The Bank, financial doping and moral hazard

Dundee United chairman Stephen Thompson’s comments to yesterdays’ Herald are worthy of attention.  During the summer, when United received a £1m bid from Rangers for David Goodwillie and Blackburn Rovers were hovering, Bank of Scotland, took an active part in the deliberations.  Thompson told the Herald, “The bank wanted me to take £1.2m for him, but I said no to that. I had to stand up against the bank.”

Thompson more than doubled the money on offer for Goodwillie, allowing him to shave over £2m off their bank debt, but this exchange took place only a few months after the same bank told former Rangers chairman, Alastair Johnston, to accept the bid for the club from Motherwell born thousandaire Craig Whyte or the bank would demand same-day repayment of Rangers borrowings.

Bank of Scotland, part of Lloyds Banking Group (LBG), are significantly exposed to Scottish football and required a taxpayer bail-out two years ago, so although their interference in the running of clubs could seem overbearing, we shouldn’t be surprised at it.  It’s business, and if you are employed at LBG with a responsibility to your taxpayer-shareholder, it’s necessary business.

Fortunately, Celtic are free from such interference, as are Rangers, thanks to their aforementioned benefactor, but if a liquidation event at a large club threatened income streams to the league I would be amazed if the Bank didn’t use the ‘Vote Newo FC  into the SPL or repay your borrowings immediately’ line.

Stephen Thompson, who sits on the SPL board, might not have a choice on whether or not to vote a Newco FC into the SPL ahead of 30 Scottish Football League clubs, but he and his fellow board members will be able to set the tariff on any exceptional league entry to what would become a financially privileged football franchise.

12 seasons of cumulative benefit from financial mis-dealings should result in 12 seasons of penury at whatever points rate the league calculate benefit was accrued.  For one scenario I have in mind, around 15 points per season sounds fair, with an expunging from the records of any trophies ‘won’ by Financial Doping.

This is measured, deliverable, is in the power of the SPL board to impose, and sets a minimum moral hazard to inhibit future mis-deeds.

    These 3 cover the requirement, substitute clubs for country and individual. The only discussion is what is appropriate and there are many options depending on what scenario we face.

     

     

    My starting point is that reparation has to be a key principle for allowing the continuation of Rangers as NewRangers in the SPL or as Old Rangers if they get time to payu and no one is articulating that point in response to the other commercial arguments.

     

     

    I would say to those who want a commercial solution that it HAS to include reparation or the game is a bogey and there will be commercial loss anyway.

     

     

    Paul’s article confirms nothing, it only sets out what we are facing and provides an opportunity to make a case to those who will be making the decisions.

     

     

    The Rangers agenda is too deep six the reparation argument for obvious reasons, it will be extremely uncomfortable to them and their ability to rule the roost would be severely curtailed by it.

     

     

    That in itself makes it worth fighting for are and if you want to bring about what you want to see in our game then you have to create that reality. It will not be created by thinking nothing will change.

    There is nothing like that moment when your walking up to Paradise, ticket in hand, and then you get in, up the stairs and there she is – CEltic Park in all her glory, your comrades in Celtic all around with common purpose, the men who represent our club warming up.

     

     

    For all the talk of money and sporting integrity and NEwco and all the rest of it, and I’ve said this many a time on here, I support Celtic and I support them because the people who created Celtic did so for the people I belong to. I am the third or fourth generation that I know of in my own family to have followed the Celtic, my children are the next generation and whatever else happens Celtic is my club, their club, your club and needs no reference point to any other. We are what we are and we don’t need defined by anything else.

     

     

    I’ve watched great games and I’ve watched awful drudgery but regardless Paradise is home. Enjoy the game. Wish I was going.

    Absolutely but first the case for repartion needs to be put. It seems to me that it is being avoided mainstream but that is OK because what we argue for here (if sensible of course) always goes mainstream eventually. So we need to soften them up.

     

     

    In fact tonight I heard a caller touch on the matter of integrity and they simply did not want to look at the issue because as things stand nothing wrong has been done. But once the FTT rule, and if it goes HMRC’s way, the reparation case will be impossible to argue against.

     

     

    Then it is a case of adapting your 2 points to suit.

    My wife was briefly self employed about 10 years ago. She never earned enough to pay any tax but always submitted the returns etc.

     

     

    Gave up the wee bit of work she did but received the ‘Returns’ letter every year followed by the threat of fines etc. Every year she wrote to them, phoned them, e-mailed them to say she was no longer self employed.

     

     

    I would say it went on for 4 or 5 years until I myself wrote a letter which mentioned the possibility of a solicitors letter being our next response as we felt we were being unfairly harrassed and my wife was under mental stress as a result of the constant demands and threats.

     

     

    Never heard anything from them since. That’s maybe three years ago? The lack of apology didn’t offend.

     

     

    So, I don’t have any legal expertise in it but I personally found that a threatening letter, all of course in the best possible taste and without getting myself in trouble, did the trick.

    After reading your article and some of the subsequent posts I’ve come to the conclusion that the Sky TV deal will fall flat next season. If Newco2012 are not allowed back into the SPL then the deal is off. If they are allowed back in but with a punitive (but well deserved) point deduction – having had to sell key players then their decimated and handicapped team would likely finish outside of the top 6 and the stipulation of 4 Glasgow Derby matches would not be fullfilled and the Sky deal would collapse.

     

    Either way the deal is off.

     

    Also, do you think the the Celtic board would threaten to resign from the SPL if Newco2012 was let straight back in? Surley the loss of Rangers is more palatable to the bank than the loss of both Rangers and Celtic.

     

    Lastly, is it not possible for the team from the 1st division who were denied promotion due to Newco2012 being allowed to assume Rangers position in the SPL to mount a legal challenge i.e. sue the SPL / SFA???

    ⦿ Celtic kept the same company registration number. Meaning that it was the same company, just with a different trading name. The records at companies house show that Celtic plc reg no. SC003487, and incorporated on April 12 1897, has traded continuously for 114 soon to be 115 years

     

     

    ⦿ There was a seamless transition, where Celtic plc, because it was merely a name change, continued to PAY all creditors, Tax Man, VAT, Banks, The Irn Bru supplier…… Pay everyone in full….

     

     

    It has to take some special kind of desperation to suggest that a Rangers Newco, who will stuff ALL creditors, apart from Whyte, and will form a New Company (Newco),are in any way similar to Celtic

     

     

    Desperation isn’t even a full enough description, it’s desperation mixed with arrogance, which refuses to believe that anything penal should happen to their club

    It is against the whole integrity of football and sport in general to have such a contract. Would teams lie down and let them win to preserve the Sky deal and in turn their own jobs?

    I was on self-assessment back in the 90’s. When I first started, the Tax Office was very helpful and used to work out what my entitlements and dues were. Now they expect you to do all the work and are quick to claw back any under-payments. However the reasons I needed to go on self-assessment were removed and when I pointed this out to the Tax Office in writing, they allowed me to go back onto normal PAYE.

     

     

    Might be too late to get you out of this year’s hassle but it is worthwhile trying to get off next year’s.

I sincerely hope Celtic have made some form of representation to the SFA explaining that if indeed RFC go bust, and are allowed re-entry to the top tier the SPL under a new name, then Celtic will be taking legal action to recover the financial losses we incurred due to a member club unfairly and illegally gaining entry to Europe at our expense. We operated within the rules, on an unfair playing field, and a precedent will be set to allow similar behaviour to occur in the future by any member clubs who choose to do so knowing the only “risk” involved is a points deduction on reintroduction under a new name.

     

     

    As for the media, the really have exceeded my expectations in terms of just how biased and pathetic they really are, and my expectation was already lower than a snakes belly. Forget the nonsense being spouted about how the collapse of the cheats and fraudsters will ruin the Scottish game. We are about to discover the game has been operating unfairly for a number of years by the inclusion of fraudsters. Add the cheating referees and you start to wonder how we have ever managed to compete at all over the most recent 10 seasons.

     

     

    When Celtic faced going to the wall, it was a case of “reap what you sow”. In our case, an honest gentleman in the shape of Fergus McCann, appeared as our saviour, and using his hard earned money, planned and executed a recovery under the rules laid out. Throughout this time, the press lambasted the Whites and Kelly’s for their neglect in taking the club to the brink of extinction. I heard no calls, nor read no headlines concerning fear for the Scottish game should Celtic die. For the first time in my life I saw gravestones on the back pages depicted almost as symbols of celebration Yes, the badly veiled jubilation in the media ranks was tangible. We played fair though, and we emerged with the famous name of Celtic FC alive and kicking, and with it’s dignity intact.

     

     

    Dignity. There is hardly a media outlet in Scotland left who can lay claim to that word. This whole fiasco has only cemented what most of us already knew about their integrity. I read James Forrest’s piece on facebook last night on that disgusting excuse of a human being that is Jeff Winters. I was beside myself with rage at his sheer hatred for the Catholic church and Celtic FC, but James expressed the same feelings much better than I can. Read it if you have access) Having had more time to consider things this evening I have arrived at the conclusion that the Scottish media are every bit as bad as that vermin. Probably worse actually. At least Winters had the balls to come out put the words from his evil, bitter, bigotted and twisted mind into print. The cowards that are Scotlands press try to justify their bitterness with lies. Crass stupidity, especially when you consider they expect any semi intelligent reader or listener to buy into it.

     

     

    Finally (you will be glad to hear), such are the volume of sympathisers and mercenaries within the other member clubs, I expect no opposition from a single club outside Celtic to the filth being given preferential treatment from the SFA. Every one will take a decency bypass to ensure the minimum of fuss. Were it the other way around and we were trying to cheat our way back in? I’d expect backing from 3 clubs maximum.

    Your solution accepts that they will be allowed re-entry but would like to see them financially curtailed and denied a realistic chance of winning the league for x number of years – a sort of Treaty of Versailles for the Govan huns. Not sure if that’s a great example to follow.

     

     

    All of this is moot, because unless UEFA step in, RFC will re-enter the SPL, reclaim their history, and remain part of the upper tier in Scottish football because any other scenario would be financially catastrophic for the other clubs. Something will have changed. We’ll all be a year older.

    Hearts major creditor is Romanov, or at least his bank. Romanov is not likely to get his money back but wants out.

     

     

    The MBB allows Rangers to go bust and as per his security takes Ibrox Park and some of the playing staff. Just before that happens he files a change of name form at Companies House to anything you like, say “Huns FC Ltd”. A consortium of Huns simultaneously buy Hearts for £10m, and relocate to Ibrox and rename themselves, em, Rangers, having secured the right to play there in a deal with the MBB who owns the stadium. Romanov gets £10m of his £30m, cash. Crucially he gets to keep Tynecastle and sells for redevelopment and recoups another £10m. Compared to his current position it has to be attractive. Hearts have never defaulted and are legitimately an SPL Club, now playing in a bigger stadium under new name.

     

     

    There is now a space in the SPL for another SFL Club to be promoted. The riddle is, who’s missing? Hearts continue to exist under a new name and ‘Rangers’ are still playing at Ibrox!

    To be fair, the old board could have done this in the summer of 2009 or 2010 with the guarantedd ECL dough.

     

     

    A slimmed down team, star players sold, transfer cash and ECL bonus cash salted for a rainy day, with the option to sell and lease back the stadium providing a backstop in the event that the final tax bill was a whopper.

     

     

    They chose not to, and their club will likely be dissolved as a consequence.

     

     

    Whatever comes next, they chose it.

    I have to disagree with your comments on how we would be received by opposition fans down south.

     

     

    Celtic are extremely well respected in England. And the only occasion I have seen any bother at a competitive match with an English team was Burnley in 1978.

     

     

    I’ve been to Nottingham, Liverpool, Blackburn, Manchester and London since then and never encountered any trouble.

    The biggest loser in financial terms if your scenario is accurate (and I’m not arguing it is not, simply that his motivations are stiil unclear) is in fact HMRC. I am not convinced they will be so easily led by the nose and all they have to do to put CW on the spot is to propose a deal that allows the back taxes to be paid in FULL over a punitively ( for Rangers) short time scale because, as you say, Rangers can downsiize, still continue on a sustanable basis and pay back what is owed.

     

     

    As a tactic for flushing CW out I would not be surprised if HMRC in fact table such a proposal. The danger to our game from this scenario is that an uncorrected Rangers will try to use UEFA money to ease their pain at others expense using favour and the football price they must pay is any UEFA money earned goes into the game as a whole and not their coffers until the bill is cleared.

    This discussion is depressing me. To the point of making my fist post despite lurking on here from the very start.

     

     

    We should not be setting the conditions under which we will accept Newco into the SPL. We should be making a clear and unequivocal statement that we will not accept it – under any circumstances. There is no fall back position,no negotiations, they’re treated like any other new club or the game’s a bogey.

     

     

    It is supposed to be a sport if we allow financial considerations to influence a decision of this magnitude how could we ever trust any decision ever again? There would be no point in continuing as we’d have all the evidence we need that the game is rigged.

     

     

    What would be the point of admitting Newco only to hamstring them to make them uncompetitive? Any titles won in these circumstances would have the same value as any tainted titles won during the EBT years.

     

     

    PS just cos it’s my first post doesn’t make me one of them.

    Who cares if they get a 25 point deduction every year? They will never be relegated.

     

     

    In effect, what we are saying, not just to Celtic, but to all SPL clubs is this: see that club that cheated and swindled you down the years by buying in foreign stars and taking your players on money they never had? Well, they’re going out of business, but get this – you will all have to accept them straight back in as Newco Rangers, as if nothing had ever happened – if not, we pull the plug on the credit facility of all bar Celtic and maybe one other (St Mirren?).

     

     

    Not only that, but woe betide you if you allow them to drop to the bottom 6 of the league over the next few years. Do that, and we pull the TV deal.

     

     

    So there you go – pay your money, and come to this dreary puppet show once a fortnight, knowing that nothing will change, and you’re stuck with this forever.

     

     

    Somebody please tell me our club is proactively seeking ways of joining either the Dutch or English leagues.

    Didn’t encounter any bother at Nottingham or Liverpool (who were as good as gold) but Blackburn, QPR and Manchester was a different story

     

     

    In fact, some of the worst violence i’ve witnessed was at OT for our CL game in 2006. If we ever got admitted to even the FL Div 3 to start with, there would be plenty of problems for the first few years due to the English hooligan element which would travel here in big numbers

    In reality I employ an accountant to do my online tax return where I include some items (like institute memberships) which means the nice tax people send me a cheque and I pay the accountant from that.

     

     

    It all seems a bit pointless really, I’ll phone them tomorrow.
