SPL propose rules for Newco FC

We told you back in October last year that Rangers were likely to be liquidated and a Newco FC would be formed, which the SPL would vote back into the league.  Today the SPL issued terms of how the deed will be done as they issued 8 resolutions to be voted on later this month.

The key resolution is 2A, which establishes a procedure to phoenix a Newco into the place of an ex-club.  Crucially, this resolution only requires the support of 8 SPL clubs, all 12 of whom will be eligible to vote at the meeting.  5 clubs would be needed to block this proposal and right now there is only one willing to do so.

Resolutions are as follows:

Resolution 1 proposes an increase in the sporting sanction (points deduction) on any Club which suffers or is subject to an Insolvency Event from 10 points to the greater of 15 points and 1/3 of the Club’s SPL points in the preceding season.

This resolution increases the penalties imposed following an insolvency event, it requires the support of 8 clubs to be carried and should be supported.

Resolution 2A proposes further sporting sanctions in the event that any Club undergoes an Insolvency Transfer Event (i.e. transfers its share in the SPL to a new company where this occurs because of the insolvency of the transferor) of 10 points in each of two consecutive seasons from the Insolvency Transfer Event.

This resolution provides for an ‘Insolvency Transfer Event’, defining what happens when a club ceases to exist and a Newco FC is formed.  No provisions currently exist for such a scenario and I see no reasons to introduce any.  The resolution requires the support of 8 clubs to be carried and must be opposed.

Resolution 2B proposes revisions to the fee payment arrangements i.e. SPL fees to any Club which has undergone an Insolvency Transfer Event will be reduced by 75% in each of three consecutive seasons from the Insolvency Transfer Event.

This resolution provides for a financial penalty in the event the Insolvency Transfer Event resolution is voted through and requires the support of 11 clubs.  This is an outrageous and arbitrary increase in support required to impose financial sanctions.  All an Insolvency Transfer club needs is the support of one other club to halt financial penalties.

If resolution 2A is passed, resolution 2B should be subject to the same voting criteria and must be supported.  The SPL must ensure a financial penalty is imposed for financial misdeeds.

Resolution 3 proposes extending sporting sanctions where an Insolvency Event is suffered by a Group Undertaking of a Member Club of the SPL (Group Undertaking is defined in Section 1161(5) of the Companies Act 2006).

This resolution confirms insolvency events at group owner level are applicable to the club, requires the support of 8 clubs and should be supported.

Resolution 4 proposes updates and extensions to the definition of Insolvency Event in the SPL Rules.

I assume this is an administrative requirement and needs the support of 8 clubs.

Resolution 5 proposes updates and extensions to the definition of Insolvency Event in the SPL Articles and clarifies the process in the event that a Member which is the subject of an Insolvency Event is required to transfer its share in the Company.

This is a technical resolution defining how clubs lose or transfer their share in the League.  It requires the support of 11 clubs but it is not clear if has any consequence, more than clarifying administrative procedures.

Resolution 6 proposes a specific requirement in the SPL Rules that Clubs must pay their Players in terms of their Contracts of Service on due dates and places a duty on any Club to report any failure to pay its Players in a timely manner to the SPL.  Failure to pay Players and / or to notify such failure to the SPL would be a breach of SPL Rules.

This resolution should enhance fair play, requires the support of 8 clubs and should be supported.

Resolution 7 proposes a requirement in the SPL Rules that Clubs report to the SPL any failure to make payments to HMRC in respect of PAYE and NIC (a Default Event).  Any Club suffering such a Default Event will be subject to a Player Registration Embargo.  Any failure to report a Default Event shall be a breach of the SPL Rules.

This resolution prohibits clubs in tax arrears from signing players, requires the support of 8 clubs and should be supported.

If only they would pay their taxes we would not need to bother with any of this.

    The only decision I personally have come to is that I will not support any other club with one thin dime of my hard earned, but I will continue to support Celtic. Celtic need my SUPPORT just now, they do not need my disaffection for something not of their making.

    I think the SPL have seriously misjudged the public mood on this, not only is it not adequate it does nothing to address the question how did it happen under the SFA’s watch? Who was responsible for licencing, how was it done, what part did how referees are appointed play and how does it all need to be improved to make sure it never can happen again?

     

     

    To think this can all be brushed under a carpet with a points penalty and it all ends there is wishfull thinking on the SPL’s part. Celtic will have something to say not only because they will lose support if they act in token fashion but because they have paid a high price for Rangers behaviour.

     

     

    On what basis are these rules being introduced, would they be the same if it were not Rangers, would they stand up then?What shape will a Newco even be in to provide a parachute to? Who gives the license to play under club licensing rules? On what basis is it granted to a new entityy?

     

    If there is a business case suggesting how Rangers will contribute to the welfare of the SPL in a fair manner, will that business plan be made public and more important will it be policed properly?

     

     

    These are the questions that football needs to answer. Me? I would not trust the whole shebang, certainly not without a root and branch enquiry with preventative measures introduced and even then I’d want to be the policeman.

    How about we get a consortium together, call ourselves The Green Knights, and start a bidding war for Ibrox and/or Murray Park? Let’s drive the price up as high as we can and make sure the process isn’t complete before the start of next season. That buys us time to stop the proposals.

     

     

    If I remember my Arthurian legends correctly, the Green Knight challenged any of the knights of Camelot to behead him, and allow him to behead THEM in turn a year and a day later. Sir Gawain took him up on the offer, and you can imagine how he keeched his breeks when the Green Knight came calling with his axe 366 days later. Could be quite an apt name.

    I’m with you, the fans are the club and it will be up to us to unite and take action. Bhoycott of sky and espn is a must along with away and cup games in Scotland. If it’s all about the clubs needing the money then they are taking it for granted that we will continue to provide them with funds.

     

     

    This is cheating of the highest order and we should consider getting out with a two fingers to any period of notice!

Here it is even spun as being unfair to the one club that it actually benefits. And the most blatant act of fixing in the history of football is proposed under the heading of Financial Fair Play!

    Barcelona’s economic vice-president, Javier Faus, has revealed that the club are still in a tight financial situation following the signings of Cesc Fabregas and Alexis Sanchez this summer.

     

     

    The Spanish and European champions spent over £50million to lure Fabregas and Sanchez to Camp Nou over the summer, and although they have reduced their debt, Faus has admitted that the Catalans “need to generate more income.”

     

     

    Barca are around £317m in debt, although the figure is down from around £375m twelve months ago.

     

     

    And speaking via the club’s official website, Faus said: “We followed an austere line, as we’re committed to growth, and we’ve reduced the debt, but we are still in a delicate situation.

     

     

    “The debt is still too high for us to be able to dictate our future.

     

     

    “It’s not the debt that we want, and we have to reduce it further to sustainable levels with regard to the cash flow generated by the club.

  25. Evening Celts, there is understandably a lot of anger re the proposed regulation changes.

     

    I’m waiting to see what CFC have to say on this, there are supporters of clubs in the SPL who won’t stand for it, our clubs have an obligation to look after our interests and indeed their shareholders.

     

    Let’s see where it takes us, hopefully out of a corrupt league.

They are getting their wrist slapped, (if not infact getting handed a gold star and an appology for having inconvenienced them!), for what is in effect, a hanging offense!

    Did something happen?

     

    Also the rules have been changed so that there can be no one (or 2) club(s) having a veto. I wonder what club that rule is aimed at?

     

    I wonder if our bored are relieved that they dont have to show their cards

     

    or pissed off that they cannot?

     

    It’s a disgrace!

     

    No remorse. No apologies. No guilt. No admission that crimes have been committed. Just more giggling at the cheating. I wouldnt trust HMRC either.

     

    The only thing I am hoping for is either a) UEFA intervention (not likely) b) HRMC have already made their minds up because this is step 1 to go after the EPL clubs.

     

    In my opinion If the huns are still around there will never be any Celtic success in Europe.

    Only downer was the rocket who seems to have empty seats all around him. I had assumed at first a bus hadn’t made it until I realised the empty seats are there to allow him to create a saliva moat as the game goes on.
