SPL propose rules for Newco FC

We told you back in October last year that Rangers were likely to be liquidated and a Newco FC would be formed, which the SPL would vote back into the league.  Today the SPL issued terms of how the deed will be done as they issued 8 resolutions to be voted on later this month.

The key resolution is 2A, which establishes a procedure to phoenix a Newco into the place of an ex-club.  Crucially, this resolution only requires the support of 8 SPL clubs, all 12 of whom will be eligible to vote at the meeting.  5 clubs would be needed to block this proposal and right now there is only one willing to do so.

Resolutions are as follows:

Resolution 1 proposes an increase in the sporting sanction (points deduction) on any Club which suffers or is subject to an Insolvency Event from 10 points to the greater of 15 points and 1/3 of the Club’s SPL points in the preceding season.

This resolution increases the penalties imposed following an insolvency event, it requires the support of 8 clubs to be carried and should be supported.

Resolution 2A proposes further sporting sanctions in the event that any Club undergoes an Insolvency Transfer Event (i.e. transfers its share in the SPL to a new company where this occurs because of the insolvency of the transferor) of 10 points in each of two consecutive seasons from the Insolvency Transfer Event.

This resolution provides for an ‘Insolvency Transfer Event’, defining what happens when a club ceases to exist and a Newco FC is formed.  No provisions currently exist for such a scenario and I see no reasons to introduce any.  The resolution requires the support of 8 clubs to be carried and must be opposed.

Resolution 2B proposes revisions to the fee payment arrangements i.e. SPL fees to any Club which has undergone an Insolvency Transfer Event will be reduced by 75% in each of three consecutive seasons from the Insolvency Transfer Event.

This resolution provides for a financial penalty in the event the Insolvency Transfer Event resolution is voted through and requires the support of 11 clubs.  This is an outrageous and arbitrary increase in support required to impose financial sanctions.  All an Insolvency Transfer club needs is the support of one other club to halt financial penalties.

If resolution 2A is passed, resolution 2B should be subject to the same voting criteria and must be supported.  The SPL must ensure a financial penalty is imposed for financial misdeeds.

Resolution 3 proposes extending sporting sanctions where an Insolvency Event is suffered by a Group Undertaking of a Member Club of the SPL (Group Undertaking is defined in Section 1161(5) of the Companies Act 2006).

This resolution confirms insolvency events at group owner level are applicable to the club, requires the support of 8 clubs and should be supported.

Resolution 4 proposes updates and extensions to the definition of Insolvency Event in the SPL Rules.

I assume this is an administrative requirement and needs the support of 8 clubs.

Resolution 5 proposes updates and extensions to the definition of Insolvency Event in the SPL Articles and clarifies the process in the event that a Member which is the subject of an Insolvency Event is required to transfer its share in the Company.

This is a technical resolution defining how clubs lose or transfer their share in the League.  It requires the support of 11 clubs but it is not clear if has any consequence, more than clarifying administrative procedures.

Resolution 6 proposes a specific requirement in the SPL Rules that Clubs must pay their Players in terms of their Contracts of Service on due dates and places a duty on any Club to report any failure to pay its Players in a timely manner to the SPL.  Failure to pay Players and / or to notify such failure to the SPL would be a breach of SPL Rules.

This resolution should enhance fair play, requires the support of 8 clubs and should be supported.

Resolution 7 proposes a requirement in the SPL Rules that Clubs report to the SPL any failure to make payments to HMRC in respect of PAYE and NIC (a Default Event).  Any Club suffering such a Default Event will be subject to a Player Registration Embargo.  Any failure to report a Default Event shall be a breach of the SPL Rules.

This resolution prohibits clubs in tax arrears from signing players, requires the support of 8 clubs and should be supported.

If only they would pay their taxes we would not need to bother with any of this.

In full flow there and then the bleeding text vanishes…hate using these ipads thingymebobwhotsits…the vast majority of fans of ALL clubs, including Hertz, are all as outraged as us at the whitewash concocted by that suited SPHell cabal we call the gang of ten. This is patently obvious from just a cursory glimpse of our rivals fans forums- our problem: despite paying our taxes & playying by the rules we are hated just as much as der hun in some circles.

    IMO the course of action that benefits the most people is for Them to pay their debts. It benefits everyone in this country that obtains benefits from publicly funded bodies (e.g. the NHS). Thats about 60 million people. It benefits those people who follow Them as it allows them to maintain their history and their view of dignity. If the time under penury to pay back the debt equals the time spent benefiting from their tax wheeze then I’d take that as karma working again.

     

     

    Who this doesn’t benefit is the current owner, whoever that may turn out to be. A few people at most. At risk is £1.

    The SFA and the rest were going to pull the plug on Celtic in 94 for £1M.

     

    We didnae have any double contracts, we didnae cheat our way to league flags and cups, we just had a board that wurnae very good businessmen.

     

     

    The Bunnet got us out that hole, by honest investment and a lot of hard work.

     

     

    A lot of handshakes, wiks and nods are getting them out of theirs.

    Still not fully able to put into words my disgust at these proposals.

     

     

    As I mentioned earlier in an email to the Fat Bhoys Slim, this is akin to East Germany and the Stasi’s “sponsorship” of BFC Dynamo.

     

    The corruption is as balatant today here, at it was back in the 70’s there.

    1. Celtic should publish in full the proposals (the SPL news item merely summarises the key points). This should include the proposers.

     

     

    2. So far RFC (IA) has openly cheated. If these proposals are voted through then all those voting in favour have joined the cheats.

     

     

    3. I will not pay to watch cheats and so if CFC propose to continue in the SPL I won’t pay to watch that.

     

     

    4. If CFC arrange to then play in the SFL I will be happy to pay and re-new.

     

     

    5. If CFC want to join another league (USA, Ireland?) I will renew and support.

     

     

    6. If CFC want to become Harlem CFC and Globetrot I will renew happily.

     

     

    Let’s be clear. The gang of 10 are relying on Celtic doing what they’re told and sitting at the back of the bus so they (the 10) can continue to survive via TV money.

     

     

    No Celtic, no TV money. Be Clear. We can out live all of them in any disruption. In any disruption I will spend all my spare dollars supporting that cause.

     

     

    There are great minds at and all around Celtic. I expect those minds to not only explore but find and enforce a future that means Celtic survive and thrive.

     

     

    We don’t need no stinking Huns. We don’t need no stinking SPL.

     

     

    What we do need is to be clear on a strategy that gives us a strong future without the 1-11 corrupt clubs of the SPL.

  22. Could it be that Regan & Doncaster saw this as a way to appease the rest of the footballing world? That they thought newco not being allowed back in was a strong possibility and that this might allow them a way to wriggle out of it?

  24. Hello to all at cqn – first time poster but a daily lurker from way back from pre black sunday . Paul , fantastic site , love the points raised from the happyclappers / mineshafters on the , pro / anti board , sammi / broony / big fraser debates and many others talked about over the years .. Some great posts which show that no matter what , we all want the best for Celtic but we just have different opinions on how , whatever is the topic of the day , can be best achieved . Difficult first post to start with regarding the proposed new spl rules so take it easy on me fellow Celts ! !

     

    Club are in a awkward position in regards to what happens if newco ( rfcia ) are allowed back into spl , as are being posted tonight . Various scenarious ie resign , move to another league , boycot etc . Think the first two are no goers , resign – play were ? sfl 3 ? financial mess , move – were to ? nothing feasible at the moment . Boycot ? best option but hard to implement . We would need practically all the Celtic family to cancel sky / espn etc . Away games , great idea but it aint gonnna happen . A few weeks ago there were calls for a boycott of ibrokes and killie and because of what was at stake the Celtic allocation could have sold out 3 times over . In my opinion this will always happen , plus there are loads of fans who will follow the team everywere no matter what .

     

    Celtic should say nothing , until the btc is resolved and the spl meeting votes on the new proposals , whilst at the same time work away in the background , with the best legal minds planning for all scenarios . Then if needs must , publish the

     

    ” dodgy dossier ” and sue the life outa the sfa / spl if its proved that the use of ebt’s , double contracts were ilegal .

  27. I am still in shock with all of this, if there is any decent Rangers fans out there surely they can see this just ain’t right.

     

     

    It’s as if they’re rewarding Rangers with all their tax dodges.

     

     

    It’s a total shambles and I can’t believe I won’t be watching my beloved team anymore. I just can’t stand back and allow this to happen.

     

     

    Our club has run a tight ship for years and we have been cheated for years and so has other SPL teams.

     

     

    They can’t get away with this, for the good of the game something has to be done.

    I agree 100% with you 67Heaven. We have been treated unfairly for a long long time by the powers that be in Scottish football and that is why last Saturday at Rugby Park felt so good, it is why Tannadice in 2008 felt so good, it is why beating St Johyntsone 2-0 in 1998 felt so good, it is why 4-2 with 10 men in 1979 felt so good etc, etc, etc

     

     

    Let them cheat, let them swindle and despite their best efforts we will continue to enjoy being the greatest supporters in the world following the best team in the world – faithful through and through.

    These cheating hun pigs cannot have it both ways. If they keep their history then they should keep the big tax bill and be made to pay it over however many years it takes.

     

     

    I work in Edinburgh and share an office with supporters of Hibs, Hearts and Dunfermline. To a man and woman they are horrified by today’s revelations. We already know how the majority of Aberdeen fans feel and I would imagine the sentiments are the same across the board.

     

     

    We must find a way to unite with fans of the other clubs to make it clear that we simply will not participate in a bent and corrupt league.

  32. As far as I know, Celtic can’t sue the SFA under UEFA rules. But presumably we could sue the SPL without incurring any punishment.
