EBTs “Gave us the opportunity to get players we otherwise couldn’t afford.”

With those words in the Glasgow High Court witness box yesterday, Sir David Murray laid bare the sporting advantage question of Rangers EBTs. EBTs gave Rangers a sporting advantage. If the loans were illegally executed, the club gained an illegal sporting advantage.

At the time of the Lord Nimmo Smith Commission the payments were regarded as legal, the Commission therefore ruled that no illegal sporting advantage was gained, as any other club could have acted in the same manner. The Supreme Court will have the final say on the legality later this year.

You and I know better than to hazard a guess as to which way that decision will go, but it will be worth tuning in for.

That aside, former vice-chairman of Rangers, Donald Findlay, representing former chairman of Rangers, Craig Whyte, appeared to enjoy questioning Sir David, another former chairman of Rangers, more than old Zsa Zsa in the witness box enjoyed being questioned.

    Police officers questioned a man outside the High Court in Glasgow yesterday as former Rangers FC owner Craig Whyte entered the premises.

     

     

    Officers were seen questioning the man in a side street near the court where Mr Whyte was expected to attend the trial.

     

     

    It is believed that Mr Whyte was the one who made the complaint to police after a man shouted something at him as he was about to enter court for yesterday’s evidence.

     

     

    Trial was subsequently adjourned until tomorrow, although it is understood that the police incident was completely unrelated as a jury member being ill was blamed for the adjournment.

     

     

    Whyte faces two charges in connection with his 2011 takeover of Rangers.

     

     

    He denies a fraud allegation and a second accusation under the Companies Act.

     

     

    A spokesman said: “Around 9.45am police were called to an incident on Osbourne Street near the High Court. Inquiries are ongoing.”

    I always thought the side letters/registration issue was the wrong basis to make a case .

     

     

    I understand why the rush, but the nature of the ebts that only Rangers used in the form they did was and remains a fundamental defect in observing Article 5.1 a and 5.1 (f) of SFA Articles.

     

     

    5. Obligations and Duties of Members

     

     

    5.1 All members shall:-

     

    (a) observe the principles of loyalty, integrity and sportsmanship in accordance with the rules of fair play;

     

    (b) be subject to and shall comply with:-

     

    (i) these Articles;

     

    (ii) the Judicial Panel Protocol;

     

    (iii) the Challenge Cup Competition Rules;

     

    (iv) the Registration Procedures;

     

    (v) International Match Calendar;

     

    (vi) Club Licensing Procedures; and

    Professional Game Board, the Non-Professional Game Board, the Judicial Panel, a

     

    Committee or sub-committee, FIFA, UEFA or the Court of Arbitration for Sport;

     

    (c) recognise and submit to the jurisdiction of the Court of Arbitration for Sport as specified in the

     

    relevant provisions of the FIFA Statutes and the UEFA Statutes;

     

    (d) respect the Laws of the Game;

     

    (e) refrain from engaging in any activity, practice or conduct which would constitute an offence

     

    under sections 1, 2 or 6 of the Bribery Act 2010; and

     

    . (f) behave towards the Scottish FA and other members with the utmost good faith.

  10. My first reaction at the Broonie decision was one of hilarity, primarily because i knew the Huns would go into meltdown and i also want him available for Saturday. However, now that the dust is settling i do have some concerns. In my opinion and i said so at the time, it was a red card. We can only assume that Celtic presented their case extremely well, no doubt arguing for the lesser charge and using precedent set by similar tackles on our players during this campaign, Halliday amongst others. Perhaps we can also assume that at least 2 members of the 3 man panel look upon Celtic favourably or the Huns unfavourably. Trust me there are a few Hibs fans on social media absolutely delighted with the decision. Now getting to my main point, i am concerned that opposing teams have now been given carte blanche to kick us off the park, or to be more accurate to continue as they have been doing. It’s all very well laughing at the Huns because you just have to but this could come back to bite us or to be more precise one of our star players. I sincerely hope not. Or maybe the Huns are right and it is some kind of Peter Lawwell inspired conspiracy.

    The appeal does not compare to other incidents in other matches.

     

     

    The Broony “foul” is judged on its own merits.

    Because you or anyone else thought it was red matters not, but fortunately Celtic understood the appeal process and the greyness of the red decision.

     

     

    Scott Brown plays, and Celtic will get kicked with impunity.

    The on loan Celtic centre-half was the only player to keep his place in the side for the visit of Rovers after head coach Neil Lennon made ten changes to the team that lost to Aberdeen in Saturday’s Scottish Cup semi-final.

     

     

    SPFL rules state that players must play in at least nine matches, whether starting or as a substitute, in the second tier to qualify for a medal, although Hibs could appeal for more mementos for squad members that fail to reach that milestone.

    Just told my mum the reason of the red card getting changed to a yellow she couldn’t believe the wording of it if anything recklessly dangerous play is worst than serious foul play lucky if she watches 1 full game a year.

    I’m sure Efe is a really nice guy and he can do a terrific somersault. But his “gaffes ” cost Celtic dear and gave us heart attacks watching them. I sure he’ll do reasonably well at Hibs, and I wish him well.
