma can offer Neil Doncaster and his SPL board.  In 1968 AC Parma went into liquidation and disappeared from existence.  They are an ex-football club, to use a phrase I can see creeping into the local lexicon soon.

Shortly after the failure and permanent disappearance of AC Parma, another club, AC Parmense, who were newly promoted into Sere D, changed their livery to match their better known former-neighbours and changed name to AC Parma.  It was this club, AC Parma-formerly-known-as-AC Parmenese, who were promoted through the divisions and went on to win three European trophies.

Precedent from Italy is clear: if a large SPL club is liquidated an opportunity exists for Clyde FC to change their name, ditch the white shirts, rent a large, vacant, stadium and try to work their way through the leagues. Just as Airdrie United-formerly-known-as-Clydebank, are attempting to do.

There are no free tickets to the elite level of Scottish football.

    Do you know? I’ve been rather intrigued by the numerous scenarios that the “R@ngers must survive” brigade have come up with, the most striking aspect of this digging, spinning and scheming is there is absolutely no precedent ANYWHERE for what they want to do.

     

     

    It’s interesting that you should mention Airdrie, as I have seen this mentioned as an straight forward “get out of gaol free card” my recollection was this is far from the case, with a painful and prolonged death and rebirth.

     

     

    I wonder if we ever see a real White Knight as a R@ngers Chairman, we will hear this type of mea sumwhit culpa.

    I would simply like (and expect) the rules to be followed.

     

    If rangers win the big tax case and don’t suffer administration or liquidation through other means then it’s business as usual ( except for the uero licence question for this current season which remains unresolved)

     

    If they go into administration,the rules governing that event should be followed.

     

    Similarly,if they are liquidated the rules pertaining to that event should be applied.

     

    rangers should be treated no better or worse than any other club would be,or have been,under the circumstances.

     

     

    To vary or alter or simply ignore the rules would leave Scottish football with as much credibility in terms of being a genuine,fair competition as something like the WWE

    THE UK’s second biggest supermarket, Asda, today unveiled plans to create some 5000 jobs this year in a £500million expansion drive.

     

     

    Its plans, which were welcomed by Prime Minister David Cameron, will see it open 25 stores, refurbish 43 existing outlets and invest in three new depots in 2012.

     

     

    Three of the stores will be in Scotland: in Inverness and Tain in the Highlands, and Larkhall in South Lanarkshire.

     

     

    The chain also aims to revamp a depot in Grangemouth.

     

     

    The chain said it will create up to 5000 jobs on top of the 30,000 staff it took on last year when it opened about a dozen stores and absorbed 147 Netto sites and their staff following its acquisition of the discount chain.

     

     

    Asda said nearly half of the jobs it created last year had gone to young people, who are currently battling high unemployment, while 8500 jobs went to people who had signed up through Job Centre Plus.

     

     

    The chain, who currently employ more than 180,000 people and run 528 stores across the UK, also pledged that eligible employees would be given the chance to take City & Guilds apprenticeships.

     

     

    Cameron said: “The additional investment and 5000 new jobs announced by Asda today will be a real boost for the economy and more importantly for people around Britain seeking jobs.

     

     

    “I also welcome Asda’s commitment to not only create jobs but invest in their staff too – offering employees the chance to join an apprenticeship scheme to gain skills which will benefit them throughout their career.”

     

     

    The majority of the new stores will be smaller supermarkets but the 600,000sq ft of new space will also be made up of superstores and Asda Living non-food outlets.

     

     

    Asda, which is owned by the world’s biggest retailer, US-based Walmart, will also open a new depot in Rochdale and revamp a centre in South Elmsall, Yorkshire, which formerly belonged to Netto.

     

     

    It has already opened a store in Tunbridge Wells, Kent, this year but also plans outlets in Bootle in Merseyside, Coventry, Gateshead in Tyne & Wear, Harworth in Nottinghamshire, Mitcham in London, Ramsgate in Kent, Shepshed in Leicestershire, Todmorden in West Yorkshire, Worcester, and Worthing in West Sussex.

     

     

    In Wales, it will open a store in Bangor.

     

     

    Asda, which has pledged to be 10 per cent cheaper than rivals amid a vicious supermarket price war, recently reported that customers were shopping less frequently but spending more in a bid to overcome high petrol prices.

     

     

    Its most recent like-for-like sales figures, excluding VAT and fuel, increased by 1.3 per cent between July 1 and September 30. But it has yet to update on the Christmas period, that saw rival Tesco issue a profits warning

  6. I’m glad the comparison to Parma that was used in the Sunday paper was picked up on. I read the article and immediatley thought here we go.

     

    It’s clear in my mind anyway that the media are already cranking up the ‘ Celtic need Rangers’, ‘SPl won’t survive without Rangers’ as the stark reality of Rangers predicament hits home. We need to make sure they face the full consequences of their financial doping that denied not only Celtic but other clubs of silverware and top 6 finishes, no mercy!

There are a few shope in Larkhall where the corporate logos are in Green and White (Subway for example) and after a review with the local comunity, these colours are now black and white, I have already written to ASDA (last Year and the local council ) that if ASDA surrender to the No Surrender croud that they can wave goodbye to my business anywhere and that of almost every person of Catholic or Irish decent in Scotland

     

     

    Watch out for a corporate change of colours, especially those nice Green and white staff uniforms

The missus has just booked a holiday to Tunisia for 10 days from the 29th of April but my joy was short lived when I then realised that I may well miss the title run in :/ Anyone know the exact date when the season finishes after the split? Just hope we’ll have wrapped the title up by then and increased that 19 point swing by a substantial margin!

    Provisional liquidators called in to Scottish First Division strugglers Airdrie have expressed hope that the club can be saved.

     

     

    They have voiced confidence that a backroom shake-up would allow new investment to come into the club.

     

     

    The Diamonds have called an extraordinary general meeting to discuss a change of constitution which could ensure its survival.

     

     

    Up until now, no Airdrie shareholder has been allowed to own more than 10% of the shares – a matter which has been scheduled for discussion at Monday’s meeting.

     

     

    Blair Nimmo, head of KPMG Corporate Recovery in Scotland, has been appointed as the club’s provisional liquidator and expressed optimism for the future.

     

     

    He said: “While the liquidation is a serious matter for the club, I would like to stress our focus will be on creating a firm foundation for the future development of Airdrie FC.

     

     

    “The club has first class facilities and is an important institution within Scottish football – it just needs new investment.

     

     

    “Hopefully a new constitution will be the catalyst which enables the introduction of new investors with the funds, and the ideas, to take the club forward.”

     

     

    ‘Business as usual’

     

     

    In the meantime, Mr Nimmo said it would be “business as usual” at the Lanarkshire club, currently lying at second bottom in the First Division.

     

     

    Airdrie’s problems worsened when it was revealed that Rangers had arrested the club’s share of the gate receipts for Sunday’s Scottish Cup tie at Dundee United.

     

     

    Airdrie’s finances have been tackled by David Murray

     

     

    Ibrox chairman David Murray applied for an interdict, on behalf of his company Carnegie, for a debt of around £30,000 owed by Airdrie.

     

     

    Mr Murray said: “I feel very sorry for Airdrie and their supporters but we’re running a business. We have given them repeated warnings and felt they were playing on our good nature.”

     

     

    The Scottish Football Association described the move as “a private matter between the clubs” and made clear there had been no contact with either party.

     

     

    Airdrie were at the centre of recent takeover speculation amid reports that Motherwell chairman John Boyle wanted to acquire the Diamonds and create a bigger Lanarkshire club.

    This is a very good call. Even in the 3rd div rangers newco would still have a sizeable travelling support.

     

    Say 5000 for each away game. Can you imagine how this would benefit the likes of Albion Rovers (a tie Im really looking forward to!) and East Stirlingshire, Stennhousemuir, Cowdenbeath, Annan Athletic, Stranraer, Forfar etc. Rangers newco would be doing Scottish football a real favour for a change.

     

     

    It got me thinking. Truth1234etc gave us his reasons why it would be bad for Scottish Football. Here are my reasons why it would be tremendous for Scottish Football. Im sure we could add to the list as the day goes on and present it to the SFA.

     

     

    1. They would pretty much wipe out the debts of many clubs within the game with their travelling support.

     

     

    2. Meanwhile, back in the SPL, the other clubs would not have to fork out 1000’s for police costs,

     

    replacement seats, vandalised toilet units etc. (but I guess the 3rd div clubs would have that problem but it would still be worth it to them due to income versus outgoings)

     

     

    3. No Celtic v rangers. Great! The Emergency wards would be able to have a breather.

     

     

    4. The Courts. How much do we pay from the public finances on sectarian related offences? Hopefully this spending would subside over the 3/4 years it would take newco to get back to the spl.

     

     

    5. A rangers Newco would have the chance at last to be free of the highly questionable 130 odd years of undignified existence. A chance to renew and create a healthy rivalry, not one born of hate, fear and aggression. A chance for the newco rangers support to adopt a more positive embracing, enlightened approach to supporting their football club. 3 years in the wilderness will give them time to think and repent.

     

     

    6. We will spend the 3/4 years celebrating wildly.

  19. I know that there are one or two posters who think that Peter Lawwell is not up to the job and doesn’t deserve to be CEO at Celtic.

    I think that it is relevant that he has a position within the SFA and that this post arose from the shambles of last year, which demanded a change in how that body operated.

     

     

    Therefore, I would not be surprised that the SFA are fully up to speed with what Celtic’s position would be in the event of a parachute landing.

    I cant speak the language, but recently I have been watching more and more.

     

    Personally, I see a different, more tolerant, open Scotland out there in the Isles, than I do in West Central Scotland.

     

     

    The Vatersay Bhoys programme was excellent, and their football coverage is refreshingly unbiased.

  27. if rangers lose the tax case and have to go out of business, any newco should have to apply to gain entry into the league starting from SFL division 3, if this does not happen the games up and celtic should move to tender resignation citing this.

     

     

    i would not take to much joy from rangers going out of business, but every other team in the league has been cheated out of league, cups, european places etc… and that must be punished.

    I accepted that advice as accurate, but paid my money because I thought the survival of our club and the ethos of the club was more important than £. s. d.
